AN ORDINANCE PRESCRIBING RULES AND REGULATIONS GOVERNING THE
MOVING OF STRUCTURES UPON, ALONG, ACROSS, OVER. OR NEAR ANY
STREET, AVENUE, ALLEY, HIGHWAY, OR OTHER PUBLIC GROUND OF THE
CITY OFAMES, THE ISSUANCE OF LICENSES AND PERMITS THEREFOR,
REPEALING ORDINANCES ROB. 576 AND 639 ING PENALTIESIFOR VIOLATIALL ONSCONFLICTING

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AMES,IOWA:
Section 1. Definition of Structure. The term "structure" as used in
this ordinance shall mean any house, building, or otherstructure eight () feet or
more in width, which is to be moved from one location

The term "house mover" as
Section 2. Definition of House Mover.
used in this ordinance shall mean a person, firm, or corporation who has been
issued a valid license to move structures.
Section 3. License Required. No person, firm, or corporation shall
engag e in the bu sine s s of moving structur e s within the City of Ame s, or haul or
transport any structure upon, across, or over any street, avenue, alley, highway
sidewalk, or public ground of the city, or raise, lower, or move any structure
within twenty (20) feet of any public sidewalk without first obtaining a license
and/or permit therefor, as hereinafter provided.
Section 4. Application. Any person, firm, or corporation intending
to carry on the business of house mover in the City of Ames, shall file in the
office of the city manager an application in writing upon forms furnished by the
city, and among other things, such application shall state:
(a) The name and address of the applicant.
(b) The foreman or other person who will have charge of work
done, his qualifications and experience as such, and that
he has knowledge of the provisions of the city ordinances
relating thereto.
(c) The applicant agrees to reimburse the city or others for all
costs incurred in the moving of structures under the provisions
of the license and permit issued therefor.
Section 5. Bond. The applicant must, before the license shall be

conditioned that all work done under such license shall be done in a good,
workmanlike manner and in accordance with the ordinances of the City of i- rmes
relating thereto and that the applicant or his sureties will pay to the city or any
person injured all damages for injuries to persons or property caused by the
negligence, fault, or mismanagement of said applicant or person in his employ,
or due to any other cause, in doing any work under said license or any permit
issued for such work, and will pay to the city any cost or expense incurred in
repairing or restoring any pavements, curbs, sidewalks, electric facilities,
or other public works injured and of restoring such works to its previous
c onditi on.
Suction 6. Insurance. The applicant must, before a license shall be
issued, file with the city clerk a certificate or affidavit executed by representa-
tives of duly qualified insurance companies, evidencing that said insurance
companies have issued liability and property damage insurance policies oovering
all operations of the house mover, or any other person, firm, or corporation
employed by him in house moving operations, and protecting the public and any
person from injuries or damages sustained by reason of carrying on the work of
house moving by the house mover. The certificate or affidavit shall specifically
evidence the following amount of insurance coverage which shall remain in effect
for the term of the license, and said certificate shall

Section 7. Issuance of License. Upon approval of the application for
a license, the filing and approval of the bond and certificate of insurance set forth
herein, and the payment of the license fee, the city clerk shall issue a license to
the applicant as a house mover. C

Section 8. License Fee. The fee for a license as a house mover shall
be $25. 00, and the license h 1i en ire on tnotfir be transferable st day of January next ensuing
after issuance therefor.
Section 9. Permit Mandatory. No person, firm, or corporation shall

move any structure upon, across, or over any street, avenue, alley, highway,
sidewalk, or public ground of the city, or raise, lower, or move any structure
within twenty (20) feet of any public sidewalk, without first obtaining a permit
therefor from the city manager as herein provided.
Section 10. Details of Application. All applications for a permit as
herein required shall be in writing on forms furnished by the city, filed in
the office of the city manager, and, among other things, shall state:
(a) The name and license number of the house mover.
(b) The present and proposed location of the structure to be moved
together with the name and address of the owner thereof.
(c) The building permit number as issued for the structure in the
proposed location.
(d) A description of the structure to be moved, with the size,
maximum height when loaded and ready to be moved and the
maximum width of the structure in the direction of travel.
(e) The route over which the structure is to be moved.
(f) The day and hour of thublic day s the

