ORDINANCE NO, 843
AN ORDINANCE REGULATING TRAFFIC AND PARKING UPON THE STREE S,
AVENUES,, ALLEYS, AND PUBLIC PLACES OF THE CITY OF AMES, IOW A;
PRESCRIBING REGULATIONS RELATIVE TO THE PARKING OF VEHICLES
UPON SUCH PUBLIC STREETS AND HIGHWAYS; PROVIDING FOR
INSTALLATION, OPERATION., MAINTENANCE, SUPERVISION, REGULA-
TION AND CONTROL OF THE USE. OF PARKING METERS; PROVIDING FOR
FORTY-EIGHT HOUR PARKING LIMIT AND FOR THE REMOVALAND
IMPOUNDING OF MOTOR VEHICLES AND FOR DISPOSAL OF ABANDONED
VEHICLES; REPEALING ORDINANCES NUMBERS 728, 733, 734, 741, 745,
748, 830 aryl ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING PENALTIES FOR VIOLATION
OF ITS PROVISION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA;
WORDS AND PHRASES DEFINED
Section 100. Definition of Words and Phrases. The following
words and phrases when used in this ordinance shall, for the purpose of
this ordinance, have the meaning respectively ascribed to them.
VEHICLES, TRAFFIC, ETC., DEFINED
Section 101. Vehicle. Every device in, upon, or by which any er-
son or property is or may be transported or drawn upon a highway, exceptingf
devices moved by human power or used exclusively upon stationary rails or
tracks.
Section 101. 1. Motor Vehicles. Every vehicle whia'_i is
self-propelled. The terms "car" or "automobile61 shall be synonymous with
the term "motor vehicle".
Section 101.2. Bicycle. Every device propelled by human pow r
upon which any person may ride, having two tandem wheels either of whio'i
is over twenty (20) inches in diameter, and including any device propelled by
human power generally recognized as a bicycle though equipped with two (2)
front or two (2) rear wheels.
Section 101. 3. Motorcycle. Every motor vehicle having a saddle
for the use of the rider and designed to travel on not more thanthree (3) wheels
in contact with the ground but excluding a tractor.
Section 101. 4. Farm Tractor. Every motor vehicle designed
and used primarily as a farm implement for drawing plows, mowing machine s,
and other implements of ausbandry.
Section 101. 5. Road Tractor. Every motor vehicle sle•signed
and used for drawing other vehicles not so constructed zs to carry any load44
thereon either independently or any part of the weight 3,f a vehicle or load
so drawn.
Section 101. 6. Trailer. Every vehicle without motive power
designed for carrying persons or property and for being drawn by a motor
vehicle and so constructed that no part of its weight rests upon the towing
vehicle. Whenever the word "trailer" is used in this ordinance, same
shall be construed to also inalude "semi-trailer".
Section 101. 7. Trailer Coach. Any vehicle used, or maintain d
for use upon highways or city streets, said coach being so designed and so
constructed as to permit occupancy thereof as a dwelling or sleeping place
for one or more persons and having no other foundation than wheels or jacks
Section 101.$. Semitrailer. Every vehicle without motive
power designed for carrying persons or property and for being drawn by
a motor vehicle and so Constructed that some part of its weight and that of
its load rests upon or is carried by another vehicle,. A "semi-trailer" shall
be considered in this ordinance separately from its power unit.
Section 101.9. Special Mobile Equipment„ Every vehicle not
designed or used primarily for the transportation of persons or property
and incidentally operated or moved over the streets, including road
construction or maintenance machinery, ditchdigging apparatus and well-bori g
apparatus. The foregoing enumeration shall be deemed partial and shall not
operate to exclude other such vehicles which are within the general terms of
this paragraph.
Section 101. 10. Authorized Emergency Vehicle. Vehicles of
the fire department, police vehicles, and such ambulances and emergency
vehicles of the municipal departments, or such privately owned ambulances,
as are designated or authorized by the city. Authorized emergency vehioles
shall include ambulances, rescue or disaster vehiales owned or operated
by the State of Iowa or the United States,
Section 101. 11. Railroad. A carrier of persons or property
upon cars, other than street cars, operated upon stationary rails.
Section 101. 12, Railroad Train. A steam engine, electric or
other motor, with or without scars coupled thereto, operated upon rails, except
street cars,
Section 101. 13. Traffic, Pedestrians, ridden or herded
animals, vehicles, and other conveyances either singly or together while usil g
any street for purposes of travel.
Section 101. 14. Right-of-way. The privilege of the immediate
use of the roadway.
Se,ction 101. 15. Stop. When required means complete cessatio
of movement.
Section 101. 16. Stopping or Standing, When prohibited means
any stepping or standing of a vehicle whether occupied or not except when
necessary to avoid conflict with other traffic or in compliance with the
diret,:tions of a police officer or traffic-control sign or signal.
i Section 101. 17. Holiday. The following days shall be classi-
fied as ho�iday.s under this ordinance: Januaryfirst (1), February twelfth
(12) and twenty-second (22), May thirtieth (30), July fourth (4), the first
Monday in September, November eleventh (11), Thanksgiving Day as
proclaimed by the President or Governor, December twenty-fifth (25), and
the following Monday, whenever any of the foregoing Holidays fall on a
Sunday, and such other holidays as are set aside by mayor's proclamation.
Section 101.. 18. Parked Vehicle The term parked shall apply,
to any vehicle which is stopped within the lin-its of a highway or
municipally-owned, -leased or -controlled parking lot, whether occupied or
not.
Section 101. 19., Official Time Standard. Whenever certain
hours are named herein they shall mean central standard time.
Section 101,.20. Double Parked. When a vehicle is standing
on a roadway in such a manner that it is outside a parking space or the
wheels nearest the curb are more than eighteen (18) inches from the curb
it shall be termed "Double Parked".. On streets without curbs, any vehicle
parked within ten (10) feet of the center line shall be termed "Double
Parked".
Section 101. 21E Parking Meter. A device or devices which
shall indicate there on the length of time during which a vehicle may be Parke
in a particular place which shall have as a part thereof a receptacle or
chamber for receiving and storing coins of the United States money; a slot
or place in which said coin or coins may be deposited; a timing mechanism
to indicate the passage of the interval of time during which parking is
permissible; and which shall also display an appropriate signal when the
aforesaid interval of time shall have elapsed.
Section 101. 22. Maximum Parking Time Limit. The maximury
length of time that a vehicle may occupy a parking space.
PERSONS, ETC,, DEFINED
Section 102. Per son. Emory natural person, firm, copartner-
ship, association, or corporation..
Section 102. 1. Operator or Driver. Every person who drives
or is in actual physical control of a vehicle.
Section 102. 2. Pedestrian. Any person afoot.
Section 102.3. Police Officer. Every officer authorized to
direct or regulate traffic or to make arrests for violation of traffic
regulations„
Section 102., 4, Traffic Division. The traffic division wheneve
used herein shall be deemed to refer to the Police department of this city.
Section 102., 5. City. Whenever the word "City" appears in thi
ordinance it shall refer to the City of Ames, Iowa,
STREETS, ETC. , DEFINED
Section 1 D3. Street, A Y enue or Highway -- The entire width
between property lines of every way or place of whatever nature when any
part thereof is open to the use of the public, as a matter of right, for
purpose of vehicular traffic.
Section 103, 1. Alley, A thoroughfare twenty-four (24) feet or
less in width, laid out, established and platted as such, by constituted
authority.
Section 103. 2. Private Road or Driveway. Every way or place
in private ownership and used for vehicular travel by the owner and those
having express or implied permissi on from the owner but not by other pers ns.
Section 103. 3„ Roadway. That portion cf a street or highway
improved, designed, or ordinarily used for vehicular travel. In the event
a highway includes two or more separate roadways the term "roadway"
as used herein shall refer to any such roadway separately but not to all
such roadways collectively.
Section 103. 4. Sidewalk. That portion of a street between the
curb lines, or the lateral lines of a roadway, and the adjacent property
lines intended for the use of pedestrians.
Section 103. 5. Laned Roadway, A roadway which is divided
into two or more clearly marked lanes for vehicular traffic.
Section 103. 6. Through (or Thru) Highway. Every highway
or portion thereof at the entrances to which vehicular traffic is required by
law to stop before entering or crossing the same or when stop signs are
erected or such entrances are controlled by a police officer or traffic-
control signal. The term "arterial" shall be synonymous with "through'.'
or "thru" when ueed in this ordinance.
Section 103. 7. Intersection. The area embraced withinthe
prolongation or connection of the lateral curb lines, or, if none, then the
lateral boundary lines of the roadways of the two streets which join one anoth r
at, or approximately at, right angles, or the area within which vehicles
traveling upon different roadways joining at any other angle may come in
c onflict.
Section 103. 8. Crosswa4. That portion of a roadway ordinari
included within a prolongation or connection of the lateral lines of sidewalks
at intersections, or any portion of a roadway distinct indicated for pedestrian
corssing by lines or other markings on the surface.
Section 103.9. Line of Street. Where the "line of street" is
referred to it shall mean the lot line, as distinguished from the curb line,
Section 103. 10. Curb Loading Zones. A space adjacent to a
curb, indicated by a sign or curb marking, reserved for the exglusive use
of vehicles during the loading or unloading of passengers or materials.
Section 103. 11. Official Traffic-Control Devices. All signs,
signals, markings, and devices not inconsistent with this ordinance placed or
erected by authority of a public body or official having jurisdiction, for the
purpose of regulating, warning, or guiding traffic.
Section 103. 12 Traffic,-Control Signal., Any device, whether
manually, electrically, or mechanically operated, by which traffic is
alternately directed to stop and to proceed.
Section 103. 13. Business District, The territory contiguous
to and including a street when fifty (50) percent or more of the frontage there n
for a distance of three hundred (300) feet or more is occupied by dwellings
or by dwellings and buildings in use for business„
Section 103. 14. Residence District„ The territory within the
city contiguous to and including a highway, not comprising a business,
suburban or school district, where forty (40) percent or more of the
frontage on such highway for a distance of three hundred (300) feet or more
is occupied by dwellings or by dwellings and buildings in use for business.
Section 103. 15. School District. The territory contiWous to a
including a street for a distance of two hundred (200) feet in either direction
from a school house.
Section 103. 16, Suburban District. All other parts of the eity
not included in the business, school or residence districts.
Section 103. 17. Parking space. That area of the street, next
to the curb, designated by lines or marks thereon within which a vehicle ma
be parked.
Section 103. 18. Parking Lot, Municipally-Owned. A munici-
pally -- Dwned area of land outside the boundaries of streets or highways,
set aside for the specific purpose of parking vehicles.
Section 103. 19. Parking Lot, Leased. An area of land,
privately-owned and leased by the City, outside the boundaries of streets
or highways, set aside for the specific purpose of parking vehicles,
RESPONSIBILITY FOR TRAFFIC ENGINEERING & RECORDS
Section 104. Responsibility for Traffic Engineering.
(a) The city manager shall exercise the powers and duties wit
respect to traffic as provided in this ordinance.
(b) It shall be the duty of the city manager to determine the
installation and proper timing and maintenance of traffic-control devices,
to conduct engineering analyses of traffic accidents and to devise remedial
measures, to conduct engineering investigation of traffic conditions and to
cooperate with other city offic-ials in the development of ways and means to
improve traffic conditions, and to carry out the additional powers and duties
imposed by traffic ordinances of the city,

