PERM, ORDINANCE NO. 791 I� 9 34 AN ORDINANCE DEFINING MOBILE HOMES AND PARKS, PROVIDING FOR THE SSUANCE OF PERMITS THEREFOR, REGULATING MOBILE HOMES AND MOBILE OME PARKS, PROVIDING PENALTIES FOR THE VIOLATION THEREOF, AND EPEALING ORDINANCE NO. 543 AND ALL OTHER ORDINANCES OR PARTS F ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA. Section 1. Definitions. The following definitions shall apply to this Ipr dinanc e. �I Section 1. 1. Mobile Home. A mobile home shall mean any occupied vehicle used or so constructed as to permit its being used as a conveyance upon he public streets or highways and duly licensed as such, and shall include elf-propelled or nonself-propelled vehicles, so designed, constructed, reconstru ted r added to by means of an enclosed addition or room in such manner as will permit he occupancy thereof as a dwelling or sleeping place for one or more persons, aving no permanent foundation and supported by wheels, jacks or similar supports. Section 1. 2. Mobile Home Space. A mobile home space is a plot of groun within a mobile home park designed for the accommodation of one (1) mobile home it Section 1. 3. Independent Mobile Home Space. An independent mobile home pace is a mobile home space which has individual water and sewer connections vailable. Section 1. 4. Dependent Mobile Home Space. A dependent mobile home space is a mobile home space which does not have individual water and sewer :connections available. I� Section 1. 5, Dependent Mobile Home. A dependent mobile home is a mobi e home which does not have a water closet, nor a bathtub or shower. Section 1. 6. Independent Mobile Home. An independent mobile home is a mdDile home which has a water closet and a bathtub or shower. Section 1. 7. Mobile Home Park . A mobile home park shall mean any site, lot, field or tract of land upon which two or more occupied mobile homes are harbored, either free of charge or for revenue purposes, and shall include ny building, structure, tent, vehicle or enclosure used or intended for use as art of the equipment of such mobile home park. I The term mobile home park shall not be construed to include mobile homes, buildings, tents or other structures temporarily maintained by any individual, e educational institution, or company on their own premises and used exclusively to house their own labor or students, j Section 1. 8. License. License shall mean the annual license issued by the state department of health for a mobile home park. Section 1. 9. Permits. A permit as used in this ordinance shall mean the permits issued by the City of Ame s for mobile homes and for mobile horne parks. Section 2. Illegal Parking of Mobile Homes, It shall be unlawful for any erson, firm, or corporation to park any occupied or unoccupied mobile home: (a) On any public street, alley, highway, or other public place within the corporate limits of the City of Ames, fora period of time in I excess of two (2) hours, and then only between the hours of sunrise and sunset. (b) For more than forty-eight (48) hours on the an remises of P y occupied dwelling or business building, nor more than twenty-four (24) hours on any lot which is not a part of the premises of any occupied dwellin or business building, except in a licensed mobile home park, unless a permit therefor shall have been first obtained as required herein. Section 3. Allowing Illegal Parking of Mobile Homes. It shall be unlawful for any person, firm, or corporation to allow any premises osccupied by him, her or it to be used in violation of the terms of this ordinance. A violation of this ordinance by the occupant of a mobile home shall raise the presumption that said violation was consented to by the person, firm, or corporatim occupying or owning the premises. Section 4. Application for a Permit to Occupy a Mobile Home Outside a Mobile Home Park. All applications to occupy or park a mobile hone on private property outside a licensed mobile home park shall be filed with the city manager i on forms furnished by the city. Section 5. Information - Mobile Home. Each application for a permit to occupy a mobile home outside of a licensed mobile home park shall contain the following information: I! (a) The street and house number of the principal buildig on the lot, or a description of the premises to be occupied by the mobile home. (b) The name of the occupant of said premises. (c) A plat showing the proposed location of the mobile home on the premis s and all other occupied buildings within fifty (50) feet thereof. ` (d) The number of persons to occupy the mobile home together with the (� name and permanent address of the applicant. I (e) A statement of the nature and location of the sanitary facilities to be used by the mobile home occupants and the written permission of the occupant of the dwelling or business building providing such sanitary facilities consenting to the use thereof, provided, that in no case shall such sanitary facilities exceed a distance of one hundred (100) feet from said mobile home. (f) A statement that all waste water from the mobile home shall be emptied into a proper sewer connected fixture. I (g) A statement that all garbage will be kept in fly tight