HomeMy WebLinkAbout~Master - Establishing Building Lines along a Certain Alley i ORDINANCE NO. 756 ORDINANCE ESTABLISHING BUILDING LINES ALONG THE PROPOSED EXTENSION OF THE ALLEY NOW SITUATED BETWEEN MAIN AND FIFTH STREET FROM CLARK AVENUE WESTWARD TOWARD GRAND AVENUE II IN AMES, IOWA. WHEREAS a proposal of the City Plan Commission that the alley between Main Street and Fifth Street commencing at Clark Avenue be extended westward toward Grand Avenue to the city--owned property adjacent to Grand Avenue, and which said plan ha been approved by the Gity Council, and WHEREAS the said extension is necessary in the interest of public safety in order to serve adequately the property adjacent thereto as the same becomes more widely used for business purposes, and WHEREAS it is the desire of the City Council that such proposed extension be anticipated by now establishing building lines adjacent to the proposed extension of said alley; NOW THEREFOR BE IT ORDAINED by the City Council of the City of Ames, Iowa, as follows: i SECTION 1: Building lines. A building line is hereby established parallel to and ten feet north, and parallel to and ten feet south of the center line of the alley now located between Fifth Street and Main Street, lying west of Clark Avenue, commencing at the west end thereof, and projected westward to city property described as Lot 3, Block 45, Third Addition to Ames, Iowa. SECTION 2: No encroaching construction. No building, structure, or addition thereto shall be erected on land lying between the two building lines established in Section 1 hereof. SECTION 3: Penalty. Any person, firm, or corporation violating any provisions of this ordinance shall upon conviction be fined a sum not exceeding one hundred dollars ($100. 00) and in default of payment thereof shall be committed to the city or county jail for a term of not exceeding thirty (30) days. SECTION 4: Repeal. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. i SECTION 5: That this ordinance shall be in full force and effect from and after its final passage and publication as provided by law.