Section 104. 1. Records of Traffic Violations.. The police
department shall keep a record of all violations of traffic ordinances of this
city or of the state vehicle laws of which any person has been charged, togethE r
with a record of the final dispostion of all such alleged offenses. Such record
shall be so maintained as to show all types of violations and the total of each.
Said record shall accumulate during at least a five (5) year period and from
that time on a record shall be maintained complete for at least the most
recent five (5) year period. All such records and reports shall be public
records.
ENFORCEMENT AND OBEDIENCE TO TRAFFIC REGULATIONS
Section 105. Authority of Police Officials. It shall be the duty
of the officers of the police department or such officers as are assigned by th
chief of police to enforce all street traffic laws of this city and all of the
state vehicle laws applicable to street traffic, in this city.
Section 106. Authority to Direct Traffic„ Officers of the police
department or such officers as are assigned by the chief of police are hereby
authorized to direct all traffic by voice, hand, or signal in conformance with
traffic laws, provided that, in the event of a fire or other emergency or to
expedite traffic or to safeguard pedestrians, officers of the police department
may direct traffic as conditions may require notwithstanding the provisions
of the traffic laws.
Sections 107. Authority of Fire Department Officials. Officers
of the fire department, when at the scene of a fire, may direct traffic thereat
or in the immediate vicinity,
Section 108. Obedience to Police and Fire Department Officials,
It shall be unlawful for a person to willfully fail or refuse to comply wit4 any
lawful order of direction of a police officer or other authorized traffic
officer„
Section 109. Persons Proelling Push Carts, etc, Every person
propelling any push tarty riding a bicycle, riding an animal upon a roadway,
and every person driving any animal-drawn vehicle, shall be subject to the
provisions of this ordinance applicable to the driver of any vehi,gley except
those provisio-as of this ordinance which by their very nature ¢an have no
application.
Section 110. Use of Coasters, Roller Skates, and Similar
Devices Restricted. No person upon roller skates, or riding in or by means
of any coaster, toy vehicle, or similar device, shall go upon any roadway
except while crossing a street on a cfo sswalk and when so crossing such
person shall be/granted all of the rights and shall be subject to. all of the duties
applicable to pedestrians. This section shall not apply upon any street while
temporarily restricted to vehicular traffic.
Section 111. Public Employees to Obey Traffic Regulations. T
prWisions ofthi s ordinance shall apply to the driver of any vehicle owned by
or used in the service of the United States Government, any state, county, or
city, and it shall be unlawful for any said driver to violate any of the pro-
visions of this ordinance, except as otherwise permitted in this ordinance or b
state statute.,
SecCon 112. Exemptions to Authorized Emergency Vehicles„

(a) The provisions of this ordinance regulating tihe operation,
parking and standing of vehicles shall apply to authorized emergency vehicle ,
as defined in this ordinance, except as follows:
(1) Park or stand notwithstanding the provisions of this
ordinance;
(2) Proceed past a red or stop signal or stop sign, but
only after slowing down as may be necessary for safe
operation;
(3) Exceed the prima facie speed limits so long s he does
not endanger life or property;
(4) Disregard regulations governing direction of ovement
or turning in specified directions so long as he does not
endanger life or property..
(b) Those exemptions hereinbefore granted inref rence to the
movement of an authorized emergency vehicle shall apply only hen the
driver of said vehicle sounds a siren, bell, or exhaust whistle s may be
reasonably necessary, and the vehicle displays a lighted red la p visible
from the front as a warning to others.
(c) The foregoing exemptions shall not, however, protect the
driver of any such vehicle from the consequences of his reckless disregard
of the safety of others.
Section 113. Operation on Approach of Emergency Vehicle.
Upon the immediate approach of an authorized emergency vehicle, when the
driver is giving an audible signal by siren, exhaust whistle, or bell, the
driver of every other vehicle shall yield the right-of-way and shall
immediately drive to a position parallel to, and as close as possible toy the
right-hand edge or curb of the street clear of any intersection and shall
stop and remain in such position until the authorized emergency vehicle has
passed, except when otherwise directed by a police officer.
ACCIDENTS
Section 114. Information and Aid. The driver of any vehicle
involved in an accident resulting in injury to or death of any person or
damage to any vehicle which is driven or attended by any person shall stop
such vehicle at the scene of such accident or as close thereto as possible an
shall give his name, address, and the registration number of the vehicle he
is driving and shall upon request, and if available, exhibit his operator's
or chauffeur's license to the person struck or the driver or occupant of or
person attending any vehicle collided with and shall render to any person
injured in such accident reasonable assistance, including the carrying or
the making of arrangements for carrying of such person to a physician,
surgeon, or hospital for medical or surgical treatment if it is apparent
that such treatment is necessary or if such carrying is requested by the
injured person.
Section 115. Striking Unattended Vehicle. The driver of any
vehicle which collides with any vehicle which is unattended shall
immediately stop and shall then and there either locate and notify the
operator or owner of such vehicle of the name and address of the driver and
owner of the vehicle striking the unattended vehicle or shall leave in a
conspicuous place in the vehicle struck a written notice giving the name
and address of the driver and the owner of the vehicle doing the striking and
a statement of the circumstances thereof.
Section 116. Striking Fixtures Upon a Highway;, The driver
of any vehicle involved in an accident resulting only in damage to property
legally upon or adjacent to a highway shall take reasonable steps to locate
and notify the owner or person in eharge of such property of such fact and o I

