ORDINANCE NO, 835
AN ORDINANCE DEFINING THE POWERS AND DUTIES HER FRDINANCESTHE MAYOR,
NAND
REPEALING ORDINANCE NUMBER 551 AND ALL
CONFLICT HEREWITH,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA: ;
Section 1. General Powei s. The Mayor shall have all the powers and perfor
such duties as are now, or may hereafter, be conferred or directed by the
statutes of the State or as herein or hereafter be required by ordinance or
resolution of the City Council. `
Section 2. Preserve the Peace. He shall be a conservator of the peace, and}I
within the limits of the city, shall have all the powers conferred by state laws
upon sheriffs to suppress disorders.
Section 3. Chief Executive. He shall be the chief executive officer of the
city and it shall be his duty to enforce all regulations and ordinances. He may,
upon view, arrest anyone guilty of a violation thereof, or of any crime under
the laws of the state, and shall, upon information supported by affidavit, issue
process for the arrest of any person charged with violating any ordinance of the
city.
Section 4. Supervise Conduct of Other Officers. He shall supervise the
conduct of all corporate officers, examine into the grounds of complaint made
against them, and cause all neglect or violation of duty to be corrected, or
report the same to the proper tribunal, that they may be dealt with as provided
by law. I

Section 5. Presiding Officer of Council. He shall be the presiding officer
of the Council with the right to vote only in case of a tie. j�
Section 6. Office. He shall keep an office in the City Hall in the rooms now
set aside for the use of the Mayor, and provide for the keeping of the corporate
seal thereof.

Section 7. Mayor Protempore. He shall designate one of the members of the
council as Mayor Protempore subject to the approval of a majority of the councilj.

Section 8. Sign Commissions, Licenses and Permits. He shall sign all
commissions, licenses and permits granted by authority of the Council, except
ias is otherwise provided by ordinance, and do such other acts as by law or
ordinance may require his signature or certificate.
Se�tion 9. Sign Ordinances and Resolutions. He shall sign every ordinance'
or resolution passed by the Council before the same shall be in force. If he
refuses to sign any such ordinance or resolution, he shall fall a meeting of the
Council within fourteen days thereafter and return the same with his reasons I
therefor. If he fails to call such meeting within the time fixed above, or fails
to return the ordinance or resolution with his reasons as herein required, such I
ordinance or resolution shall become operative without such signature.

Section 10. Remove Persons Appointed by Him. He may remove any
provisions of Chapter 365, Cod
person appointed to office by him, subject to the
of .Iowa 19541, (Civil Service) but every such removal shall be by written order,
and shall give the reasons therefor, and the order filed with the City Clerk.

Section 11. Institute Suits. He may by resolution of the Council, institute j
a suit in equity in the District Court to void any plat of the City filed and IJ
recorded in violation of the Sections 409. 14 and 409. 15 Code of ,Iowa, 1954.
Section 12. Board of Arbitration. He may make written application to the
Governor for the appointment of a board of arbitration and conciliation in labor
disputes, as provided in Chapter 90, Code of Iowa, 1954.
Section 13. Sign Contracts. He shall, i n behalf of the municipality, sign
all contracts made between the municipality and any other party, where the
contracts are authorized and directed to be made by the Council, except in case
where some other person or committee is expressly authorized to do so. He
shall see that all contracts made with the municipality are faithfully performed
by the contracting party, and in all suits conducted before any tribunal, and
when the municipality is a party interested in the results, he shall advise with,
and in as far as practical assist, the attorney for the municipality in collecting
the testimony, conducting the trial and protecting the interest of the municipality.
Section 14. Sign Bonds. He shall sign all bonds issued by the City and affix
the corporate seal thereto.
Section 15. Chairman Board of Health. He shall be chairman of the local
Board of Health and as chairman of said board, enforce the statutes of the
state relative to public health, the rules of the state department and local board
Section 16. Appoint Advisory Committees. He may, from time to timer byl
and with the approval of the Council, appoint such advisory committees for the
purpose of obtaining information and making recommendations to the Council
of the City of Ames.
Section 17. Appoint Police Chief. The Mayor shall appoint a Chief of
Police and such other police officers as may be authorized by ordinance or
resolution. He may also, in emergencies, appoint such special policemen
as he may think proper, reporting such appointments to the council at its
next regular meeting. Such special appointments shall continue in force until
such meeting, unless sooner terminated by the Mayor.
Section 18. Appoint Members of Various Boards. He shall appoint with
the approval by the Council, the members of the Civil Service Commission,
Hospital Board of Trustees, Library Board of Trustees, City Plan Commission,
Playground Commission, Board of Plumbing Examiners, Zoning Adjustment
Board, two members of the Council to the Board of Trustees of the Utility
Employees Retirement System, members of the Building Code Board of Appeals
a:.-id two members each to the Police Retirement Board and the Firemen's
Retirement Board.
Section 19. Salary. He shall receive a yearly salary of Six Hundred and
No/100 Dollars ($6DD. 00), payable semi-monthly, or such sum as hereafter,
at the beginning of his term, may be established by ordinance.
Section 20. Repeal. Ordinance No. 551 and all ordinances or parts of
ordinances in conflict with the provisions of this ordinance are hereby repeale I.
Section 21. This ordinance shall be in force and effect from and after its
passage and publication as provided by law.

of the City of Ames, Iowa, do hereby certify that the above and foregoing
Ordinance No. 835 is a true and exact copy of said ordinance and that said
ordinance was passed and adopted by the City Council of the City of Ames, Iowa
at an adjoumed meeting thereof on the 31st day of January, 1956 and published
by codifying on the day of 0 19 .
