AN ORDINANCE PROVIDING FOR THE COLLECTION, REMOVAL AND DISPOSAL
OF GARBAGE AND REFUSE, THE LICENSING OF GARBAGE AND REFUSE
COLLECTION AGENCIES, THE ESTABLISHING OF A CITY OWNED OR LEAS
SANITARY LAND FILL DISPOSAL AREA, AND FOR THE OPERATION AND
CONTROL THEREOF, PROVIDING PENALTIES FOR VIOLATION OF SAID
ORDINANCE AND REPEALING ORDINANCE NUMBER 746 AND ALL OTHER
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA:
Section 1. Definitions.
(a) The word garbage as used in this ordinance shall be held to include
every waste accumulation of animal, fruit, or vegetable matter, liquid or
otherwise, that attends the preparation, use, cooking, dealing in or storing of
meat, fish, fowl, fruit or vegetables, and including tin cans or similar food
containers. Dead animals are not included in the term garbage.

(b) word refuse as used in this ordinance shall be held to include all
other miscellaneous waste materials not specifically defined as garbage.
Section 2. Garbage to be Collected. It shall be unlawful for any person,
firm or corporation to deposit, or place any garbage in any street, alley, lane,
public place or private property outside of buildings, within the City of Ames,
Iowa, unless the same is enclosed in a watertight metal receptacle provided
with handles or bales and a tight-fitting cover, and with a capacity not exceeding
twenty (20) gallons.
Section 3• Refuse to be Collected. Refuse shall be placed in baskets or
boxes not larger than one (1) bushel capacity and shall be provided with handles.
Newspapers and magazines shall be bundled and tied. Hedge and tree trimmings
shall be securely tied in bundles not more than six (6) feet in length or more
than two (2) feet in diameter.
Section 4• Maintenance of Garbage Receptacle. It shall be the duty of any
person, firm or corporation using or maintaining a garbage receptacle to cause
the same to be emptied of its contents before it is so full that the cover will no
longer fit tightly.
Section 5. Householder to Furnish Garbage Receptacle. The proper
receptacle for the receiving and holding of garbage shall be furnished by the
householder or the occupant of any building or place of business and shall be
kept covered and in a sanitary condition at all times; said garbage shall be
wrapped when placed in said receptacle.
Section 6. Location for Collection. All garbage, whenever practical,
shall be delivered by the householder or the occupant of any building or place
of business to the ground level for collection, and the receptacle therefor must
be kept in a location convenient for collection.
Section 7. Placing of Refuse in Streets. It shall be unlawful for any
person, firm or corporation to deposit, throw, or place any refuse in any street,
alley, lane, public place, or private property outside of buildings, within the
City of Ames, unless the same is to be hauled away and, pending hauling, is
kept in such a manner as in no way to constitute a nuisance, hazard, or annoyance
to others.
Section 8. Approved Methods of Disposal. Any garbage o r refuse may be
disposed of by householders or the occupant of any building or place of business
in any of the following manners:
(a) By delivery to a licensed collection agency;
(b) By burial or incineration in such manner as in no way to constitute
a nuisance or annoyance to others;
(c) By hauling to the city operated land fill disposal area and dumping there)
las directed by the custodian incharge, provided that the containers and vehicle
used in transportation conform to the requirements of Section 15 hereinafter set
o rth.
(d) By disposal of garbage in a home garbage disposal unit.
Section 9. License Required. It shall be unlawful for any person, firm or
corporation to collect garbage and/or refuse within the City of Ames, except
from his own residence or business property without first obtaining a license oni
the City of Ame s.
Section 10. Application for License. Application for a license to collect
garbage and/or refuse shall be made at the office of the city clerk on firms
provided by said office. The applicant shall file with his application a certificate
or affidavit of insurance as hereinafter set forth and shall pay the required licens
fee. Upon receipt of such application properly executed, the city clerk shall

refer the same to the city manager for his approval before issuing the license.
Section 11. Insurance. The certificate or affidavit to be filed with the
application shall be executed by representatives of a duly qualified insurance
company evidencing that said insurance company has issued liability and property
damage insurance policies covering the following: First, all operations of the
applicant, or any other person, firm or corporation employed by him in garbage
and refuse collection within the corporate limits of the City of Ames; Second, the
disposal of such garbage and -refuse to and within any area designated asa sanitary
land fill by the City of Ames; third, protecting the public and any person from
injuries or damages sustained by reason of carrying on the work of garbage and
refuse collection and disposal. The certificate or affidavit shall specifically
evidence the following amounts of insurance coverage which shall remain in effect
for the term of the license, and shall provide that writtennotice shall be given the
city clerk thirty (301)days prior to any change in the conditions of the certificate
or affidavit, or any expiration or cancellation thereof.

