AN ORDINANCE MAKING IT THE DUTY OF THE OWNERS OF REAL ESTATE
IN THE CITY OF AMES, IOWA, TO KEEP ABUTTING SIDEWALKS FREE AND
CLEAR FROM SNOW, ICE, OR ACCUMULATIONS, PROVIDING PUNISHMENT
FOR A FAILURE SO TO DO, PROVIDING FOR ASSESSING THE ABUTTING
PROPERTY OF THE EXPENSE OF REMOVAL BY THE CITY, AND REPEALING
ORDINANCE NUMBERS 565, 710 AND ALL OTHER ORDINANCES AND PARTS
OF ORDINANCES IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA:
Section 1. Duty of Property Owner. It shall be the responsibility of the
abutting property owner to promptly remove snow, ice, and accumulations from
the sidewalks.
Section 2. Failure of Owner to Remove. Any owner who shall, for a
period of ten (10) daylight hours after the cessation of the storm or cause of
accumulation, permit snow, ice, or accumulations to remain upon the adjoining
and abutting sidewalks, shall be guilty of a misdemeanor and upon conviction
thereof be fined a sum not exceeding twenty-five dollars ($25. 00) and costs, and
in default of payment, be committed to the city or county jail for a period not
exceeding ten (1'0) days.
Section 3. City Manager May Remove. In addition to and notwithstanding
the punishment provided in above section, should snow, ice, or accumulations be
permitted to remain upon any sidewalk for a period of ten (10) daylight hours
after the cessation of the storm or cause of accumulation, the city manager may,
without notice to the property owner, cause the same to be removed and the actual
cost of such removal assessed against the property as herein provided.
Section 4. Procedure of Assessing Costs of Removal. When snow, ice
or accumulations have been removed from any sidewalk, under the provisions of
the preceding section, the procedure to secure payment of the cost of removal of
snow, ipe, or accumulations to the city shall be as follows:
(a) The city manager shall submit to the council an itemized and
verified statement showing expendituresof material, labor and equipment used
in making such removal, the name of the owner or owners of the property, and
the description of the lot, part of lot, or parcel of ground infront of and abutting
upon the sidewalk from which snow, ice or accumulations have been removed.
(b) The council shall examine the verified statement and if found correct
shall assess the actual cost of such removal against such lot, part of lot, or
parcel of ground, and direct the city cleric to certify said costs and assessments
to the county auditor and it shall then be collected with, and in the same manner
as, general taxes as provided in section 368. 4, Code of Iowa, 1954.
Section 5. Repeal. Ordinance numbers 565 and 710 and all other
ordinances or parts of ordinances in conflict herewith are hereby repealed.
Section 6. This ordinance shall be in full force and effect from and after
its passage and publication as provided by law.
