HomeMy WebLinkAbout~Master - Regulating Fireworks, Repealing Ordinance 548, 782 j ORDINANCE NO. 833 AN ORDINANCE PROHIBITING THE SALE OF FIREWORKS, REGULATING SUPERVISED DISPLAYS OF FIREWORKS UNDER CERTAIN CONDITIONS, AND REPEALING ORDINANCE NO. 548, 782 AND ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA: i Section 1. Definition. The term "fireworks" shall mean and include any explosive composition, or combination of explosive substances, or article prepared for the purpose of producing a visible audible effect by combustion, explosion, deflagration or detonation, and shall include blank cartridges, balloons which require fire underneath to propel the same, firecrackers, torpedoes, skyrockets,, roman candles, daygo bombs, or other fireworks of like construction and any fireworks containing any explosive or inflammable compound, or other device containing any explosive substance. Toy pistols, revolvers and guns using dyna- mite caps shall not be deemed to be fireworks. Section Z. Supervised Exhibitions. Except as hereinafter provided, it shall b� unlawful for any person, firm, copartnership, or corporation to offer for sale, expose for sale, sell at retail, or use or explode any fireworks; provided the city ,council may, upon application in writing, grant a permit for the display of fireworks by any organization or group of individuals when such fireworks displays w will be handled by a competent operator. After such privilege has been granted sales of fireworks for such display may be made for that purpose only; provided further, that nothing in section 1 hereof shall be construed to prohibit any resident, dealer, manufacturer, or jobber from selling such fireworks as are not herein prohibited; or the sale of any kind of fireworks provided the same are to be shipped out of the state; or the sale or use of blank cartridges for a show or theater, or for signal purposes in athletic sports or by railroads, trucks, for signal purposes, or by recognized military organizations; and provided further that nothing in this ordinance shall apply to any substance or composition pre- pared and sold for medicinal or fumigation purposes. Section 3. Penalty. Anyone violating any of the provisions of this ordinance shall, upon conviction, be imprisoned in jail not to exceed thirty days, or fined not to exceed one hundred dollars ($10D. 00). Section 4. Repeal. Ordinance No. 548, 782 of the city of Ames and all other ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 5. This ordinance shall be in full force and effect from and after its passage and publication as provided by law. jPassed this 31 st day of January, 1956. J. W. z ather, Auditor & Clerk J. P.