name and address and of the registrat n number of the vehicle he is driving
and shall upon request and if available exhibit his operator's or chauffeur's
license and shall make report of such accident when and as required in
Section 117.
Section 117. Immediate Report of Accidents,. The driver, or
if unable, any occupant of a vehicle involved in an accident resulting in injury
to or death of any person or property damage to an apparent extent of
fifty (50) dollars or more, shall immediately by the quickest means of
communication, either verbal or written, give notice of such accident to the
police department if such accident occurs within this City.
Section 118. Cleaning Up After Accidents, Any person
removing a wrecked or damaged vehicle or property from a street shall remo e
any glass or other substance dropped upon the street from such vehicle or
property.
TRAFFIC.-CONTROL DEVICES
Section 119. Authority to Install Traffic-C ontr of Devices.. The
city manager shall place and maintain traffic-control signs, signals,
markings and devices when and as required under the traffic ordinances of
this City to make effective toe provisions of said ordinances, and may place
and maintain such temporary 4additional traffic-control devices as may be
necessary in times of emergency or hazardous conditions to regulate
traffic under the traffic ordinances of this city or under state-law, or to
guide or warn traffic.
Section 120. Manual and Specifications for Traffic-Control
Devices. All traffic-.control signs, signals, markings and devices shall
conform to the Manual of Uniform Traffic-Control Devices for Streets and
Highways as approved by the .Iowa Highway Commission. All signs and
signals required hereunder for a particular purpose shall so far as
practicable be uniform as to type and locaticnt hroughout the 5ity. All
traffic-control devices so erected and not inconsistent with the provisions
of state law or this ordinance shall be official traffic-control devices,
j Section 121. Obedience to Official Traffic-Control Devices.
The driver of any vehicle shall obey the instructions of any official
traffic-.control device applicable thereto placed in accordance with the
traffic ordinances of this city, unless otherwise directed by a police
officer, subject to the exceptions granted the driver of an authorized emer-
gency vehicle in this ordinance.
Section 122. When Traffic Devices Required for Enforcement
Purposes. No provision of this ordinance for which signs are required shall
be enforced against an alleged violator if at the time and place of the
alleged violation an official sign is not in proper position and sufficiently
legible to be seen by an ordinarily observant person. Whenever a
particular section does not state that signs are required, such section shall
be effective even though no signs are erected or in place.
Section 123. Traffic-Control Signal Legend, When traffic
is controlled by traffic_control signals exhibiting the words "Go", "Caution".
or "Stop" or exhibiting different coloed lights successively one at a time,
or with arrows, the following colors Iall be used and said terms and lights
shall indicate and apply to drivers of vehicles and pedestrians as follows:
(a) Green alone or "Go".
(1) Vehicular traffic facing the signal shall proceed straight
tkrough or turn right or left unless a sign at such place
prohibits either such turn. But vehicular traffic,
including vehicles turning right or left, shall yield the
right-of-way to other vehicles and to pedestrians
on streets, alleys, or public places, or portions of streets, alleys, or public
places, for cleaning and repairing; to protect sewer., water, curb and gutter
and paving constructions; to close a street for public demonstrations; to
re-route traffic when there is a heavy influx of such due to speaal events,
such as .Iowa State College Homecoming, Veischea, etc.
Section 127. 1. Temporarily Closed Streets, Whenever signs are
erected indicating any street or part thereof as a closed street, no person
shall drive a vehicle upon any such street or portion thereof.
Section 128. City Manager to Designate Crosswalks, Establish
Safety Zones, Mark Traffic Lanes, Etc, The city manager is authorized--
(a) To designate and maintain, by appropriate devices, marks,
or lines upon the surface of t$e roadway, crosswalks at intersections where
in
his opinion there is particular danger to pedestrians crossing the roadway,
and at such places as he may deem necessary;
. (b) To designate safety zones of such kind and character and
at such places as he may deemnecessary for the protection of pedestrians;
(c) To mark lanes for traffic on street pavements at such place
as he may deem advisable, consistent with the traffic ordinances of this city.
(d) To designate and erect signs indicating zones of quiet and
no person operating a motor vehicle within any such zone shall sound the her
or other warning device of said vehicle except in an emergency,
(e) To designate and erect signs indicating any street or part
thereof as a play area, no person shall drive a vehicle upon any such street
or portion thereof except drivers of vehicles having business or whose resid n-
oes are within such Closed area, and then said driver shall exercise the
greatest care in driving upon said street or portion thereof,
SPEED REGULATIONS
Section 129. Speed Restrictions, It shall be unlawful for any
person driving a vehicle on the streets to drive the same in any manner
other than at a careful and prudent speed not greater than, nor less than,
is reasonable and proper, having due regard to the traffic surface, and
widthl of the street and of any other conditions then existing, and no person
shall drive any vehicle upon a street at a speed greater than will permit him
to bring it to a stop within the assured clear distance ahead such driver havil g
the right to assume, however, that all persons using said street will observe
the law, I
Section 129. 1. Speed Restriction, Business or School Distrct„
A speed in excess of twenty (20) miles per hour in any business or school
district, unless specifically designated otherwise in this ordinance, shall
be unlawful.
Section 129. 2. Speed Restriction, Residence District, A spee
in excess of twenty-five (25) miles per hour in any residence district, unles
specifically designated otherwise in this ordinance, shall be unlawful.
Section 129. 3, Speed Restrictions, Suburban District. A speed in
excess of forty-five (45) miles per hour in any suburban district, unless
specifically designated otherwise in this ordinance, shall be unlawful.
Section 129.4. Speed Restrictions, Public Park, Parking Lot
or Cemetery. _i speed in excess of fifteen (15) miles per hour in any
public park, parking lot or cemetery, unless specifically designated otherwi e
lawfully within the intersectionor an adjacent crosswalk
at the time such signal is exhibited.
(2) Pedestrians facing the signal may proceed across the
roadway within any marked or unmarked crosswalk.
(b) Yellow alone or "Caution,, when shown following the green
or "Go" signal,
(1) Vehicular traffic facing the signal is thereby warned that
the red or "Stop"" signal will be exhibited immediately
thereafter and such vehicular traffic shall not enter or
be crossing the intersection when the red or "Stop"
signal is exhibited.
(2) Pedestrians facing such signal are thereby advised that
there is insufficient time to cross the roadway, and any
pedestrian then starting to cross shall yield the right-of--way
to all vehicles..
(c) Red alone or "Stop%
(1) Vehicular traffic facing the signal shall stop before entering
the nearest crosswalk at an intersection or at such other
point as may be indicated by a clearly visible line and
shall remain standing until green or "Go"" is shown.
(2) No pedestrian facing such signal shall enter the roadway
unless he can do so safely and without interfering with any
vehicular traffic.
Section 124. Flashing Yellow or Amber Sinals (Caution Signal),
When a yellow or amber lens is illuminated with rapid intermittent flashes,
drivers of vehicles may pr :-)ceed through the intersection or
only with caution. past such signal
Section 125. Display of Unauthorized Signs, Signals, or Markixg
No person shall place, maintain, or display upon or in view of any street any
unauthorized sign, signal, marking, or device which purports to be or is
an imitation of or resembles an official parking sign, curb or other marking,
Itraffi&-control device or railroad sign or signal, or which attempts to direct
the movement of traffic, or which hides from view or interferes with the
effectiveness of an official traffic.-control device or any railroad sign or
signal, and no person shall place or maintain upon any street any traffic sign
or signal bearing thereon any commercial advertising. This shall not be
deemed to prohibit the erection upon private property adjacent to highways of
signs giving useful directional information of a type that cannot be mistaken
or official signs.
Section 125. 1. Removal of Unauthorized Signs, Signals, or
Markings. Every such protibited sign, signal, or marking is hereby declared
to be a public nuisance and the city manager is hereby empowered to remove
the same or cause it to be removed without notice.
Section 126. Interference With Official Traffic-Control
Devices or Railroad Signs and Signals„ No person shall without lawful
authority atterript to or in fact alter, deface, injure, knock down, or remove
any official traffic-control device or any railroad sign or signal or any
inscription, shield, or insignia thereon, or any other part thereof.
Section 127. .Authority to Establish Temporary Use of a Street
or Alley. The city manager shall have the authority to temporarily close and to erect temporary "No Parking" signs, street closing pigns and barricades
in this ordinance, shall be unlawful.
Section 129. 5. Speed Restrictions, Sixth Street Through
Brookside Park, A speed in excess of thirty-five (35) miles per hour on
Sixth Street from Brookridge Avenue to Wallace Road, shall be unlawful.

