t � ORDINANCE NO. p AN ORDINANCE REGULATING TRAFFIC AND PARKING UPON Tr_"3 S TR1.',;TS, AV 11MU S, ALLEYS AND PUBLIC PLACES OF THE CITY OF A"FES; REPEALING ALL ORDINANCES IN REFERENCE THERETO, AND PROVIDING P; TIALTIES FOR A VIOLATION OF ITS PROVISIONS. Be it Ordained by the City Council of the City of Ames, Io?raa. DEFINITIONS: Section 1. The following =rds and phrases when used in this Ordinance shall, for the purpose of this Ordinance, have the meaning respectively ascribed to them; (a) Vehicle means every device in, upon, or by which any person or property is or may be transported or dra,:rn upon a highi%ray, excepting devices moved by human power or used exclusively upon stationary rails or tracks.. (b) Tlotor Vehicle meats every vehicle which is self-propelled and every vehicle which is propelled by electric power obtained from overhead trolley wires, but not operated upon rails. The terms car or auto- mobile shall be synonymous with the term motor vehicle. (c) Farm Tractor means every motor vehicle designed and used primarily • as a farm implement for dra-•;ing plows, moving machines, and other implements of husbandry. (d) Road Tractor means every motor vehicle designed and used for drawing other vehicles not so constructed as to carry any load thereon either independently or any part of the weight of a vehicle or load so drawr_- (e) Trailer means every vehicle without motive power designed for carry- ing persons or property and for being drawn by a motor vehicle and so constructed that no part of its weight rests upon the towing vehicle. 1 (f) Semitrailer means every vehicle without motive power designed for carrying persons or property and for being drawn by a motor vehicle and so constructed that some part of its vreight and that of its load rests upon or is carried by another vehicle. Wherever the word "trailer" is used in this Ordinance same shall be construed to also include "semi-trailer." A "semi-trailer" shall be considered in this Ordinance separate- ly from its power unit. (g) Special TMobile Equipment means every vehicle not designed or used • primarily for the -transportation of persons or property and incident- ally operated or moved over the streets, including road construction or maintenance machinery, ditch-digging apparatus and well-boring apparatus. The foregoing enumeration shall be deemed partial and shall not operate to exclude other such vehicles which are within the general terms of this paragraph. (h) Authorized Emergency Vehicle means vehicles of the fire department, police vehicles, and such ambulances and emergency vehicles of the municipal departments as are designated or authorized blr the City. i (k) Operator or Driver means every person who is in actual physical control of a ads vehicle upon a street. (j) Police Officer means every officer authorized to direct or regulate traffic or to make arrests for violations of traffic regulations: (k) Pedestrian means any person afoot. (1), Street or Highway means the entire width between property lines of every way or place of whatever nature when any part thereof is open - 2 - to the use of the public, as a matter of right, for purposes of Vehicular traffic. (m) Private Road or Driveway means every way or place in private ownership and used for vehicular travel by the owner and those having express or implied permission from the owner but not by other persons. (n) Roadway means that portion of a street improved, designed, o,- ordin- arily used for vehicular travel. (o) Sidewalk means that portion of a street between the curb lines, or • the lateral lines of a roadway, and the adjacent property lines intended for the use of pedestrians. (p) Laned Highway means a highway the roadway of which is divided into three or more clearly marked lanes for vehicular traffic. (q) Through (or thru) Highway means every highway or portion thereof at the entrances to which vehicular traffic from intersecting highways is required by law to stop before entering or crossing the same and • when stop signs are erected or such entrances are controlled by a police officer or traffic-control signal. The term "arterial" shall be synonymous with "through" or "thru" when used in this Ordinance, (r) Intersections mean the area embraced within the prolongation or coj- nection of the lateral curb lines, or, if none, then the lateral boundary lines of the roadways of the two streets which join one a another at, or approximately at, right angles, or the area within which vehicles traveling upon different streets joining at any other ang].2 may come in conflict. (s) Business District means the territory contiguous to