(a) Public liability insurance $25, 000 per person
$50, 000 per accident
(b) Motor vehicle bodily injury
liability $25, 000 per person
$50, 000 per accident
(c) Property damage $10, 000 per accident.
Section 12. Inspection by City Manager. Upon notice from the citycler';
that an application has been received, the city manager shall cause to be made an
inspection of the applicant's equipment proposed to be used, the pick-up service
to be maintained and his methods of operation; and if they meet the requirements
herein specified, he shall file his approval with the city clerk.
Section 13. Issuance of License. Upon receipt of approval from the
city manager, the filing of the proper certificates or affidavits of insurance and
the payment of the license fee, the city clerk shall issue the applicant a license.
All licenses shall expire on December 31st of the year of issue.
Section 14. License Fee. The license fee shall be five dollars ($5. 00) per
year per truck . If issued after July 1st of any year the license fee for the
remainder of that year shall be three dollars ($3. 00) per truck.
Section 15. Condition of Vehicles. All vehicles used in the transportation

of garbage and refuse within the city shall be kept in a sanitary condition and
shall be so constructed as to prevent leakage in transit. The body of the truck
shall be wholly enclosed or shall at all times while in transit be kept covered
with an adequate cover or a canvass cover provided with eyelets and rope for
tying down. Loading of vehicles shall be done in such manner as to prevent spill-
ing or loss of contents.
Section lb. Frequency of Collections. Collections of garbage from private
-residences shall be made not less than three (3) times per week from May 1st to
November 1st, and not less than two (2) times per week from November 1st to
April 30th.
Collections of garbage from hotels, restaurants, clubs, boarding houses
or other places of like character where considerable garbage is produced daily
shall be made on each week day.
Section 17. Pick-up Service. Each garbage collector shall maintain an
adequate and prompt pick-up service to service all complaints from patrons on
missed service and improper handling. Such service shall be promptly availabl
for servicing complaints from the office of the city manager for any material
improperly deposited within the limits of streets or highways during transit.
Section 13. Hauling to Disposal Site. All garbage and refuse collected
shall be hauled to a designated sanitary land fill disposal site. All operations
including that of unloading shall be as directed by the custodian of the area.
Section 19. Disposal Sites Under Control of City Manager. The schedule
of operation, and all matters pertaining to the control and disposition of garbage
and refuse material at sanitary land fill disposalsites shall be under the super-
vision, inspection,and direction of the city manager.
Section 20. Periodic Inspection of Equipment. Frequent inspections shall
be made by the custodian of disposal sites of equipment used in the transportatio
of garbage and refuse; and repeated violations of the requirements herein
specified shall be called to the attention of the city manager.
Section 21. Revocation of License. The city council may for repeated
violations of the provisions of this ordinance upon recommendation of the city
manager revoke any license issued after notice and hearing to the person or
persons affected.
Section 22. Hours of Dumping at Disposal Sites. The hours when dumping)
of garbage and -refuse at the disposal sites will be permitted shall be posted in
a conspicuous manner at the entrance to such sites, and any dumping at any othe�
time is unauthorized and hereby prohibited.
Section 23. Establishmetit of Sanitary Land Fill Areas. There is hereby
established sanitary land fill areas,at such place or places as the city council
upon the recommendation of the city manager may direct, where all garbage and
refuse originating within the corporate limits of the City of Ames shall be
deposited. It shall be unlawful to deposit such material in any other place.
The custodian of the area may be named as a special police officer or deputy
sheriff, but he shall not be eligible to participate in the health and retirement
system of the police department of the City of Ames.
Section 24. Reservation of City's Rights. The city -reserves the right
to enter into contract at any time with any license holder or others, for the
collection and disposal of garbage and/or refuse within the city, or may itself
operate and maintain such a service.
Section 25. Penalty
. Any person, firm, or corporation violating any
provisions of this ordinance shall upon conviction be fined a sum not exceeding
one hundred dollars ($100. 00) and in default of payment thereof shall be
committed to the city or county jail for a term of not exceeding thirty (30) days.

I Section 26. Zepeal. All ordinances or parts thereof in conflict herewith,
particularly ordinance number 746 is hereby repealed.
Section 27. This ordinance shall be in full force and effect from and after
its passage and publication as provided by law.
