HomeMy WebLinkAbout~Master - Adopting Municipal Code , I; ORDINANCE NO. 864 AN ORDINANCE TO ADOPT A MUNICIPAL CODE AND TO REVISE, AMEND AND CONSOLIDATE THE GENERAL ORDINANCES OF THE CITY OF ANES, IOINA, INCLUDING'- THOSE IMPOSING A FIA?E OR PENALTY, PR.OVIDINC A PENALTY FOR THE VIOLATION OF THE PROVISIONS HEREOF AND REPEALING ALL ORDINANCES OR 'PARTS THEREOF IN CONFLICT HEREWITH, WHEREAS, pursuant to Resolution No, 2882 adopted by the City Council of the City of Ames, Iowa, the 2nd day of October, 19-56 at 8 :00 P.M. in the council chambers of the City Hall of Ames, Iowa was designated the time and place for a hearing on a proposal to adopt a municipal code, and WHEREAS a public notice of hearing on said proposal was published in the Ames Daily Tribune, Ames, Iowa, once each week for two consecutive weeks, all as directed by Section 366.7 of the 1954 Code of Iowa, and said hearing; was duly held at the time and place designated at a regular session of the Council, and INHEREAS no written objections to the adoption of the proposed municipal code were filed in the office of the City Clerk, and no oral objections to said adoption were made at the said hearing, and ,.TiHEREAS the City Council then determined that the said proposed municipal code be adopted in its original form as now filed, NOW THEREFORE be it ordained by the City Council of the City of Ames, Iowa: Section 1. Municipal Code Adopted. That the proposed municipal code of the City of Ames, Iowa, as now on file in the office of the City Clerk at the City Hall in said city be, and the same is, hereby adopted as the municipal code of the said City of Ames, Iowa; that said code shall completely supersede all Page 2. general ordinances passed by the City Council prior to the enact- ment, except such as are by _reference expressly saved from repeal or continued in force and effect for any purpose; the City Clerk shall attach to the official copy of the municipal code as here adopted his official certificate showing such adoption and the effective date thereof, and shall retain the said copy and cer- tificate on file in his office where the same shall be subject to public inspection. Section 2, Amendments. Any additions or amendments to this code when passed as ordinances amending this code and which indicate the intention of the city council to make the same a part hereof shall be deemed to be incorporated in this code so that a reference to the')municipal code of Ames shall be understood to include them. Section 3. Legal Publications. No officer or employee of the city shall issue, mail or distribute as a publication on the part of the city or any officer, department or branch of the city government any book, pamphlet, leaflet, card or other printed matter purporting; to contain excerpts or quotations from this code or purporting to give the law on any subject herein to the public, either as a reprint of an ordinance or as a digest, interpretation, resume, condensation or explanation of the sane, without submit- ting such material to the city solicitor for examination and approval as to form and contents. Section L. Distribution of Code. All printed copies of the code shall be deposited with the City Clerk . He shall de- liver copies of said code to all departments of the city adminis- tration as needed, and in addition one copy &-the State Law Library, one copy to the municipal library, one copy to the .Ames Daily Tribune , one copy to radio station KASI in Ames, one copy Page 3# to Iowa State College library, one copy to the Clerk of the District Court of Story County, one copy to each established law office in the City of Ames and one copy to the secretary of the League of Iowa Municipalities* The City Clerk shall sell printed copies of said code at such price as the City Council shall fix. The city manager, city clerk and city solicitor shall have the power to reciprocate courtesies of other cities or agencies by presenting to each a copy of this code without cost. Section 5, Numbering of 'Sections. Each section number shall consist of two component parts separated by a dash, the figure before the dash referring to the chapter number of the municipal code and the figure after the dash referring to the position of the section within_ the chapter. The decimal system as established herein shall be used for all additions to this code. Section 6. Definitions, Unless the context requires other interpretations, the following words and t erras are defined for the purpose of this code as follows : a, City - City of Ames. b. State - State of Iowa. c, City Council - City Council of the City of Ames „ d, Code - the municipal code of Ames and all amendments thereto# Section 7, Construction of Words# Whenever any words in any section of this code impart the plural number, the singular shall be deemed to be included. and whenever the singular number shall be used it shall be deemed to include the plural; whenever the masculine gender is used in this code, females as well as males shall be deemed to be included; words in the present tense shall be deemed to include future tense. The word "shall` as used in this code is mandatory* Page 4. Section H, Amendment of Section Subject to Penalty„ In case of the amendment of any section of this code containing provisions for which a penalty is provided in another section of this code, the penalty so provided in such other section shall be held to relate to the section so amended whether reenacted in the amendatory ordinance or not , unless such penalty is specif- ically repealed therein„ Section 9* General Penalty. Whenever in any section of this code the doing of an act or the omission to do any act or duty is declared to be a breach thereof, and there shall be no fine or penalty declared for such breach, any person upon con- viction for the violation thereof shall be fined in a sum not exceeding one hundred dollars ( 5100.00) or imprisoned not to exceed thirty (30) days. Section 10, Savings Clause, The enactment hereof shall not be deemed to affect any ordinances establishing and changing grades, naming streets, making or providing for appropriations, tax levies or bond issues, vacating streets, dedicating property for public use, ordering construction or repair of public improve- ments, or ordinances granting special rights and privileges which are provided by law, or ordinances not herein specifically repeale 1. Section 11„ Old Offenses. Any civil or criminal actions now pending for violation of ordinances hereby shall be saved and not affected by the passage hereof. Section 12. Repeal. All ordinances or parts of ordin- ances in conflict herewith are hereby repealed. Section 13, Effective Date. The municipal code of Ames shall be in full force and effect from and after passage of this ordinance, as provided by law. Passed this 4th day of December 19 56 Ma r Attest , City Clerk.
