HomeMy WebLinkAbout~Master - Regulating Junk i j ORDINANC E N O. 8 36 AN ORDINANCE REGULATING THE RECEIVING, PURCHASE AND DISPOSAL OF JUNK, THE LICENSING OF JUNK DEALERS, FIXING THE LICENSE FEE THEREFOR, RESTRICTING THE LOCATION OF JUNK YARDS WITHIN THE CORPORATE LIMITS OF THE CITY OF AMES, REPEALING ALL ORDIN- ANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING A PENALTY FOR THE VIOLATION OF THE PROVISIONS OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA: Section 1. Junk Dealer Defined. Every person who conducts or carries on a junk shop, or who buys, sells or deals in junk, old iron, old gopper, old brass, old lead, or any old metal, scrap metal, or old or discarded macchinery or automobiles, old rope or cordage, rags, paper and paper stock, old bottles or glass, old cans or tinware, old clothes, discarded furniti.re, carpets and hangings, old or discarded plumbing or electrical material or fixtures, or any article or thing usually bought, sold, or dealt in, in junk shops, and including all persons who carry on said business at shops, yards or stores, and any person who by advertisement, or sign, or otherwise holds himself out as a junk dealer, shall be deemed a junk dealer within the meaning of this ordinance. Section Z. License Required. No person shall engage in or carry on in the I City of Ames, the business of junk dealer, without first making application for paying the required fee and procuring the license provided for to this ordinance, nor shall any person carry on said business in any manner contrar to the provisions of this ordinance. Section 3. Application for License. Every junk dealer shall make applica- tion to the city clerk for a license upon forms furnished by the city. Such applic ati l;n shall state: 1. The name and address of the junk dealer. iZ. The location of the junk yard or store. 3. The type of junk bought and sold. Issuance of License. Section 4. 'Application for license shall be approved by the City Manager and the Chief of Police and upon payment of the required license fee, the city clerk shall issue a license to the junk dealer. All licenses shall be for a period of one year and shall expire on December 31st of the year of issue. Section 5. License Fee. The license fee if issued before July first of the year shall be twenty dollars ($2 0. 0 0) and if issued during the last six months of the year shall be ten dollars ($10. 00). Any person conducting several, or separate places of business shall pay the license fee and procure a license for each place. Section 6. Notice to Chief of Police and City Manager. Notice of the issuance of each junk dealers license shall be given by the city clerk to the chief of police and city manager. Section 7. Prohibited Locations. No junk yard, junk store or junk shop shall be located in a dwelling or on the lot or premises thereof or in other :;han a district zoned for heavy industry. Junk yards operating on the date of the passage of this ordinance shall not be required to comply with the provision �! of Section 7 hereof until July 1, 1958. I Section 8. Yards to be Enclosed. Yards used for the storage of junk including dismantled motor vehicles shall be effectively enclosed with a fence at least eight (8) feet in height or otherwise effectively screened from i public view, subject to approval of the City Manager. Section 9. Records to be Kept. Each junk dealer shall keep a book, in whi2L he shall accurately and intelligibly enter, in the English language, at the i time of purchasing or receiving any article: I 1. The name and place of residence of the person from whom, the article was purchased and received. 2. An accurate description of each article. i His license and said book shall at all times be open to examination by any sheriff, deputy sheriff or police officer. Section 10. Report to Chief of Police. Every junk dealer who shall purchase or receive from any person any old waste, discarded or secondhand copper, brass, lead, zinc or babbitt metal, or articles made therefrom, or any secondhand sheet copper or brass, copper, aluminum or brass wire, lead (sheet or pipe), zinc (sheet or pipe), plumbing or plumbing materials or fixtures, electric wire, apparatus or fixtures, dQocr'locksi . knobs, or door ' fixtures, window locks, bolts, weights or window fixtures, nickel or nickelplat�d articles, silverplated articles, or any guns, pistols, mechanics tools, i instruments or implements or parts thereof, or any used bicycle, motorcycle, I automobile or parts thereof or accessory, shall within twenty-four (24) hours after receiving or purchasing said article report the same to the chief of police of the city of Ames. No junk dealer purchasing or receiving any such article shall melt up, destroy, dismantle or dispose of the same without making such report or within ten (10) days after such report is made without permission from the chief of police. I Section 11. Consent of Parent. No junk dealer shall purchase or receive any personal property from any minor without first receiving the consent, in I writing, of the parent or guardian and permission from the chief of police to i make such purchase. Section 12. Search Prevented. No person shall knowingly hinder, obstruct, prevent or attempt to prevent the chief of police or police officer from enterin Upon or making examination of the premises of any junk dealer, for the purpose of discovering stolen property or otherwise enforcing the provisions of this i ordinance. I Section 13. Penalty. Any person who shall do business as a junk dealer as defined in this ordinance, without obtaining a license, or who shall refuse, neglect, or fail to comply with any of the provisions of this ordinance shall be guilty of a misdemeanor, and upon conviction shall be fined a sum not exceed- ing one-hundred dollars ($100. 00) or may be committed tojail for a period not exceeding thirty (30) days. Section 14. Repeal. All ordinances or parts of ordinances in conflict I herewith are hereby repealed. Section 15. This ordinance shall be in full force and effect from and after its passage and publication asprovided by law. Passed this 31st day of January, 1956. J. W. Prather, City Clerk J. P.