and including 3 t a street when fifty per cent or more of the frontage thereon for a distance of three hundred feet or more is occupied by buildings in use for business. (t) Residence District means the territory contiguous to and including a street not comprising a business district or a school district, (u) School District means the territory contiguous to and includi:rng a street for a distance of two hundred feet in either direction from a school house. (v) Official traffic-control Signal or Devices mean all signs, signals, markings, and devices not inconsistent with this Ordinance placed or erected by authority of a public body or official having jurisdiction, for the purpose of regulating, warning, or guiding traffic. (w) Right-of-Way means the privilege of the immediate use of the street. (x) Parked Vehicle. The term "parked" shall apply to any vehicle which • is stopped in a street, whether occupied or not. (y) Line of Street. Where the "line of a street" is referred to it shall mean the lot line, as distinguished from the curb line. SPEED AND TRAFFIC REGULATIONS Section 2. Speed Restrictions. Any person driving a motor vehicle on a streo-;, shall drive the same at a careful and prudent speed not greater than nor .less than is reasonable and proper, having due regard to the traffic, surface and width of the highway and of any other conditions then exist•- ing, and no person shall drive any vehicle upon a street at a speed gre,-- ;eo - 4 - than will permit him to bring it to a stop within the assured clear distance ahead, such driver having the right to assume, however, that all persons using said street will observe the law. The following shall be the lawful speed except as hereinbefore or hereinafter modified, and any speed in excess thereof shall be unlawful 1. Twenty miles per hour in any business or school district. 2. Twenty-fivo miles per hour in any residence distric'c.. 3. Thirty-five miles per hour for any motor vehicle drawin't- another vehicle. 4. Fifteen miles per hour in any public park or cemetery.. 'VSection 3. Special Speed Limit Districts. The following "Special Speed Limit Districts" within the City of Ames,, Iowa are hereby established and any speed in excess of thirty-five miles per hour within such districts shall be unlawful (a)*inln V1 y b tween the west corporate limits and the Trostline of (b) Lincoln yVay between the east line of Beech Avenue and the west line of Riverside Drive. • (c) Lincoln Way between the east line of "E" Avenue South and the east corporate limits. (d) South Duff Avenue between the south corporate limits and the south line of South Third Street. (e) Grand Avenue between the north corporate limits and the north line of 13th Street. Section 4. Speed Signs - Installation. The signs erected by the State Highway Commission on the primary roads and extensions of primary roads within the City shall show and determine the point at which the rate of speed changes and the maximum rate of speed permissible - 5 - :sv in the district, which the vehicle is entering. Section 5. Minimum Speed Regulations. No person shall drive a motor vehicle at such a slow speed as to impede or block the normal and reasonable movement of traffic except when reduced speed is necessary for safe operation or in compliance with law. Section 6. Fire Trucks and Police Vehicles. The speed limits established in the preceding sections shall not apply to fire trucks or to police cars or other authorized emergency vehicles, while engaged in the performance of public duties. Such vehicles shall have the right • of way at all times over all other vehicles. Upon signal by siren, whistle, claxon, horn or the ringing of a bell, given from a fire truck or police vehicle or authorized emergency vehicle, it shall be the duty of the drivers or operators of all other vehicles on the street to drxa up to the right hand curb as nearly as possible, and in no event to enter an alley or cross an intersection ahead of said emergency vehicle, PARKING REGULATIONS • Section 7. Method of Parking Vehicles. Except as hereinafter provided, where parking is permitted, vehicles shall be parked parallel to t',e curb, headed in the direction of the traffic on that side of the street, with the right hand wheels of the same not more than eighteen. 