Section 130. Minimum Speed Regulations. No person shall
drive a motor vehicle at such a slow speed as to impede or block the normal
and reasonable movement of traffic, except when reduced speed is necessary
for safe operation, or in compliance with law.
Section 131. Emergency Vehicle's Speed The speed limitations
set forth in this ordinance shall not apply to authorized emergency vehicles
when responding to emergency calls and the drivers thereof sound audible
signal by bell, siren, or exhaust whistle. This provision shall not relieve the
driver of an authorized emergency vehicle from the duty to drive with due
regard for the safety of all persons using the streets, nor shall it protect the
driver of any such vehicle from the consequences of his negligence.
TURNING MOVEMENTS
Section 132. Required Position and Method of Turning at
Intersections„ It shall be unlawful for the driver of a vehicle intending to tur
at an intersection to do so in any manner other than as follows:
(a) Both the approach for a right turn and a right turn shall be
made as closes as practical to the right--hand curb ored ge of roadway.
(b) Approach for a left turn shall be made in that portion of the
right half of the roadway nearest the center line thereof and after entering
the intersection the left turn shall be made so as to leave the intersection to
the right of the center line of the roadway being entered.
(c) Approach for a left turn from a two -way street into a one--wa
street shall be made in thatportion of the right half of the roadway nearest the
center line thereof and by passing to the right of such center line where it
enters the intersection. A left turn from a one -way street into a two-way
street shall be made by passing to the right of the center line of the street
being entered upon leaving the intersection.
(d) Where both streets or roadways are one-way, both the appr ach
for a left turn and a left turn shall be made as close as practicable to the
left-.hand curb or edge of the roadway.
Section 133. Authority to Place Turning Markers. The city manager is authorized to place markers, buttons, or signs within or adjacent
to intersections indicating the course to be traveled by vehicles turning at
such intersections, and such course to be traveled as so indicated may
conform to or be other than as prescribed by ordinance.
Section 133,1. Obedience to Turning Markers. When authorized
marker s, buttons, or other indications are placed within an intersection
indicating the course to be traveled by vehicles turning thereat, it shall be
unlawful fmr a driver of a vehicle to disobey the directions of such indications

Section 143. Signs to Bear the Word "Stop". Every sign erected
pursuant to this article shall bear the word "Stop" in letters not less than
six (6) inches in height and such sign shall at nighttime be rendered luminous
by efficient reflecting elements on the face of the sign. Every stop sign
shall be located as near as practicable at the nearest line of the crosswalk
on the near side of the intersection or, if none, at the nearest line of the
roadway.
Section 144. Vehicles to Stop at Stop Signs. When stop signs are
erected as herein provided at or near the entrance to any intersection,
every driver of a vehicle shall stop such vehicle at such sign or at a clearly
marked stop line before entering the intersection except when directed to
proceed by a police officer or traffic-control signal.
Section 145. Stopping Vehicle at "Stop" signs. Operators of
vehicles shall stop in obedience to a stop sign as required herein at an
intersection where a stop sign is erected at one or more entrances thereto
although not a part of a through highway and shall proceed cautiously, yielding
to vehicles not so obliged to stop which are within the intersection or approaching
SO closely as to constitute a hazard, but may then proceed.
Section 146. Emerging from Alley or Private Driveway. It shall be
nlawful for the driver of a vehicle emerging from an alley, driveway, or
building to fail to stop such vehicle immediately prior to driving onto a sidewal
or onto the sidewalk area extending across any alleyway, yielding the right-of-
ay to any pedestrian as may be necessary to avoid collision, and upon enterin
he roadway shall yield the right-of-way to all vehicles approaching so closely
s to constitute a hazard, but said driver having so yielded may proceed cautiol. sl}

Section 147, Stop When Traffic Obstructed. It shall be unlawful for th

accommodate the vehicle he is operating without obstructing the passage of
ther vehicles or pedestrians, notwithstanding any traffic-control signal

Section 148. Obedience to Signal ,Indicating Approach of Railroad
rain.
(a) Whenever any person driving a vehicle approaches a railroad
grade crossing under any of the Circumstances stated in this
section, the driver of such vehicle shall stop within fifty (50)
feet but not less than ten (10) feet from the nearest rail of such
railroad, and shall not proceed until he can do so safely. The
foregoing requirements shall apply when:
(1) A clearly visible electric or mechanical signal device
gives warning of the immediate approach of a railroad
train;
(2) A crossing gate is lowered or when a human flagman
gives or continues to give a signal of the approach or
passage of a railroad train;
(3) A railroad train approaching within approximately fifteen
hundred (1500) feet of the highway crossing emits a
signal audible from such distance and such railroad train,
by reason of its speed or nearness to such crossing, is
an immediate hazard.
Section 148. 1. Observance of Crossing Gates and Barriers. It shall
e unlawful for any person to drive any vehicle through, around or under any
rossing gate or barrier at a railroad grade crossing while such gate or barrie
t a railroad grade crossing is closed or is being opened or closed.
DRIVING REGULATIONS
Section 149. Following Fire Apparatus Prohibited. It shall be unlawul
or a driver of any vehicle other than one on official business to follow any
ire apparatus traveling in response to a fire alarm closer than five hundred
500) feet or drive into or park such vehicle with the block where fire apparatus
as stopped in answer to a fire alarm.
Section 150. Crossing Fire Hose. No vehicle shall be driven over an
nprotected hose of a Fire Department when laid down on any street, alley,
r private driveway, to be used at any fire or alarm of fire, without the consent
f the fire department official in command.

