HomeMy WebLinkAbout~Master - Amending Section Five of Ordinance 555 ORDINANCE NOa 64o AN ORDINANCE AMENDING ORDINANCE NO. 555 OF THE CITY ORDINANCES OF THE CITY OF AMES, IOWA, PARTICULARLY SECTION 5 OF SAID ORDINANCE NO. 555 Be It Ordained by the City Council of the City of Ames, Iowa: Section to That Section 5 of Ordinance No. 555 of the City Ordinances of the City of Ames, Iowa, is hereby specifically re- pealed and the following shall be hereinafter known as Section 5 of Ordinance No. 555: "Section 5. Requirements for cuts in pavement surfaces or street surfaces. Before issuing a permit for cut- ting into or through a pavement surface or street surface, the City Manager shall require the person, firm or corporation making application for such permit to make a cash payment to the City Clerk in sufficient amount to reimburse the City for all costs and expense for work done or to be done by the City in connection with such permit and the increased maintenance cost of the pavement surfaces or street surfaces due to such work. The payments required shall be based on the follow- ing schedule of charges : (a) For cuts in or through a pavement surface in place one (1) ,year or less, Two Dollars ($2.00) per square foot of surface cut, with a minimum charge of Twenty-five Dollars ($25000) . (b) For cuts in or throgh a pavement sur- face in place more than one (1) ,year, One Dollar ($1.00) per square foot of surface cut, with a minimum charge of Five Dollars ($5.00) . (c) For cuts in or throw h stabilized gravel street surfaces, thirty cents 1300) per square foot of surface cut, with a minimum charge of Two Dollars ($2.00) . The City Manager shall, in addition to the above charges, require the person, firm or corporation doing such work to file with the City Clerk a good and suffi- cient bond in the amount of $1,000.00 as to property damage and $10,000.00 as to personal injury, with sureties thereon to be approved by the Clerk, conditioned that the said person, firm or corporation will pay any or all damages incurred as a consequence of granting such permit which may be caused to either person or proper y, public or private, within the City of Ames whether such damage or injury shall be inflicted by said person, firm or corporation, his agent or employees, and also condi- tioned that said person, firm or corporation will waive and indemnify and hold the City of Ames harmless against all liability, judgments, costs and expenses which may in any wise accrue against said City arising from or occasioned by work performed under the terms of said permit. " Section 2. All ordinances or parts of ordinances in conflict with the provisions of this amendment are hereby repealed. Section 3. This amendment to Ordinance No. 555 of the City Ordinances of the City of Ames, Iowa, shall be in force and effect from and after its passage and publication as provided by law.
