HomeMy WebLinkAbout~Master - Vacating Public Walkway in Moore's Third Addition ORDINANCE NO. 829 AN ORDINANCE VACATING THE PUBLIC 'NAL-K-WAY BETNEEN LOTS 8 and 9 IN MOORStS THIRD ADDITION COUNTRY CLUB HEIGHTS. Be It Ordained by the City Council of the City of Ame.f,, Iowa, as follows : SECTION 1 : That the public walkwav between lots and 9, Mloore ' s Third f.ddition Country Club Heights, upon recommendation of the City Planning Commission and investigation by the City Council, is hereby determined to be unnecessary as a public walkway and is hereby vacated and discontinued. SECTION 2: That it is hereby determined as necessary and proper that the City retain a right-of-way and easement for any any- all public utilities over, under, and across the said vacated walkway. SECTION 3 : That the Mayor and City Clerk are hereby authorized and directed to execute quit claim deeds, containing the proper easement and reservation, conveying said walkway equally to the abutting property owners, as their respective interests may appear. SECTION 4: That the City Clerk is hereby authorized and directed to make a certified copy of this ordinance and attach the same to said deeds . SECTION 5: All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION 6 : This ordinance shall be in full force and effect from and after passage and publication as provided by law. Passed this 6 day of _ December 1955. sei Lawlor l or. _ N. Prather, City Clerk of the City of Ames, Iowa, do hereby certify that the above and foregoing Ordinance No. 829 was duly and properly passed at a meeting of the City Council on the 6th day of December, 1955 and published in the Ames Daily Tribune on the loth day of December, 1955.