receptacles with tight fitting covers, which receptacles will be kept in a sanitary condition at all times. (h) The length of time requested for occupancy on the premises. Whenever the requested period of occupancy of the mobile home exceeds fourteen (14) days the applicant shall accompany the applicationwith the writteni consent of all property owners or their legal agent within two-hundred (200) feet of the proposed mobile home location. ISection 6. Investigation. The city manager upon receipt of any applicatio ,, containing the information herein required for mobile homes shall cause an investigation of the facts and statements to be made as set forth in said applica- tion. i Section 7._ Approval of Application. If after investigation the city manage ' shall find the statements and information in the application to be complete and true he shall note his approval thereon and shall indicate the length of time the permit is to be effective, which period of time shall not exceed thirty (30) days. Section 8. Issuance of Permit. The city clerk upon receipt from the city) manager of an approved application for. a mobile home permit and the payment of the required permit fee, shall issue a permit therefor for the approved period of time and shall retain a record of such permit in his office. i I Section 9. Renewal of Permit. A permit for the occupancy of a mobile home on private propertymay, upon application to the city manager, be renewed for a period of not to exceed thirty (30) days upon payment of the renewal fee as herein provided. Section 10. Permit Fee. The permit fee for occupancy of a mobile home outside a mobile home park shall be five dollars ($5. 00). The fee for renewal of a mobile home permit on private premises outside a mobile home park shall be two dollars ($2. 00). Section 11. Permanent Additions or Attachments. No permanent additions or attachments of any kind shall be built onto or become a part of any mobile home nor shall any mobile home, other than one located in a mobile home park, be attached to the ground by means of posts, piers or foundations. Section 12. Mobile Home Sales Lots. The provisions of this ordinance hshall not apply to unoccupied mobile homes on sales lots located within the limits, of districts zoned for business or industry within the City of Ames. i Section 13. Mobile Home Parks. It shall be unlawful for any person, �) firm or corporation to begin the construction and/or operation of a mobile home park within the City of Ames without the owner or lessee first having obtained a permit therefor as provided in this ordinance and a license to operate and maintain a mobile home park from the state department of health. Section 14. Application for Mobile Home Park Permit. The application for a permit to operate a mobile home park shall be filed on a form furnished by the city with the city manager who shall present the application to the city council for consideration at the first regular meeting following the filing of said application. The application shall state the name or names of the attendant or attendants to be in active charge of the mobile home park and his or their hours of duty, and be accompanied by a plat and other documents showing the following inf ormati on: i (a) A legal description of the mobile home park area, (b) The extent of the area to be used for mobile home park purposes, (c) Location and size of mobile home lots, (d) Location, number, and type of construction of existing or proposed toilets, washrooms, laundries, laundry drying space and utility rooms, (e) Method and plan of sewage disposal, (f) Public water supply taps and facilities, (g) Method and plan of garbage disposal, (h) Plan of electric lighting including the location of exterior park lights and the electric facilities provided for mobile homes, (i) Incinerator and burning space, (j) Children' s play area, (k) Drainage facilities, (1) Fire protection facilities. Sectiom 15: - Permit ReauiremPnts. No permit for the construction • , and/or operation of a mobile home park shall be issued unless: (a) The park shall be located on a well drained site; (b) the park has a surfaced entrance and exit, said entrance and exit, or either of them, being not less than eighteen (18) feet in width and plainly marked in the daytime and adequately lighted at night; (c) all roads within the park are surfaced, easily accessible to all mobile 1-1 home s and adequately lighted; (d) the park is divided into lots for each mobile home, the boundaries of each lot indicated by corner markers, and each lot having an area not less than eight hundred (800) square feet with a minimum width of twenty (20) feet and a minimum depth of thirty-five (35) feet; (e) adequate space is provided to afford space for clothes drying adjoin- ing laundry facilities, locations for burning space and incinerator spa e, and play space for children; (f) a sufficient supply of drinking water meeting the sanitary requirements. of the state department of health is provided inconvenient locations, provided, however, if water from a private source is to be used it shall be tested at intervals of thirty(30) days by the City of Ames at the expense of the permittee; (g) all