ORDINANCE PROVIDING FOR THE COLLECTION, REMOVAL,
AND DISPOSAL OF GARBAGE AND REFUSE, ESTABLISHING
CITY OWNED OR LEASED SANITARY LAND FILL DISPOSAL
AREA, AND FOR THE OPERATION THEREOF, AND REPEAL-
ING ORDINANCE NUMBER 582.
Be It Ordained by the City Council of the City of Ames ,
Iowa, as follows:
SECTION 1: Definitions.
a. The word "garbage" as used in this ordinance
shall be held to include every waste accumulation
of animal, fruit, or vegetable matter , liquid or
otherwise, that attends the preparation, use,
cooking , dealing in or storing of meat, fish,
fowl, fruit or vegetables , and including tin cans
or similar food containers. Dead animals are not
included in the term "garbage."
b. The word "refuse" as used in this ordinance
f shall be held to include all other miscellaneous
{ waste materials not specifically defined as
garbage.
SECTION 2 : It shall be unlawful for any person, firm
or corporation to deposit, throw or place any garbage
in any street alley, lane, public place or private
property outside of buildings , within the City of Ames ,
Iowa, unless the same is enclosed in a watertight
metal receptacle, provided with handles or bales and
a tight-fitting , watertight cover and being of a
capacity not exceeding twenty (203 gallons. Refuse
shall be placed in baskets not larger than #2 , with
handles. Newspapers shall be bundled and tied.
SECTION : It shall be the duty of any person, firm
or corporation using or maintaining the said receptacle
for the purposes above mentioned to cause the same to
be emptied of its contents before it is so full that
the cover will no longer fit tightly.
SECTION 4: That the proper receptacle for the receiving
and holding of garbage shall be furnished by the house-
holder or the occupant of any building or place of
business and shall be kept covered and in a sanitary
condition at all times; that said garbage shall be wrapped,
when placed in said receptacle.
SECTION 5: That all garbage, whenever practical, shall
be delivered by the householder or the occupant of any
building or place of business to the ground level for
collection, and that said receptacle therefore must be
kept in a location convenient for collection.
SECTION 6: It shall be unlawful for any person, firs
or corporation to deposit, throw or place any refuse in
any street, alley, lane public place or private property
outside of buildings , within the City of Ames , Iowa, unless
the same is to be hauled away and, pending hauling, is
kept in such a manner as in no way to constitute a
nuisance or annoyance to others.
SECTION : That any garbage or refuse may be
disposed of by householders or the occupant of any
building or place of business in any of the following
manners:
a. By delivery to a licensed garbage collector,
b. By incineration of refuse in such manner as
in no way to constitute a nuisance or annoyance
to others.
c. By hauling to the city operated land fill
disposal area, and dumping there as directed by
custodian in charge, provided the containers and
vehicle used in transportation conform to the
requirements of Section 9 hereinafter set forth,.
SECTION_ 8: It shall be unlawful for any person, firm
or corporation to collect garbage and/or refuse within
the City of Ames, Iowa, without first obtaining a
license from the City of Ames.
SECTION L. Application for a license to collect
garbage and/or refuse shall be made at the office of
the City Clerk on forms provided by said office. The
applicant shall file with his application the required
insurance policy and pay a fee of $5.00 for each
vehicle. Upon receipt of the application, the City
Manager or his agent shall ascertain whether the said
applicant, his equipment, and his expected manner of
collection comply with the following requirements :
a. Applicant shall present for filing with the
City Clerk, a policy of insurance in limits not
less than $10,000 — $20,000 bodily injury and
$5,000 property damage and shall keep such policy
in force during the duration of his license.
b. The body of the truck shall at all times be
kept covered with an adequate wooden cover or
canvas cover with eyelets and rope for tying
down, and shall be kept in a sanitary condition.
c. The truck to be used shall be so constructed
as to prevent leakage during transit.
d. The loading shall be done in such a wanner as
to prevent spilling or loss of contents.
e. Collection of garbage from hotels , restaurants9
clubs and large boarding houses , and other places
of like character where considerable garbage is
produced daily shall be made on each week day.
f. Collection from private residences shall be
made not less than three times per week from May
1st to November 1st and not less than twice a
week from November Ist to May 1st.
g. A pickup service shall be maintained to
promptly service all complaints on missed col—
lections and improper handling.
h. Garbage and refuse collected shall be hauled
to Sanitary Land Fill Disposal site where trucks
shall be unloaded under the direction of area
custodian. The schedule of operation shall be
determined by the City Manager.
i. If the applicant meets the foregoing require-
ments as to equipment and method of operation,
the City Manager shall indicate his approval on
the application, and the Clerk shall then issue
the license effective to December 31st. There—
after in December a license shall be obtained and ,
a fee of $5.00 for each vehicle paid, on an annual
basis , January 1st to December 31st.
J . Equipment and method of operation shall be
subject to periodic inspection by the custodian
of the disposal site. Any license may be revoked
by the City Council, upon recommendation of said
custodian or the City Manager , for failure to
observe these regulations.
SECTION 10: There is hereby established a sanitary
land fill area, at such place or places as the City
Council upon the recommendation of the City Manager
may direct, where all garbage and refuse shall be dump di
and it shall be unlawful to dump such material in any
other place. The operation, management, supervision,
and inspection of the area shall be under the juris—
diction of the City Manager. To more effectively
control the operation, the custodian of the area may
be named as a special police officer or deputy sheriff,
He shall not, however, be eligible to participate in
the Health and Retirement program of the Police Depart-
ment.
SECTION 11: That the City of Ames , Iowa, may enter
into a contract with any licenseholder for the collection
of garbage and/or refuse within the City or may itself
maintain a service for the collection of garbage and/m
refuse within said City.
SECTION 12: Any person, firm or corporation violating
any provisions of this ordinance shall upon conviction
be fined a sum not exceeding one hundred dollars , and
in default of payment thereof shall be committed to
the City or County jail for a term of not exceeding
thirty days.
SECTION lam, All ordinances or parts of ordinances t
including Ordinance #582 , in conflict with the provisions
of this ordinance are hereby repealed.
SECTION li+: This ordinance shall be in full force and
effect from and after passage and publication as pro—
vided by law,