wires, cables, or guys will have to be cut or moved and the

(m) Said application shall state that all work will be done in strict
accordance with the provisions of this ordinance and under the
direction and supervision of the city manager.
Section 11. Compliance with Ordinances. No moving permit shall be
issued unless the structure, if moved to a new location in the city, will comply
with the zoning, building code and all other ordinances of the city.
Section 12. Restrictions on Moving. No moving permit shall be
issued to move any structure over the paved streets, avenues, or highways of
the city when the maximum width of such structure in the direction of travel

Section 13. Moving Not Regdring License. The city manager may
issue moving permits for structures to persons, fstr s or or dothe e s etter

travel does not exceed fourteen (14) feet, and when in his judgment they may be
moved on rubber tired vehicles or trucks in such a manner as will not substantially
interfere with traffic, damage any street structure or trees, require the
removal of any electric, telephone, or telegraph wires, or damage any street
pavements or sidewalks. Before issuing such a permit the city manager shall
designate the route to be followed and the date and time when such moving shall
take place, and shall supervise the operation of moving thereof.
Section 14. Moving Over Railway Tracks. No permit shall be issued
for the moving of any structures across the tracks of any railway or street
railway until the mover thereof shall have given the superintendent of such
railway or street railway companies not less than twenty--four (24) hours notice
before such crossing of the tracks is to be made and satisfactory arrangements
for such crossing have been made and the city manager advised in detail of i
such arrangements.

Section 16. Permit to Move Issued. When an application has been made
for a moving permit as provided herein and is approved by the city manager, he shall,
after being presented with a receipt for payment of the permit fee by the house
mover to the city clerk, issue to the applicant a permit, in duplicate, numbered
in consecutive order, one copy being furnished the applicant and a record thereo
retained in his office. Such permit shall contain the name and address of the
person, firm or corporation to whom issued, the route to be followed, and the
time of starting and completing the moving operation within public ways, an
abstract of the inRormation and agreements contained in the application, and suc
regulations, conditions, and instructions as the city manager may deem necessa y
to protect public and private property and secure compliance with the provisions
of this ordinance. Such perml shall not take effect, and the work shall not be
commenced until the time therein stated and shall at all times be under the

supervision and control of the city manager or his representative.
Section 17. Revocation of License. Any licensed house mover who
shall, in any application for a permit, make any untrue or false statements, or I
who shall be guilty of violation of this ordinance, or who shall be guilty of acts
of negligence in the conduct of his business, shall upon such finding have his
license revoked by the city council.
Section la. Plaihng Streets. When in the judgment of the city manager
it is necessary to protect streets or street imlrovements, he may require the
house mover to properly and adequately plank such streets and all rollers,
trucks or other devices used in conveying and moving same shall run upon and
rest upon such planks at all times.
Section 19. Permit Fee. The fee to be paid for moving any structure
on, across, or along any street, avenue, alley, or highway in the city shall be
as follows:
(a) $15. 00 for the first day fixed by the permit.
(b) $10. 00 for each day after the first day fixed by the permit.
(c) In case an extension of time is granted beyond the time fixed
by the permit, a fee of $10. 00 for each additional day so grafted.
(d) $5. 00 for a permit issued under the provisions of section 13.
Section 20. Penalty for Violation. Any person, firm, or corporation
who shall engage in the business of house moving without first securing a license
therefor as provided herein, or shall move any structure from one location to
another upon, along, across, over, or near any street, avenue, alley, highway
or sidewalk, or other public ground as provided herein, or otherwise violate the
provisions of this ordinance shall upon conviction be subject to imprisonment not
exceeding thirty (30) days, or to a fine not exceeding one hundred dollars
($100. 00).
Section 21. Repeal. Ordinance nos. 576, 639, and all other ordinances
or parts of ordinances in conflict herewith are hereby repealed.
Section 22. This ordinance shall be in full force and effect from and
after its passage and publication as provided by law.