waste water shall be emptied into a drain connected to an approved disposal system; (h) there is no common drinking vessel for drinking water in toilet com- partments; (i) an abundant supply of hot water is provided at all times for bathing, washing and laundry facilities; (j) there is provided flush toilets inconveniently located buffiings not more than one hundred fifty (150) feet from the most remote dependent mobile home, said buildings being well lighted at all times and constructed of moisture proof material permitting satisfactory cleanin said buildings having floors of concrete or similar material with floor drains, and said buildings being well screened and fly tight; (k) there is provided a minimum of one toilet for each sex; (1) separate bathing facilities for each sex are provided not more than one hundred fifty (150) feet from the most remote dependent mobile home in the park, each section containing one shower per sex, said sections being not less than hine (9) square feet in area with a dressin compartment not less than ten (10) square feet in area and constructed out of like material and in the same manner as designated for toilet buildings; (m) adequate laundry facilities are provided; (n) provision is made .for garbage receptacles sufficient to prevent litter- ing the ground with rubbish and debris and said garbage receptacles to be fly tight depositories with tight fitting covers conveniently locatea not farther than two hundred (200) feet from any mobile home; ( 0) provision is made for adequate fire protection; (p) all construction and installations at the mobile home park site confor to the requirements of the ordinances of the City of Ames, Iowa. Section 16. 4proval of Application. The city council shall consider said 1 i application and if found satisfactory shall instruct the city clerk, upon payment of the permit fee, to issue a mobile home park license and retain a record thereof in his office. i Section 17. Mobile Home Park Permit Fee. The permit fee for a mobile ! ! home park shall be ten dollars ($10. 00) for the first year or fraction thereof and i such permit, unless revoked, may be renewed annually upon the payment of five dollars $5. 00) at the office of the city clerk. l i I Section 18. Registration of Guests. The owner, lessee, or attendant in charge of a mobile home park shall keep a record of all guests. Said record shall be available for inspection at any time by an official of the City of Ames and shall contain the following information: (a) Name and address of each mobile home occupant; (b) License number of mobile home and/or automobile; (c) State of issuance of such licenses; { (d) Date of arrival and departure from the park Section 19. Suspension of Mobile Home Park Permit. Any mobile home jpark permit issued under this ordinance shall be suspended by the City council if I the operator thereof fails, within 24 hours after notification to: (a) locate each mobile home so that it will be at least ten (10) feet from any building and not nearer than five (5) feet to any property line whic is a street line and three (3) feet to any other property line; I (b) keep garbage depositories in a sanitary condition at all times; (c) empty garbage and refuse depositories at least three (3) ti_res each week during summer months and twice (2) each week during winter months; (d) maintain the park in accordance with the requirements necessary to I! obtain a permit. Section 20. Inspection. Any officer of the City of Am s shall have authority to enter and inspect, at any reasonable time, any facility permitted hereunder. Revocation of Permit. Section 21. / The conviction of any person, firm or corporation for violation of this ordinance or any other ordinance of the City of Ames or statutes of the State of Iowa involving moral turpitude shall automatically revoke any permit issued under the terms hereof. Section 22. Application for Annual Mobile Home Park License. Applica I� tions for an annual license to operate and maintain a mobile home park within the corporate limits of the City of Ames shall be filed on the forms as prescribed by the state department of health with the board of health of the City of Arne s. Section 23. Approval by Local Board of Health. When the local board of health has approved the application, they shall authorize the city clerk to issue a permit for a license and to forward a copy of such permit together with the application for the mobile home park to the state department of health for the issuance of the annual license. He shall retain a record of such permit in his office. Section 24. Display of Permits and Licenses. The mobile home park permit issued by the Cityof Ames and the annual license issued by the state Department of health shall be conspicuously displayed in the park office at all times. Section 25. Penalty. Anyone violating any of the provisions of tins ordinance shall, upon conviction, be subject to imprisonment not exceeding I thirty(30) days, or to a .fine not exceeding one hundred dollars ($100. 00). e ,I Section 26. Repeal. Ordinance No. 543 and all other ordinances or parts Iof ordinances in conflict herewith are hereby repealed. Section 27.