4cupi inches from the curb, (and not placed closer than-;i;;_ Afeet from another vehicle. Y Section B. Diagonal Parking Districts. All vehicles parked in the follow- ing specified districts shall be parked diagonal with the right h2md front wheel not more than twelve inches from the curb* (a) Main Street from Duf.' Air-n,ie to venue. I (b) Fifth Street from Carroll Avenue to Duff Avenue. (0) West side of Kellogg from the alley south of the Chicago & Northwestern Railway right of way to Lincoln Way. (d) West side of Hayward Avenue from the south line of Lincoln 'Nay to the north line of Chamberlain Street. Section 9. Parking Long Vehicles, No part of any vehicle parked within a diagonal parking district shall extend into the roadway more than a distance of sixteen feet when measured at right angles to the adjacent curb. Section 10. Right Angle -Parking. Upon that portion of Burnett Avenue south of Main Street, parking shall be at right angles to the curb. Section 11. Stalls and Sections. mere now or hereafter stalls or sections may be marked or painted upon any street or portion thereof, it shall be the duty of the driver or operator of any vehicle to park the same within one of the said stalls or sections and not over or across said lines. • Section 12. Double Parking. Double parking is p g prohibited upon all streets except in an emergency and not for more than five minutes at a dine, and then only if an operator, capable of moving the vehicle, remains therein. Such operator shall at once, on direction of an..officer cr at the request of any person with whom such parking interferes, move said vehicle. Section 13. Limited Parking--Ninety Minutes. The parking of vehicles on all week days, except Saturday, between the hours of 8.:00 o'clock A ji , and 6s00 o'clock P.M. and on Saturdays between the hours of 8:00 otr-I.ek A.M. and 9:00 o'clock F.I.I. shall be limited to ninety (90) min.u- eS in the following place3) (7� (a) I.lain Street from (b) South side of Fifthfg Avenue to Burnett Avenue. (v) Within the limits of the streets designated herein as "bus stations" except to take on or discharge passengers; - 9 «. 1. On the west side of Welch Avenue for the distance cf twenty-five feet south of the south line of L�-ncoln Way. rr%} 'Ifithin ten feet of any "Stop" sign erected on a through highway or elsewhere as provided herein. • Soction 16. Police Reservation. The forty feet on the east side of Kellogg Avenue - and adjacent; t th6 City Hall, is hereby reserved and set aside for the motor cf the Police Department. All other vehicles are prohibited from &L err time parking in said space, or from interfering with the use of sail space by the said Police Department. Section 17. Taxi Stands. Such portions of the parking space on the . side of Main Street, between Kellogg Avenue and Burnett Avenue, as m,.y be necessary for taxi stand, is hereby set aside and reserved for such purposes. Each taxi license A�have space for one vehicle. Such space ,jVbe assigned and set aside by the City manager. When so assigned and marked by standards, or signs, it shall be unlawful for any person other than the licensee to park vehicles therein, or to interfere therewith. Section 18. Notice to be Given. Then, hereafter, parking stations, speed limit districts, or other traffic regulatinns or control districts, are established, clanged, regulated, or annulled and an appropriate notice of the action given by a sign or standard at the place affected, it shall be the duty of all persons to comply therewith. - 10 - THROUGH HIGHWAY'S and SPECIAL STOPS Section 19. Through Highways. The following streets within the City of Ames, Iola are hereby designated and established as through highways, and every operator of a vehicle shall bring such vehicle to a full stop at the stop sign or at a clearly marked stop line before entering such through high- way except when directed to proceed by a police officer or traffic control signal? (a) Grand Avenue from the north corporate limits to its intersection with Lincoln 'Pay. (b) Lincoln 'say from the east to west corporate limits. ® (c) South Duff Avenue from the south corporate limits to its intersection with Lincoln ?iiay. (d) Ninth Street from the east line of Carroll Avenue to the west line of Ridgewood rivenue o Section 20. Intersecting Through Highways. At the intersections of through hig1vrays all traffic on the highway or street as designated below shall come to a full stop at the stop sign or at a clearly marked stop line before entering the intersection except when directed to pro- ceed by a police officer or traffic control device) Grand Avenue and Ninth Street. Traffic on Ninth Street to stop before entering Grand Avenue. C�) zoi Lincoln 'ray and South Duff Avenue. Traffic on South Duff Avenue to stop before entering Lincoln Way. v Section 21. School Zones. (e) Grand Avenue at Ninth Street - Grand Avenue intersection. - 11 - Section 22. Obedience to Signal of Train. 