AN ORDINANCE. ESTABLISHING THE. NUMBER OF PARK COMMISSIONERS,
PROVIDING FOR. THEIR ELECTION, PRESCRIBING THEIR TERM OF OFFICE.,
AND DEFINING THEIR RIGHTS AND DUTIES.

BE IT ORDAINED BY THE CITY COUNCIL OF THE. CITY OF AMES, IOWA;
Section 1. Membership. The park commission shall consist of three members,
elected from the city at large. Each commissioner shall be a resident of the
city and at least one commissioner shall be a resident of Washington Township
and one a resident of Franklin Township,

Section 2. Election - Term of Office. One commissioner shall be elected at each
general city election for a term of six years.

S--ction 3, Organization. The commission shall at its first meeting in January
of each year elect one of its members as chairman and one member as secretary.
Two members shall be necessary to constitute a quorum. Each commissioner shall
give a bond with sureties to be approved by the city council, in the penal sum of
one thousand dollars ($1, 000. 00), conditioned for the faithful discharge of his
offic e.
Section 4. Treasurer. The city treasurer shall be the treasurer of said board
and pay out all moneys under the control of the board on orders signed by the
chairman and secretary, but shall receive no compensation for his services as
such treasurer.
iSection 5. Compensation, Each commissioner shall receive such salary as shall
I be fixed by the city council, not to exceed in the aggregate annually ten dollars
($10, 00) for each thousand population or fraction thereof according to the last
federal census, said compensation to be paid out of the -recreation fund,
Section 6. Tax Levy. The commission shall, on or before the first day of July
of each year, determine the amount to be levied, collected and appropriated for
the ensuing year for general park purposes, and shall certify such amount to the
city council on or before the fifth day of July,
Section 7. General Powers. The par_= commission shall have the following power:
Section 7. 1, Acquisition of Real Estate. The park commission may acquire real,
estate within or without the city for park purposes by donation, purchase, or
condemnation, and tal-ze the title to the same in the name of the part.: commission
in trust for the public and hold the same exempt from taxation.
Section 7.2. Disposal of Real Estate. The park commission may sell, subject I
to the approval of the city council, exchange, or lease any real estate acquired
by it which shall be found unfit or not desirable for park purposes.
Section 7. 3, Lease to Organizations. The par commission shall have authority
to lease under reasonable rules and requirements a particular par... or portion
thereof, under its jurisdiction, for a period not in excess of ten days, to !
charitable, fraternal and patriotic organizations, for the purpose of permitting
such organizations to conduct celebrations, anniversaries, and entertainments.
They may also lease under reasonable rules and regulations such parks or
portions thereof under their jurisdiction for suchtime or times, not to exceed
six consecutive months, as the commission shall deem proper for the playing of
professional baseball or other professional games and under such conditions as
to charging a fee for the use of same as the commission shall determine.

Section 7. 4. Control of Grounds. The park commission shall have exclusive i
control of all parks and pleasure groands acquired by it or any other ground
owned by the r�ity and set apart for like purposes; and may make contracts, sue
and be sued, but shall incur no indebtedness in excess of its appropriation,
except bonds as authorized by Chapter 370 Code of Iowa, 1954.
(Section 7. 5. Jurisdiction. The park commission shall have jurisdiction over
fall lands used for parks within or without the corporate limits, and all ordinances
of the City of Ames shall be in full force and effect in and over the territory
occupied by such parks.
Section 8. Annual Report. The commission shall make an annual detailed report �
to the city council immediately after the close of each municipal, fiscal year of
the amounts of money expended and the purpose for which used, and such annual
statement shall be published as part of the annual municipal report. i
Section 9. City Engineer. The commission shall be entitled to the services of
the city engineer, when requested without expense to it.
Section 10. Repeal. Ordinance No. 365 and all other ordinances or parts thereof;
in conflict herewith are hereby repealed.
Section 11. This ordinance shall be in full force and effect from and after its I
passage and publication as provided by law.
