TEMPORARY ORD. NO. 33 PERM. ORD. NO. 782
AN ORDINANCE PROHIBITING THE SALE OF FIREWORKS, REGULATING
SUPERVISED DISPLAYS OF FIREWORKS UNDER CERTAIN CONDITIONS, AND
REPEALING ORDINANCE NO. 548 AND ALL OTHER ORDINANCES OR PARTS
OF ORDINANCES IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITYOF AMES, IOWA:
Section 1. Definition. The term "fireworks" shall mean and include any
explosive composition, or combination of explosive substances, or article
prepared for the purpose of producing a visible audible effect by combustion,
explosion, deflagration or detonation, and shall include blank cartridges, toy
pistols, toy cannons, toy canes, or toy guns in which explosives are used,
balloons which require fire underneath to propel the same, firecrackers, torpedoes,
skyrockets, roman candles, daygo bombs, or other fireworks of like construction
and any fireworks containing any explosive or inflammable compound, or other
device containing any explosive substance.
Section 2. Supervised Exhibitions. Except as hereinafter provided, it
shall be unlawful for any person, firm, copartnership, or corporation to offer
for sale, expose for sale, sell at retail, or use or explode any fireworks;
provided the city council may, upon application in writing, grant a permit for
the displayof fireworks by any organization or group of individuals when such
fireworks display will be handled by a competent operator. After such privilege
has been granted sales of fireworks for such display maybe made for that
purpose only; provided further, that nothing in section 1 hereof shall be construe
to prohibit any resident, dealer, manufacturer, or jobber from selling such
fireworks as are not herein prohibited; or the sale of any kind of fireworks
provided the same are to be shipped out of the state; or the sale or use of blank
cartridges for a show or theater, or for signal purposes in athletic sports or by
railroads, trucks, for signal purposes, or by recognized :military organizations;
and provided further that nothing in this ordinance shall apply to any substance o
composition prepared and sold for medicinal or fumigation purposes.
Section 3. Penalty. Anyone violating any of the provisions of this ord-
inance shall, upon conviction, be imprisoned in jail not to exceed thirty days, or
fined not to exceed one hundred dollars ($100. 00).
Section 4. Repeal. Ordinance No. 548 of the city of Ames and all other
ordinances or parts of ordinances in conflict herewith are hereby repealed.
Secti on 5. This ordinance shall be in full force and effect from and
after its passage and publicatinn as provided by law.