'Plhenever any person driving a vehicle approaches a railroad grade crossing and warning is given by automatic signal or crossing gates or a flagman or otherwise of the ' Sid vehicle immediate approach of a train, the driver czl oft i shall stop^ within fifty feet but not less than ten feet from the nearest track- of such railroad and shall not proceed until he can do so safely. The driver of a vehicle shall stop said vehicle and cause same to remain standing and not traverse such a grade crossing •:vhen a crossing gate is lowered or when a human flagman gives or continues to give a • signal of the approach or passage of a train ONE ,,',TAY ALLEYS Section 23. (b) Alley immediately south of Blocks thirteen and fourteen, Original Town of Ames - enter from the west only. CONTROL AND DRIVING OF VEHICLES Section 24. Control of Vehicle. The person operating a motor vehicle or motorcycle shall have the same under control and shall reduce the speed to a reasonable and proper rate; ote R"&,rvq M W_' e, 1. Turning at Intersections. The driver of a vehicle intending to turn at an intersection shall do so as follows: Both the approach for a right turn and right turn shall be made as close as practical to the right-land curb or edge of the roadway. Approach for a left turn shall be made in that portion of the right half of the roadway nearest the center line thereof and after entering the intersection the left turn shall be made so as to depart from the intersection to the right of the center line of -mho • roadway being entered. Approach for a left turn from a two-way street into a street shall be made in that portion of the right half of the rr)'.dtimr nearest the center line thereof and by passing to the right of sucks center line where it enters the intersection. Signal Continuous. A signal of intention to turn right or .deft shall be given continuously during not less than one hundred feet traveled by the vehicle before turning. --- V , Section 27. Stopping. No person shall stop or suddenly decrease the speed of a vehicle without first giving an appropriate signal in the manner provided herein to the driver of any vehicle immediately to the rear when there is opportunity to give such signal. Section 28. Signals by Hand and Arm or Signal Device. Section 33. Passing at Intersection. No motor vehicle shall overtake and pass another vehicle at a street intersection. Section 34. Failure to Recognize Signal. Any driver of a vehicle that is overtaken by a faster moving vehicle who fails to heed the signal of the overtaking vehicle when it is given under such circumstances that he could, by exercise of ordinary care and observation and precaution. • hear such signal and who fails to yield that part of the traveled 7iray as herein provided, shall be guilty of a misdemeanor. The driver of a vehicle may overtake and pass upor. the right of another vehicle which is making or about to make a left turn. The driver of a vehicle may overtake and, allowing sufficient clearance, pass another vehicle proceeding in the same direction either upon the left or upon the right on a roadlmuy with unobstructed pavement of sufficient width for four or more lines of moving traffic whet, such movement can be made in safety. No person shall drive off the pave- ment or upon the shoulder of the roadvray in overtaking or passing on the right. V Section 36. Limitations on Overtaking on the Left. No vehicle shall be driven on the left side of the center of the roadway in overtaking and. passing another vehicle proceeding in the same direction unless such 15 - left side is clearly visible and is free fron oncoming traffic for sufficient distance ahead to permit such overtaking and passing to be completely made without interfering with the safe operation of any vehicle approaching from the opposite direction or any vehicle over- taken. In every event the overtaking vehicle must return to the right hand side of the roadway before coming within one hundred feet of any vehicle approaching from thc: opposite direction. v�J Section 37. Ro-A-Nays Lanod for Traffic. Whenever an,;• roadway has been divided into three or more clearly marked lanes for traffic �M the following rules in addVAon to all others consistent herewith shall apply: A vehicle shell be driven as nearly as practical entirely within a single lane and shall not be moved from such lane until the driver has first ascertained, that such movement can be made with safety. Upon a roadway which is divided into three lanes a vehicle shall not be driven in the center lane except when overtaking and passing another vehicle where the roadway is clearly visible and such