Section 151. Driving Through Funeral or Other Processions, It shall
be unlawful for the driver of a vehicle to drive between the vehicles comprisi g
a funeral or other authorized procession while they are in motion. This
provision shall not apply at intersections where traffic is controlled by
traffic-control signals or police officers.
Section 152. Drivers in a Procession. Each driver in a funeral or
other procession shall drive as near to the right-hand edge of the roadway as
practical and shall follow the vehicle ahead as close as is practical and safe.
Section 153. Vehicles Shall Not Be Driven on a Sidewalk, It
shall be unlawful for a driver of a vehicle to drive within any sidewalk area
except at a permanent or temporary driveway.
Section 154. Limitations on Backing. The driver of a vehicle shall
not back the same unless such movement can be made with reasonable safety
and without interfering with other 'traffic.
Section 155, Following Too Closely. The driver of a motor vehicle
shall not, follow another vehicle more closely than is reasonable and prudent,
having due regard for the speed of such vehicles and the traffic and the
condition of the street.
Section 156. Reckless Driving. Any person who drives any vehicle
in such manner as to indicate either a wilful or a wanton disregard for the
safety of persons or property is guilty of reckless driving.
Section 157. Starting Parked Vehicle. No person shall start a
vehicle which is ttopped, standing, or parked unless and until such movement
can be made with reasonable safety.
Section 158. Signal Required Before Stopping. No person shall stop
or suddenly decrease the speed of a vehicle without first giving an appropriat
signal in the manner rovided herein to the driver of any vehicle immediately
to the rear when them is opportunity to give such signal.
Section 159. Control of Vehicle. The person operating a vehicle
or motorcycle shall have the same under control and shall reduce the speed
to a reasonable and proper rate:
(a) When approaching and passing a person walking or riding a
bicycle in the traveled portion of a public street.
(b) When approaching and passing an animal which is being led,
ridden, or driven upon a public street.
(c) When approaching and traversing a crossing or intersection of
public street, or a bridge, or a sharp turn, or a ccir.ve; or a steep
descent, in a public street.
(d) When approaching and passing a fusee, flares, red reflector
electric) lanterns, red reflectors or red flags displayed according
to Section 321. 448, Code of Iowa, 1954.
Section 160. Approaching or Entering Intersection. The driver of
a vehicle approaching an intersection shall yield the right-of-way to a vehicle
which has entered the interset;tion from a different street.
Where two (2) vehicles are appr caching on any public street or
highway so that their paths will intersect and there is danger of collision the
vehicle approaching the other from the right shall have the right-of-way.
The foregoing rules are modified at throughhighways and otherwise
as stated in this ordinance.
Section 161. Turning Left at Intersection. The driver of a vehicle
within an intersection intending to turn to the left shall yield the right-of-way
to any vehicle approaching from the opposite direction which is within the
intersection or so close thereto as to constitute an immediate hazard, but said
driver, having so yielded and having given a signal when and as required by
this ordinance, may make such left turn and the driver of all other vehicles
approaching the intersection from said opposite direction shall yield the
right-of-way to the vehicle making the left turn.

Section 168. Limitations on Overtaking on the Left on a Pavement
of Four (4) or More Lanes. No vehicle shall cross the center line of a
roadway when overtaking another vehicle, when such line is a solid painted
line, of a pavement of four (4) or more lanes.
Section 169. Driving Upon Laned Roadways. Whenever any roadwa
has been divided into two (2) or more clearly marked lanes a vehicle shall be
driven as nearly as practical entirely within a single lane and shall not be
moved from such lane until the driver has first ascertained that such moveme t
can be made with safety.
Section 170. Unlawful Passing on Hills. No vehicle shall be driven
to the left half of the roadway in order to overtake and pass another vehicle
proceeding in the same direction in that part of a street designated as a
"no-passing" zone. Such zones shall be marked with signs.

MISCELLANEOUS REGULATIONS
Section 171. Riding on Motorcycle. A person operating a motorcyc
shall not ride other than up¢n the permanent and regular seat attached thereto
or carry any other person nor shall any other person ride upon such motor-
cycle other than upon a firmly attached seat to the rear or side of the operato
n.
Section 172. Clinging to Moving Vehicles. Any person riding upon
any bicycle, motorcycle, coaster, sled, roller skates, or any toy vehicle
shall not attach the same or himself to any moving vehicle upon any roadway.
Section 173. Boarding or Alighting from Vehicles. No person shall
board or alight from any vehicle while such vehicle is in motion.
Section 174. Unlawful Riding. No person shall ride on any vehicle ,
upon any portion thereof not designed or intended for the use of passengers.
This provision shall not apply to an employee engaged in the necessary
discharge of a duty, or to persons riding within truck bodies in space

Section 175. Railroad Trains Not to Block Streets. It shall be
unlawful for the directing officer or the operator of anyrailroad train to
direct the operation of or to operate the same in such a manner as to prevent
the use of any street for purposes of travel for a period of time longer than
five (5) minims, except that this provision shall not apply to trains or cars i
motion other than those engaged in switching.
Section 176. Obstruction to Driver' s View. No person shall drive
a vehicle when it is so loaded, or when there are in the front seat such
three (3), as to obstruct ths contro view of te d
rive
number of persons, exceeding
ow to the front or sides of the vehicle or as to interfere withhe driver
over the driving mechanism of the vehicle.
No passenger in a vehicle shall ride in such position as to interfere
' with the driver' s view ahead or to the sides, or to interfere with his
control over the driving mechanism of the vehicle.
Section 177. Windshields Unobstructed. No person shall drive any
motor vehicle equipped with a windshield which does not permit clear vision,
or with any sign, poster or other non-transparent material upon the front
windshield of such vehicle other than a certificate or other paper required
to be so displayed by law, which shall be displayed in the lower right-hand
corner.
Section 178. Trucks and Drays Loading and Unloading. From eight
(8) o'clock a. m. to ten (10) o'tlock p.m. upon Main Street between Duff
Avenue and Burnett Avenue and upon Lincoln Way between Stanton and Haywar
Avenues, trucks and drays are prohibited from loading and unloading freight,
goods and merchandise, at all places, stores and buidings where it is possibl
to perform such work in the adjacent alley.
Section 179. Unattended Motor Vehicle. It shall be unlawful for any
person driving or in charge of a motor vehicle to permit it to stand unattended
without first stopping the engine, or when standing upon any perceptible grade
without effectively setting the brake thereon and turning the front wheels to
the curb or the side of the highway.
Section 180. Moving Other Vehicles. No person shall move a vehicl
not owned by such person into any prohibited parking area or away from a
curb such distance as is unlawful.
Section 181. Putting Glass, etc. , on Street. No person shall throw
or deposit upon any street, roadway, municipally-owned, -leased or - control ed
parking lots, any glass bottle, glass, nails, tacks, wire, cans, or any other
substance likely to iri„'- any person, animal_, or vehisle upon sush street.
Section 182. Removing injurious material. Any person hodraps

Section 183. 1. Driving of Unsafe Automobiles. It shall be unlawful
for any person to drive or move or for the owner to cause or knowingly
permit to be driven or moved on any street any vehicle or combination of
vehicles which is in such unsafe condition as to endanger any person, or which
does not contain those parts or is not at all times equipped with such lamps an
other equipment in proper condition as required by chapter 321 code of Iowa,
1954.
Section 183. 2. Driving Without Lights. It shall be unlawful for any
person to operate a vehicle on any street in the City at any time from a half
hour after sunset to a half hour before sunrise and at any other time when

PEDESTRIAN RIGHTS AND DUTIES
Section 184. Pedestrians Subject to Traffic-Control Signals.

Section 185. Pedestrian's Right-of-Way.
(a) When traffic-control signals are not in plateor not inr sopertopping

