INTENTION TO REMOVE TREES IN PUBLIC STREETS.
Be it ordained by the City Council of Ames , Iowa, as
follows
SECTION 1 : Section 1 of Ordinance No. 807 is here-
by repealed and the following shall hereinafter be
known as Section 1 of said ordinance :
SECTION 1: Control Established, The City of Ames
hereby assumes charge, custody and control of all
- trees and shrubbery upon the public streets and
the right to plant, prune, care for, remove and
maintain all trees and shrubbery upon the public
streets, except as hereinafter provided.
SECTION 2: Section 3 of Ordinance No, P'97 is hereby
repealed and the following shall hereafter be known as
Section 3 and Section 3-A of said ordinance :
SECTION 3 : Planting of Trees Within ;street Limits.
The planting of trees within street limits shall
be done by the city or private property owner in
accordance with a revised street tree plan and
program proposed by the City Plan Commission and
approved by the Council„ Such plan shall be based
on a classification of street uses, and shall re-
cognize that certain streets are primarily designed
for traffic and others for access to property,
Pending approval of the proposed street tree plan,
trees may be planted in the parking at points de.
signated by the City .14anager, the varities to be
those designated by the City Plan Commission,
SECTION 3-A : Tree Removal, Dead trees, damaged
and unsightly trees, and trees that constitute a
real danger to safety, may be removed at the air-
ection of the city manager, If other trees are
designated for removal, the city manager shall
cause a notice of such intention to be posted on
the particular tree, Such notice shall remain
posted for a period of not less than 15 days, dur-+
ing which period any local resident may file a
written objection with the city manager. If such
objections are filed, triey shall be referred to a
special committee of three members, appointed by
the mayor, with the approval of the city council,
The term of office of the committee shall be two
years. This committee shall review the facts in.
cident to the proposed tree removal, the objections
filed, and may authorize the removal of the tree
or sustain the objections, Either party may, within
three days, file a written appeal from the committeets
decision to the council. This procedure shall not
apply to trees designated for removal in the 1955
and 1956 Sidewalk Repair Program,
SECTION 3 : Repeal, All other ordinances or parts of
ordinances in conflict herewith are hereby repealed,
SECTION : This ordinance shall be in full force and
effect rom and after its passage and publication as
provided by law. CD

Moved by Smith and seconded by De Hart that the rules governing thepassage
of ordinances be suspended, the second and third readings be omitted and
Ordinance No. 872 be placed on its final passage.

pass.