center lane is clear of traffic within a safe distance, or in prepar- ation for a left turn where such center lane is at the time allocated exclusively to traffic moving in the direction the vehicle is proceed- ing and is sign-posted to give notice 'of such allocation. Section 38. Following too closely. The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicles and the traffic upon and the condition of the street. Section 39. Driving 'Through Procession. o motor or otlior vehicle shall be 16 - driven through a funeral procession or parade without the permission of a police or traffic officer. Section 40. Vehicles 77ith P;fetal Tires or Treads. No person shall operate or move on any street any motor vehicle, trailer, farm tractor, or road tractor havin-, any metal tire in contact ;,rich the roadway. No tire on a vehicle moved on a street shall have on its periphery any block, stud, flange, cleat, or spike or any other protuberances of any material other than rubber vrhich projects beyond the tread of the traction surface of the tire, except that it shall be permissible to use farm machinery with tires having protuberances which will not injure the highway, and except also that it shall be permissibl- to use tiro chains of reasonable proportions upon any vehicle wher. ron?; .x•ed for safety because of snow, ice, or other conditions tending •,-o ease a vehicle to skid. The City Manager may, at his discretion, issue special perm ;;s authorizing the operation upon the street of traction engines or tractors h,-:ving movable tracks with traverse corrugations upon the periphery of such movable tracks or farm tractors or other machinery, the operation of ,°rhich upon a street would otherwise be prohibited under this section. Section 41. Bicycles or Animal-Drarm Vehicles. Every person riding a bicycle or an animal or driving any animal drawing a vehicle upon a roadway shall be subject to the provisions of this Ordinance applicable to the driver of a vehicle, except those provisions of this Ordinance which by their nature can have no application. i Section 42. "U" Turns. Vehicles are hereby prohibited from making a complete or "U" turn within the limits of the following designated - 17 street intersections. (a) Douglas Avenue and Main Street. r (b) 'Cellogg Avenue and Main Street. (c) Burnett Avenue and Main Street. • f. (d) Welch Avenue and Lincoln Way. (c) Duff Avenue and LincolnWay. Section 43. Obstruction to Driver's View, No person shall drive a vehicle when it is so loaded, or when there are in the front seat such number of persons, exceeding three, as to obstruct the view of the driver to the front or sides of the vehicle or as to interfere with the driver's control over the driving mechanism of the vehicle,, No passenger in a vehicle shall ride in such position as to interfere with the driver's view ahead or to the sides, or to fore with his control over the dri-Ting mechanism of the vehicle, RIGHT OF WAY Section 44. Approaching or Entering Intersections. The driver of a vehicle approaching an intersection shall yield the right of ,�ray to • --� a vehicle which has entered the intersection from a different�ipeeet- �hreee�s When two vehicles enter an intersection from different at the same time the driver of the vehicle on the left shall yield the right of way to the vehicle on the right. The foregoing rules are modified at through highways and otherwise as hereafter stated in this' Ordinanco. Section 45. Turning Left at Intersection. The driver of a vehicle within an intersection intending to turn to the left shall yield the right of vvaz> to any vehicle approaching from the opposite direction which is within the intersection or so close thereto as to constitute an immediate l8 hazard, but said driver, having so yielded and having given a signal when and as required by this Ordinance, may make such left turn and the drivers of all other vehicles approaching the intersection from said opposite direction shall yield the right of way to the vehicle making the left turn. 5 Section 46. Entering Through Highways. The driver of vehicle shall stop as required by this Ordinance at the entrance to a through highway and shall yield the right of ?