HomeMy WebLinkAbout~Master - Vacating a Piece of Land, Repealing Ordinance 867 ORDINANCE NO. 871 AN ORDINANCE VACATING A TRIANGULAR PIECE OF LAND ON THE VVES T SIDE OF HYLAND AVENUE, IrUED- IATFLY NORTH OF OAKLAND STREET, AND REPEALING ORDINANCE NO. 867 . g:_�, 7 Be it Ordained by the City Council of the City of Ames, Iowa, as follows : SECTION 1 : That a parcel of land described as : A triangular parcel of land starting at the Southeast corner of Lot 3 in the W2 Sw of Section 4, Township 83 North, Range 24 `Nest of the 5th P.M. , thence northwesterly along the East line of said Lot 3, and the East line of Lots d and 9, Block 1, Briley's Addition to Ames, Iowa, a distance of 216.7 feet to the Northeast corner of said Lot 8, thence East 37.5 feet to the West line of Hyland Avenue , thence South 214.1 feet to the point of beginning, subject to easement for sanitary sewer as now installed. the same being adjacent to and a part of Hyland Avenue in Ames, Iowa, is hereby determined to be unnecessary as a part of a public street and is hereby vacated and discon- tinued. SECTION 2 : That it is hereby determined as necessary and proper that the City retain a right-of-way and easement for any and all public utilities as now installed over, under, and across the said parcel of land. SECTION 3 : That the Mayor and the City Clerk are hereby authorized and directed to execute quit claim deeds, sub- ject to utility easements , conveying said parcel of land to the abutting property owners, as their respective in- terests may appear. SECTIONAL. : That the City Clerk is hereby authorized and directed to make a certified copy of this ordinance and attach the same to said deeds. SECTION 5 : Ordinance No . 867 and all ordinances or parts of ordinances in conflict with the provisions of this ordnance are hereby repealed.