Section 186. Pedestrians to Use Right Half of Crosswalk. Pedestrians
hall move, whenever practicable, upon the right half of crosswalks.
Section 187. Crossing at Right Angles. No pedestrian shall cross a
oadway at any place other than by a route at right angles to the curb or by the
hortest route to the opposite curb except in a crosswalk.
Section 188. When Pedestrian Shall Yield.
(a) Every pedestrian crossing a roadway at any point other than witlin
marked crosswalk or within an unmarked crosswalk at an intersection shall
field the right-of-way to all vehicles upon the roadway.
(b) Any pedestrian crossing a roadway at a point where a pedestrian
nnel or overhead pedestrian crossing has been provided shall yield the
fight-of-way to all vehicles upon the roadway.
(c) The foregoing rules in this section have no application under the
onditions stated in Section 189 when pedestrians are prohibited from crossing
t certain designated places.
Section 189. Prohibited Crossing. Between adjacent intersections
t which traffic-control signals are in operation, pedestrians shall not cross
t any place except in a crosswalk.
Section 190. Walking on Roadway. Where sidewalks are provided it
hall be unlawful for any pedestrian to walk along and upon an adjacent roadway.
Section 191. Walking on Left. Where sidewalks are not provided any
edestrian walking along and upon a highway shall when practicable walk only
n the left of the roadway or its shoulder facing traffic which may approach frorr
he opposite direction.
Section 192. Pedestrians Soliciting Rides. No person shall stand in
roadway for the purpose of soliching a ride from the driver of any private
ehicle.
Nothing in this ordinance shall be construed so as to prevent any
pedestrian from standing on that portion of the street or roadway, not
rdinarily used for vehicular traffic, for the purpose of soliciting a ride
from the driver of any vehiW.le.
Section 193. White Canes Restricted to Blind Persons. For the
purpose of guarding against accidents in traffic on the public thoroughfares,
it shall be unlawful for any person except persons wholly or partially blind
o carry or use on the streets, highways and public places of the city any
bite canes or walking sticks which are white in color or white tipped with red.
Section 193. 1. Duty of Drivers. Any driver of a vehicle or operator cf
a motor-driven vehicle who approaches or comes in contact with a person
wholly or partially blind carrying a cane or walking stick white in color or whit
tipped with red, shall immediately come to a complete stop, and take such pre-
cautions as may be necessary to avoid accident or injury to such person.
Section 194. Drivers to Exercise Due Care. Notwithstanding the
foregoing provisions of this article every driver of a vehicle shall exercise
due care to avoid colliding with any pedestrian upon any roadway and shall
give warning by sounding the horn when necessary and shall exercise proper
precaution upon observing any child or any confused or incapacitated person
upon a roadway.
PARKING REGULATIONS
Section 195. Method of Parking. Except where angle parking is
permitted by this ordinance, every vehicle stopped or parked upon a roadway
where there is an adjacent curb, shall be so stopped or parked with the
right-hand wheels of such vehicle parallel with and within eighteen (18) inches
of the right-hand curb and not placed closer than four (4) feet end to end fr om
another vehicle.
Section 196. Parking on Streets Without Curbs. Vehicles parked on
streets without curbs shall be parked parallel to the center line of the street
with no portion of the vehicle closer than twelve (12) feet to the center line of
the street.
Section 197. Double ParIKdng. Double parking is prohibited upon all
streets, except in an emergency, and then only if an operator capable of
moving the vehicle remains therein.
Section 197. 1. Unlawful Parking. It shall be unlawful for any person
to park a vehicle upon any roadway for the principal purpose of:
1. Displaying it for sale.
2. Washing, greasing, or repairing such vehicle except repairs
necessitated by an emergency.
3. Advertising.
Section 198. Stalls and Sections. Where now or hereafter stalls or
sections for vehicles may be marked or painted upon the surface of any street,
portion thereof, municipally-owned, or leased parking lots, it shall be the duty
of the driver or operator of any vehicle to park the same within the limits of
one of th_ said stalls or sections and not over or across said lines.
Section 199. Parking Lone Vehicles. No part of any vehicle or the
load thereon when parked within an angle parking district shall extend into
a roadway more than a distance of eighteen (18) feet when measured at right
angles to the adjacent curb. No vehicle exceeding twenty (20) feet in overall
length shall park in an angle parking district or parkinglot..
Section 200. "Angle Parking". On streets and parking lots set aside
y this ordinance for "angle Parking" vehicles shall be parked at an angle with
he curb line as marked on the street or paring lot surface and the nearest
front wheel of such vehicle shall not be more than twelve (12) inches from the
urb.
Section 200. 1. "Angle parking" shall be permitted upon Main Street
from Duff Avenue to a point five hundred (500) feet west of the west line of
lark Avenue.
Section 200. 2. "Angle Parking" Shall be permitted on the North side
f Fifth Street from Carroll Avenue to Duff Avenue.
Section 200. 3. "Right angle parking" shall be permitted on Burnett
Avenue from the south line of Main Street to the first alley south thereof.
Section 201. Limited Parking, Ninety (90) Minutes. The parking of
vehicles on all week days, except Mondays and holidays, between the hours
f eight (8) o'clock a. m, and six (6) o'clock p.m. and on Mondays between
he hou rs of eight (8) o'clock a.m, and nine (9) o'clock p, m. , shall be limited
o ninety (90) minutes on certain streets designated in this ordinance. Signs
hall be posted on such streets indicating said limit.
Section 201. 1. Parking is limited to ninety (90) minutes onf Fifth Stre t
rom Burnett Avenue to Grand Avenue as provided in section 201.
Section 201. 2. Parking is limited to ninety (90) minutes on Douglas
venue from Fifth Street to Sixth Street as provided in section 201.

sixty (60) minutes in certain locations as designated in this ordinance. Signs
shall be posted in such locations indicating said limit.
Section 202. 1. Parking is limited to sixty (60) minutes on the
municipal-leased parking lot abutting on Fifth Street and Kellogg Avenue,
more particularly described as an area including approximately the South
Fifty (50) feet on Lot Six (6), the South Fifty (50) feet of Lot Eight (8) on
said prenises all in Block Eight (8), Original Town of Ames, Story County,
Iowa, as provided in section 202.
Section 203. Limited Parking, Five (5) Minutes. The parking of
vehicles on all week days except Monday and holidays between the hours of
eight (8) o'clock A. M. and five (5) o'clock P.m. and on Mondays between the
hours of eight (8) o'clock A.m. and nine (9) o'clock P.M. shall be limited
to five (5) minutes on streets designated as having a five (5) minute limit.
Signs shall be posted thereon indicating such limit.

if need be to so yield, to a pedestrian crossing the roadway within a cross-
walk when the pedestrian is upon the half of the roadway upon which the
vehicle is traveling, or when the pedestrian is approaching so closely from
the opposite half of the roadway as to be in danger, but no pedestrian shall
suddenly leave a curb or other place of safety and walk or run into the path
of a vehicle, which is so close that it is impossible for the driver to yield.
A pedestrian's right-of-way in a crosswalk is modified under the condition
and as stated in section 188 (b).
(b) Whenever any vehicle is stopped at a marked crosswalk or at any unmark d
crosswalk at an intersection to permit a pedestrian to cross the roadway,
the driver of any other vehicle approaching from the rear shall not overtake
and pass such stopped vehicle.

Section 206. 1. Night parking is hereby prohibited on Main Street
from a point one hundred and .forty (140) feet East of the East line of Duff