•ray to other vehicles which have entered the intersection from said through highvray or which are approaching so closely on said through highway as to constitute a hazard, but said driver having so yielded may proceed cautiously and with due care enter said through highway. Section 47. Entering Stop Intersection. The driver of a vehicle shall 144R-t1.w stop in obedience to a stop sign as required herein at an intersection where a stop sign is erected at one or more entrances thereto although not a part of a through highway and shall proceed cautiously, yielding to vehicles not so obliged to stop which are ;rithin the intersection or approaching so closely as to constitute a hazard, but may then proceed. Section 48; Emerging from an Alley or Private Driveway. The driver of a vehidlo�within a business or residence district emerging from an alley, driveway, or building shall stop such vehicle inmediately prior to driving onto a sidewalk or into the sidewalk area extend- ing across any alley-way or private drivevray. Section 49. Entering from Private Drivevray. The driver of a vehicle about to enter or cross a street from a private road, drive-;ray, or building shall yield the right of vray to all vehicles approaching on said stree=c.b 19 Section 50. Operation on Approach of Emergency Vehicles. Upon the im- mediate approach of an authorized emergency vehicle, ahon the driver is giving an audible signal by siren, exhaustwhistlo, or bell, the driver of every other vehicle shall yield the right of vray and shall immediately drive to a position parallel to, and as close as possible to, the the right hand edge or curb of the -may clear of any inter- section and shall stop and remain in such position until the authorized emergency vehicle has passed, except when othonrise directed by a police officer. This 'section shall not operate to relieve the driver of an authorized emergency vehi,;lo from the duty to drive with due regard Sf►aeef for the safety of all persons using the lsti�. V/ PEDESTRIANS RIGHTS AND DUTIES Section 51. Podestrians' Right of ;lay. Whore traffic control signals are in operation at any pl«ce not an intersection pedestrians shall not cross at any place except in a marked crossvralk. Section 53. Duty of the Driver. Not,:rithstanding the provisions of the preceding section$,every driver of a vehicle shall exercise due - 20 - care to avoid colliding -with any pedestrian upon any roadway and shall give warning by sounding the horn whon necessary and shall exercise due care upon observing any child or any confused or in capacitated person upon a roadvmy. Section 54. Pedestrians Soliciting Rides. No person shall stand in a roadway for the purpose of soliciting a ride from the driver of any private vehicle. Nothing in this section or this Ordinance shall be construed • so as to prevent any pedestrian from standing on that portion of the street or roadway, not ordinarily used for vehiculc.r traffic for the purpose of soliciting a rido from the driver of any vehicle. Section 55. Walk on Left. Pedestrians shall at all times when walking on or along a street, yralk on the loft side of such highway. ACCIDrNT REPORTS Section 56. Reporting Accidents. The driver of a vehicle involved in an accident resulting in injury to or death of any person or total • property damage to an apparent extent of twenty-five dollars or more shall, immediately after such accident, report the accident, together with the said information, at the office of some peace officer as near as practicable to the place of injury or to the county attorney or sheriff of the County in which said injury took place. The parent or personal guardian of a minor driver may, if present at the accident, make the report required by this section. VEHICLE and BICYCLE EQUIPAENT Section 57, Vehicle Equipment Required. It shall be unlawful for any person to operate a vehicle upon the streets f the City of Ames, - 21 - unless the equipment thereon conforms to the requirements of Sections 407 to 474 inclusive of Chapter 134 Laws of the Forty-Seventh General Assembly. Section 58, "Acycle Equipment required. Every bicycle shall be equipped with a lamp on the front exhibiting a white light visible from a distance of at least three hundred feet to the front and with a larip on the roar exhibiting a red light visible from a distance of three hundred feet to the rear at the times specified in Section 409 Chapter 134 Acts of the Forty-Seventh General Assembly; except that a red reflector meeting the requirements of Chapter 134 Acts of the Forty-Seventh General Assembly may be used in lieu of a rear lamp. OBEDIENCE TO POLICE OFFICERS AND SIGNS Section 59, Obedience to Police Officers* No person shall wilfully fail or refuse to comply with any lawful order or direction of any Peace officer invested by law with authority to directs control, or regulate traffic. Section CO. Stoppino Vehicle on Signal by Officer* Operators of rotor vehicles upon the streets of the City shall* upon signal of traffic or police officer* immediately drive the same up to the nearest