ORDINANCE NO. 819
AN ORDINANCE DEFINING THE POWERS AND DUTI
ES OF THE FIRE DEPART
MENT AND REPEALING ALL OTHER ORDINANCES OR PARTS OF ORDINANCES
IN CONFLICT HEREWITH,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA: i
Section 1. Administration. The chief and all members of the fire
department shall be appointed by the city manager from the approved lists of
the civil service commission in accordance with the statutes governing civil
service.
SectionZ Distribution of Personnel. The chief of the fire department
shall have the power and authority to assign the personnel of the fire department
as he deems necessary to carry out the functions and duties of the department,
and to prescribe rules and regulations for the conduct and management of the
department.
Section 3. Duties of Chief. The duties of the chief of the fire depart-
ment, subject to the directions and control of the city manager, shall be as
hereinafter stated.
Section 3. 1. Property. He shall take charge of and be responsible for i
all property of the fire department. He shall see that all property is in good
IIorder and condition and fit for use at all times. At the expiration of his term
of office he shall deliver the same to his successor in office, or shall satis-
factorily account therefor.
Section 3 2 Control of Department. He shall have command and
control of the fire department and shall see that all persons employed by the
fire department are properly organized, drilled and equipped for active service.
Section 3. 3. Records. He shall keep a record of the officers and men
in the department, with their respective positions and rank.
He shall keep a record of all fires attended which record shall show:
(a) When and where such fire occurred.
(b) The kind of building or structure, and a separate estimate of
the loss to the building and contents.
(c) The amount of insurance thereon, if any.
(d) Such other detailed information as may be prescribed by the
city manager.
1 Section 3. 4. Annual Report. He shall make an annual report of the
activities of the fire department for each calender year and the same shall be
filed with the city clerk on or before February first of the year following, and
in addition shall make such other reports as may be requested by the city counc 1.
Section 3. 5. Budget. He shall prepare and file with the city manager
on or before July first of each year a detailed budget of proposed expenditures
for the following fiscal year.
Section 3. 6. Inspection of Buildings. He shall cause such inspections
to be made by members of the department of all buildings within the fire
limit districts of the city as may be deemed necessary for fire prevention.
He shall personally inspect periodically the storage of volatile or flammable
liquids, exits, fire prevention and fire extinguishing apparatus and facilities
in all buildings or structures, and shall report in writing to the building official,
any violations of the ordinances of the city in respect thereto.

Section 4. The members of the department under direction of the

chief shall operate in accordance with rural fire protection agreements approved
by the city council. All such agreements shall receive the approval of the
city council before being effective.
Section 5. Interference With Fire Department. The officers, men and
apparatus of the fire department shall have the: right of way while going to or at
any fire, and any person willfully obstructing the member s of the department
in the performance of their duty shall be deemed guilty of a misdemeanor and
I liable to punishment for such offense.

Section 6. Street Openings and Obstructions. It shall be the duty of the;
members of the fire department upon observing or being informed of any street
openings, excavations, obstructions or conditions within the street limits, likely
lIto cause injury to persons or property, to promptly notify the city manager of
such condition and in emergencies to take such immediate action as may be
I necessary to protect the public from injury until the condition can be remedied.

Section 7. Power to Summon Members Off Duty. In the event of any
great, threatening or unusual conflagration, the chief of the fire department,
his assistants or other person in charge or command of the fire department,
shall have the power and authority to summon such members of the department
as may be off duty to assist in the protection of life and property and it shall be
the duty of such members of the department to respond promptly to such summons.
Section 8. Repeal. All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
II Section 9. This ordinance shall be in. full force and effect from and
after its passage and publication as provided by law. i