Section 206. 2. Night parking is hereby prohibited on Fifth Street
from the West line of Duff Avenue to the East line of Clark Avenue between
the hours of two (2) o'clock a.m. and six (6) o'clock a.m. on Sundays.
Section 206. 3. Night parking is hereby prohibited on Duff Avenue
from the North line of Main Street to,the South line of Fifth Street between the
hours of two (2) o'clock a. m, and six o'clock a.m on Sundays.
Section 206. 4. Night parking is hereby prohibited on Douglas Avenu
from the North line of Main Street to the South line of Sixth Street between
the hours of two (2) o'clock a.m. and six (6) o'clock a.m. on Sundays.
Section 206. 5. Night parivag is hereby prohibited on Kellogg Avenue
from the North line of Lincoln Way to the South line of Sixth (6th) Street
between the hours of two (2) o'clock a.m. and six (6) o'clock a.m. on Sundays.
Section 206. 6. Night parking is hereby prohibited on Burnett Avenue
from the North line of Main Street to the South line of Fifth (5th) Street betwe n
the hours of two (2) o'clock a.m. and six (6) o'clock a.m. on Sundays.
Section 206. 7. Night parking is hereby prohibited on Lincoln Way fr m
the West line of Lynn Avenue to the West line of Hayward Avenue between the
hours of two (2) o'clock a. m. and six (6) o'clock a.m. on Sundays.
Section 206. 8. Night parking is hereby prohibited on Hayward Aven e
from the South line of Lincoln Way to the North line of Chamberlain Street
between the hours of two (2) o'clock a.m, and six (6) o'clock a.m.
Section 206. 9. Night parking is hereby prohibited on Welch Avenue
from the South line of Lincoln Way to the North line of Chamberlain Street
between the hours of two (2) o'clock a.m. and six (6) o'clock a. m.
Section 207. Official Car Reservation. The forty (40) feet on the
East side of Kellogg Avenue and the forty (40) feet on the South side of Fifth
Street, both adjacent to the city hall, are hereby reserved and set aside for the
motor vehicles of the police department, other official cars of the City of Ame
and the state highway patrol cars. All other vehicles are prohibited from
parking in said space, at any time, or from interfering with the use of said
space by such motor vehicles.
Section 208. Public Carrier Stands. The city manager is hereby
authorized and required to establish bus stops and taxicab stands on such
public streets in such places and in such number as he shall determine to be
of greatest benefit and convenience to the public, and every such bus stop and
taxicab stand shall be designated by appropriate signs.
Section 209. Parking of Buses and Taxicabs Regulated. The driver
of a bus or taxicab shall not park upon any street in any business district at
any place other than at a bus stop, or taxicab stand, respectively, except that
this provision shall not prevent the driver of any such vehicle from temporaril
stopping in accordance with other stopping or parking regulations at any place
for the purpose of and while actually engaged in loading or unloading passengers.
Section 210. Restricted Use of Bus and Taxicab Stands. No person
shall stop, stand, or park a vehicle other than a bus in a bus stop, or other
than a taxicab in a taxicab stand when any such stop or stand has been
officially designated and appropriately signed, except that the driver of a
passenger vehicle may temporarily stop therein for the purpose of and while
actually engaging in loading or unloading passengers when such stopping does
not interfere with any bus or taxicab waiting to enter or about to enter such
z one.
PARKING METER REGULATIONS
Section 211. Authority for Installing Parking Meters. The city
manager is hereby authorized to install, or cause to be installed, parking
meters in the parking meter zones as are herein established or which shall
hereafter be established. Said parking meters shall be installed within
approximately twenty-four (24) inches of the curb line and in front of the parkin
spaces.
Section 211. 1. Parking Meter Districts. Two parking meter district
are hereby established as follows: District No. 1 being the parking meters in
the First, Second and Third Wards. District No. 2 being the parking meters
in the Fourth Ward.
Section 212. Parking Meter Zones. There are hereby established
certain zones, to be known as parking meter zones. The parking meters
erected in said parking meter zones shall determine the maximm parking time
limits as set out in sections 213 and 214 of this ordinance, on week days, exce t
Mondays and holidays, from the hours of nine (9) o'clock a.m, to six (6)
o'clock p.m. and on Mondays from twelve (12) o'clock noon to nine (9) o'clock
P.m,
Section 213. Maximum Parking Time Limit, Twelve (12) Minutes.
In the parking meter zones, established as having a maximum parking time lirrit
of twelve (12) minutes, the stands supporting the parking meters shall be
painted orange. Nothing but a one (1) cent coin shall be deposited in said parkii g
meter.
Section 213. 1. The South side of Fifth Street from Kellogg Avenue
to Burnett Avenue shall have a maximum parking time limit of twelve (12)
minutes.
Section 21 3. 2. The west side of Douglas Avenue from the south line
of the East and West alley between Main and Fifth Street to the North line of
Main Street.
Section 213. 3. Both sides of Kellogg Avnnue from the North line of
the East and West alley between Main and Fifth Street to the South line of
Fifth Street.
Section 213. 4. The North side of Sixth Street from the West line
of Douglas Avenue to the East line of the North and Souza alley between Douglas
and Kellogg Avenue.
Section 213. 5. Two parking meter spaces on the South side of
Lincoln Way immediately East of Welch Avenue, and two parking meter spaces
on the South side of Lincoln Way immediately East of Hayward Avenue, shall
have a maximum parking limit of twelve (12) minutes.
Section 214. Maximum Parking Time Limit, Sixty (60) Minutes.
In the parking meter zones, established as having a maximum parking time
limit of sixty (60) minutes, the stands supporting the meters shall be painted
aluminum. Upon the deposit of certain coins an allowed parking time shall
be established up to the maximum parking time limit as follows:
(a) Upon the deposit of a one (1) cent coin a parking time limit of
twelve (12) minutes shall be established.
(b) Upon the deposit of two (2) one (1) cent coins a parking time
limit of twenty-four (24) minutes shall be established.
(c) Upnn the deposit of three (3) one (1) cent coins a parking time
limit of thirty-six (36) minutes shall be established.
(d) Upon the deposit of four (4) one (1) cent coins a maximum
parking time of forty-eight (48) minutes shall be established.
(e) Upon the deposit of five (5) one (1) cent coins a maximum
parking time limit of sixty (60) minutes shall be established.
(f) Upon the deposit of one (1) five (5) cent coin a maximum parking
time limit of sixty (6 0) minutes shall be established.
Section 214. 1. Main Street from Duff Avenue to Clark Avenue is
hereby established as a sixty (60) minute parking meter zone.
Section 214. 2. East side of Douglas Avenue from Main Street to
Fifth Street and the West side of Douglas Avenue from the East and West
alley to Fifth Street is hereby established as a sixty (60) minute parking
meter zone.
Section 214. 3. Kellogg Avenue from the North line of Lincoln Way
to the South line of Sixth (6th) Street is hereby established as a sixty (60)
minute parking meter zone except in the following places:
(a) The North 192 feet on the West side.
(b) The North 150 feet on the East side.
(c) On the West side, from the North side of the alley between
Main Street and Fifth Street, to Fifth Street.
(d) That portion of Kellogg Avenue reserved for taxi stands
and for parking of official cars.
Section 214. 4. Fifth Street from Duff Avenue to Burnett Avenue
except the space reserved for official cars North of the City Hall, and
except the South side of Fifth Street from the West line of Kellogg Avenue
to the East line of Burnett Avenue, is hereby established as a sixty (60)
minute parking meter zone.
Section 214. 5. Burnett Avenue from the North line of the East-Wes
alley South of Main Street to Fifth Street, is hereby designated as a sixty
(60) minute parking meter zone.
Section 214. 6. Linc oln Way from the East line of Hayward Avenue to
he West line of Stanton Avenue except for two parking meter spaces on
the
South side of Lincoln Way immediately Ea st of Welch Avenue, and two parking

eter spaces on the South side of Lincoln Way immediately East of Hayward
A enue, is hereby established as a sixty (6 0) minute parking meter zone.