curb or at the side of street and bring the same to stops there to await the communication, orders or directions of such. officer. The fact, if established* that the operator had committed no offense for which he was subject to arrest shall not constitute a defense to a prosecution under this section. Section 61# Interference with Signs. It shall be unlawful for any person to removet destroy, deface or Interfere, with any parking sign or standard, placed or erected under the authority of this Ordinance or order bf the City Council, or for .any. person to place or erect any such sign on any street of the City rrhich has not boon authorized by the City Council. Section 62. Unauthorized Signs, Signals, or Markings. No person shall place, maintain, or display upon or in viej of any street any unauthorized sign, signal, marh:ing, or device -which purports to be or is an irrita- tion of or resembles an official pli-rking sign, curb or other ;:r,rking, traffic--control device or railroad sign or signal, or which attempts to direct the movement of traffic, or -which hides from vier; or inter- . feros -with tho effective ess of any official tr,:ffic-control device or any r�.ilroad sign or signal, and no person shall place or maintain upon any street any traffic sign or signal bearing thereon any com- mercial a-3_vertising. This shall not be doei7od to prohibit the erection upon private property adjacent to highzr:ys of signs giving useful directional information of a typo that cannot be mistaken for official signs. NIISCEII:-11TEOUS REGULATIONS • Section 63. Trucks and Drays Loading and Unloading Upon Ilain Street. From 8:00 o'clock A.Mi. to 10:00 o'clock P.M. upon Main Street between Duff Avenue and Burnett Avenue, trucks and drays are prohibited from loading and unloading freight, goods and merchandise, at all places, stores and buildings -where it is feasible or possible the to perform such -work in/adjacent alley. Section 64. Unattended Notor Vehicle. No person driving or in charge of a motor vehicle shall permit it to stand unattended without first stopping the engine, or when standing upon any perceptible grade -without effectively setting the brake thereon and turning the ' ., 23 _ front wheels to the curb or side of the highway. Section 65. Moving Other Vehicles. No person shall move a vehicle not owned by such person into any prohibited parking area or away from a curb such distance as is unlawful. Section 66. Following Fire Apparatus. The driver of any vehicle other than one on official business shall not follow any fire apparatus traveling in response to a fire alarm closer than five hundred feet or drive into or park such vehicle within the block �,rhere fire apparatus has • stepped in answer to EL fire alarm. Section 67. Crossing Fire Hose. No vehicle shall be driven over any un- protected hose of a Fire Department when laid dorm on any sire , private driveway, or street car track, to be used at any fir-- Ci' alarm of fire, without the consent of the Fire Department official in co.-,Mand, Section 68. Putting Glass, etc., on Highway. No person shall throw or deposit upon any street or roadway any glass bottle, glass, nails, tacks, wire, cans, or any other substance likely to injure any • person, animal, or vehicle upon such street. Section 69. Removing Injurious material. Any person who drops, or permits to be dropped or thrown, upon any street any destructive or injurious material shall immediately remove the same or cause it to be removed. Section 70. Clearing Up Wreck. Any person removing a wrecked or damaged vehicle from a street shall remove any glass or other injurious sub- stance dropped upon the street from such vehicle. Section 71. Operating a Vehicle 'Mnile Intoxicated. No person shall operate a vehicle upon the streets of the City ,chile intoxicated, or under the 2,11 - influence of intoxicating liquor. k Section 72. Any person violating any of the provisions of this Ordinance shall, upon conviction, be fined a sum not exceeding one hundred dollars and costs, and in default of payment be committed to the City or County jail until such fine and costs are paid not exceeding thirty days, or with or withoutafine a jail sentence may be imposed not exceeding the said thirty days. • Section 73. Ordinances No. Ts 418,437,444, 454, and 464 and all other Ordinances or parts thereof in conflict herowith arc by this Ordinance repealed and superseded,- Section 74. If any section, sentence or clause of this Ordinance is for any held reason/to be unconstitutional or invalid such decision shall not affect the validity of the remaining portions of this Ordinance.