Section 214. 7. The East side of Hayward Avenue from Lincoln Way
to Chamberlain Street, is hereby established as a sixty (60) minute parking
meter zone.
Section 214. 8. Both sides of Welch Avenue from Lincoln Way to
Chamberlain Street, is hereby established as a sixty (60) minute parking
meter zone.
Section 215. Two Minute Unmetered Parking. The city manager may
with the consent of the council, designate the zone and order two-minute
unmetered parking during such portion of the day as will expedite the
movement of vehicular traffic, on or across any street, avenue, or alley
within the parking meter district.
Section 215. 1. Application for Two-Minute Parking. The proprietor
of any real estate within any parking meter district, desiring unmetered
two-minute parking in the street, avenue, or alley abutting his real estate,
shall make a written proposal therefor to the city manager. If in the opinion
of the city manager the request is reasonable and the granting thereof will
facilitate traffic, he shall present such request and his recommendation to the
council for its approval. The graiti.ng of the request shall be contingent upon
the proprietor agreeing to pay into the parking meter fund yearly in advance
a sum of money equivalent to the hourly charge for parking multiplied by
the number of hours per year during which two-minute unmetered parking is
in effect for each such parking space. Meters involved shall be clearly
marked during this period when such unmetered two-minute parking is
applicable. The granting of the application shall not preclude later cancellatio
thereof, by council action.
Section 216. Extending Maximum Parking Time Limit. It shall be
unlawful for any person to deposit or cause to be deposited, an additional
coin or coins to extend the parking time limit beyond the maximum parking
time limit for a meter space.
Section 217. Slugs and Counterfeit Coins. It shall be unlawful for
any person to deposit or, cause to be deposited in any parking meter any slug,
r
device or substitute for a one (1) - cent or a five (5)-cent coin of the United
States of America.
c Section 218. Supervision. The city manager or his authorized
representatives shall have direct supervision of the installation, operation of
the installation, operation, repair and maintenance of said parking meters and
parking meter zones.
Section 219. Policing. The chief of police of the City of Ames, under
the direction of the mayor shall have direct supervision of the policing of
said parking meters and parking meter zones.
Section 220. Collection of Funds. The city clerkor his duly
authorized representative shall have the power and authority to make regular
collections of the monies deposited in said parking meters and the city clerks lall
deliver the same to the city treasurer of the city of Ames, Iowa.
Section 221. Use of Funds. Funds derived from'the operation of
each of the parking meter districts herein established shall be used for the
following purposes and none other, to wit:
(a) Payment of the cost of acquisition and installation of meters
purchased.
(b) Payment of the cost of maintenance and repair of meters and
collection of meter taxes and the enforcement of traffic laws in the parking
meter districts.
(c) Payment of the purchase and installation cost of other parking
or traffic control devices installed on such portions of streets as are equipped
with parking meters.
(d) Payment of the cost of acquiring by purchase, lease, or similar
arrangement of parking lots or other off street parking areas, including
operation, enlargement, or improvement thereof or the facilities thereof
within four tenths (.4) of a mile of the metered portion of the streets within
the meter district, and widening the streets within the meter district or
within two blocks thereof to provide additional parking facilities.
(e) Retirement of revenue bonds issued pursuant to the provisions of
this chapter for which funds not required for the payment of the costs under
subsections a, b, and c hereof may be pledged.
(f) All as provided in chapter 390 of the 1954 Code of Iowa as
amended,.
Section 222. Duty of Operator.
(a) It shall be the duty of the operator of any vehicle, upon parking
said vehicle in any parking space adjacent to which a parking meter is
installed, to immediately deposit or cause to be deposited a five (5) cent coin
or a one (1) cent coin or coins, as the case may be, for the time said vehicle
is to occupy said parking space,
(b) It shall be the duty of the operator of the vehicle to immediat(l y
remove the vehicle from the parking space at the expiration of the maximum
parking time limit for said space or prior to the display, within said meter,
of the expired signal.
Section 223. Commercial Truck Parking.. Nothing herein contained
shall be construed as prohibiting the parking of commercial trucks in the
parking meter zones for the purpose of loading or unloading, provided,
however) that an operator of such truck shall not park in a parking meter
zone longer than thirty (30) minutes.
Section 224. Injury to Parking Meters. No person shall deface,
injure, tamper with, open, wilfully break, destroy, plug up, or impair the
usefulness of any parking meter.
FORTY-EIGHT HOUR PARKING LIMIT ESTABLISHED,
PROVISIONS FOR THE REMOVAL AND IMPOUNDING
OF MOTOR VEHICLES AND THE DISPOSAL OF
ABANDONED VEHICLES
Section 225. Forty-eight (48) Hour Parking Limit on Public Streets.
It shall be unlawful for any person to park any vehicle and to permit the same
to remain standing continuously and in one place for a period of more than
forty-eight (48) hours upon a public street, municipally-owned or leased
parking lot, or any public place in the city except those locations which
have a more restricted parking limit under this ordinance. In addition to
the penalty set out for the violation of any provisions of this ordinance any
such vehicle so found may be determined to be an abandoned vehicle.
Section 226. Abandoned Vehicle. Any vehicle which is found parked
continuously and in one (1) place for a period of more than forty-eight (48)
hours upon any public place in the city is hereby determined to be an abandone
vehicle and may be removed and impounded as provided in the following
sections of this ordinance.
Section 22y Removal and ,Impoundment of a Vehicle. Any motsr
vehicle found upon the streets and highways, parking lots, or public places
f the City of Ames, .Iowa, illegally parked and/or reasonably appearing to be
%bandoned, may be removed from said streets or highways under the direction
f the police department and may be impounded until disposed of as hereinafter
rovided. Impoundment shall be in any city-owned garage or area or in any
rivately-.owned public garage to be designated by the city council.
Section 228. Impoundment Fees. Within three (3) days after the
mpoundment of any such motor vehicle the owner thereof may appear and
claim the same on payment of an impoundment fee of three dollars ($3. 00)
and towing charges if stored by the City of Ames, or upon payment of the towing
and storage fees, if stored in a public garage, whereupon said vehicle shall
e released.
Section 229. Notice of Impoundment. If any impounded vehicle is not
claimed by the owner within three (3) days after impoundment the chief of
olice on said date, shall notify the commissioner of the Iowa State public
safety department as the administrator of the state motor vehicle department
y registered letter giving notice that he has such a motor vehicle in his
possession, and giving a full and complete description of the same, including
all marks of identification and factory and serial numbers.
Section 230. Release of Vehicle After Notice. If within forty (40)
days from notice to the owner thereof by the Commissioner of the Iowa state
public safety department as provided by the state statute, said owner shall
appear and properly identify such vehicle, the same shall be released to him
upon payment of the impoundment fee and towing charges or upon payment of
the towing and storage fees if impoundment in a privately-owned public garage,
and in addition thereto the costs incident to the location of such owner.
Section 231. Notice of Sale. If the owner of said vehicle does not
appear within such period the ebief of police shall advertise said motor
vehicle for sale in a newspaper published within the county at least once each
week for two (2) consecutive weeks.
Section 232. Sale of Unclaimed Vehicle. Said sale shall be held at a
time and place to be fixed in said published notice, which shall be within
one (1) week following the date of the last publication thereof at which time and
place said motor vehicle shall be sold at public auction to the highest bidder
thereof, for cash.
Section 233. Disposal of Proceeds of Sale. After deducting costs
of the sale, those incurred in attempts to locate the owner of such vehicle and
the towing and storage fees or impoundment fee, the chief of police shall pay
the remaining money to the city clerk to be credited to the street fund.
Section 234. Payment To Owner of Proceeds of Sale. If within six
(6) months from the date of sale the owner of any motor vehicle sold under
the provisions hereof makes a showing satisfactory to the city council of the
City of Ames, that he was the owner of such motor vehicle at the time of sale,
the city council may direct the drawing of a warrant paying such owner the
amount for which same was sold less impoundment fee, towing or storage Char es
and the costs incidental to notice to the owner and the conducting of said sale,
and may direct the clerk of the City of Ames to pay the same out of the street
fund,
Section 235. Bids for Private Storage. At least once each year the
city council may take bids from privately-owned garages for a schedule of
fees for towing and storing impounded vehiFles. Thereupon the city council
may designate the garage or garages to be used.
NOTICE OF CHANGES AND VIOLATION PROVISIONS
Section 236. Notice to be Given. When, hereafter, parking stations
speed limit district, or other traffic regulations or control districts, are
established, changed, regulated or annulled and an appropriate notice of the
action given by a sign, standard, or curb marking at the place affected, it
shall be the duty of all persons to comply herewith.
Section 237. Penalties for Violation. A violation of the provisions
of this ordinance shall be deemed a misdemeanor and any person violating
any of the provisions of this ordinance shall, upon conviction, be fined a
sum not exceeding one hundred (100) dollars and costs, and in default of
payment be committed to the city or county jail until such fine is paid not
exceeding thirty (30) days, or a jail sentence may be imposed not exceeding
the said thirty (3 0) days.
Sectinn 237. 1. Over-time Parking Violations. The penalty provided
in Section 237 shall not apply to a ticket issued for over-time parking,
provided the recipient shall within twenty-four hours (24) after the time of
the commission of the violation, place fifty (50) cents in coin in the envelope
upon which the over-time parking notice is printed, and place the same in one
of the special containers provided for that purpose near the front door of the
city hall, and at the intersection of Welch Avenue and Lincoln Way or at
such other collection boxes as may from time to time be provided. Nothing
in this section shall prevent the imposition of the penalty provided in Section
237 if, in the opinion of the court, a greater penalty is required in dealing wit
repeated or frequent violations.
EFFECT OF AND SHORT TITLE OF ORDINANCE
Section 238. Effect of Ordinance. If any part or parts of this
ordinance are for any reason held to be invalid, such decision shall not effect
the validity of the remaining portions of this ordinance.
Section 239. Repeal. Ordinances numbers 728, 733, 734, 741, 745, 748
and 830 are hereby repealed, and all other ordinances or parts of ordinances
in conflict with or inconsistent with the provisions of this ordinance are
hereby repealed, except that this repeal shall not affect or prevent the
prosecution of punishment of any person for any act done or committed in
violation of any ordinance hereby repealed prior to taking effect of this
ordinance.
Section 240. Short Title. This ordinance may be known and cited as
the "Traffic Ordinance'.
Section 241. Effective Date. This ordinance shall be in full force
and effect from and after its passage and publication as provided by law.
