TO --. THE HONORABLE W. L. ALLAN, Mayor of the City of Ames, Iona=
Pursuant to Section 6132 of the 1935 Code of Iowa, the undersigned
residents and qualified electors of Ames, Iowa, and owners of property
In the voting precinct set opposite their respective names, do hereby
petition you to call a special election of the qualified voters of the
City of Asses, Iowa, said electiom to be held on or before the sixteenth
day of July, 193 and to submit to them at said election the following
question or public measure:
"Shall the Iowa Electric Light & Power Company, of Cedar Rapids,
Iowa, its successors and assigns, be granted the right, privilege and
franchise to establish, construct and maintain a gas works, including
buildings, tanks, reservoirs and machinery and to manufacture and sell
gas for power, light, fuel, heat and other purposes and to continue to
maintain and to lay and maintain gas pipes, lines and conduits in the
public streets, avenues, alleys and public grounds in the City of Ames,
Iowa, and to continue to furnish and sell gas by means thereof to the
inhabitants of said City for a period of twenty-five years -. said
franchise to be governed by the laws of the State of Iowa, and in accord-
ance with the following proposed ordinance, which ordinance shall be a
part of this question or public measure?
aRDINANCE
AN ORDINANCE GRANTING TO THE IOWA ELECTRIC LIGHT AND POWER COMPANY,
A CORPORATION WITH ITS PRINCIPAL PLACE OV BUSINESS AT CEDAR RAPIDS, IOWA,
AND TO ITS SUCCESSORS OR ASSIGNS, AND AS THE SUCCESSORS OF EDNARD G.
PRATT AND HIS ASSIGNS, A RENENAL OR EXTENSION OF THE RIGHT, PRIVILIGE
AND FRANCHISE TO ESTABLISH, CONSTRUCT AND MAINTAIN A GAS WORKS, INCLUDING
THE BUILDINGS, TANKS, RESERVOIRS, AND MACHINERY, AND TO MANUFACTURE AND
SELL, GAS FOR POWER, LIGHT, FUEL, MOAT, AND OTHER PURPOSES, AND TO COIT-
TINUE TO MAINTAIN AND TO LAY AND MAINTAIN GAS MAINS, PIPE LINES AND
CONDUITS IN THE PUBLIC STREETS, AVENUES, ALLEYS AND PUBLIC GROUNDS IN
THE CITY OF AMES, IOWA, AND TO FURNISH, DISTRIBUTE AND SELL GAS AND
DEFINING ITS RIGHTS, POWERS AND DUTI : AND GIVING THE CITY OF AMES, IOWA,
THE POWER TO IFIr THE RATES TO BE CHARGED FOR GAS, TO ESTABLISH THE
QUALITY OF GAS AND TO REGULATE THE SERVICE TO BE FtWTISHED BY THE GRANTEE
TO THE INHABITANT'S OR THE CITY OF AMES, IONA, AND TO PROHIBIT DISCRIM-
INATION IN RAMS 13ETWM THE INHABITANTS OF SAID CITY.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF AMES, IOWA:
Section 1.
That in consideration of the benefits herein expressed and subject
to the torus and conditions prescribed in this Ordinance, the Iowa
Electric Z"Ight and Power Co. , a corporation organised and existing under
and by virtue of the A,aws of the State of Iowa, and with its principal
placer of business at Cedar Rapids, Iowa, and to its successors or assigns,
and which company is hereinafter referred to and designated as "Grantee"
is hereby authorized and empowered, and as sugceesor and assign of Edward
G. Pratt and his assigns, to continue to m4t4tain and grant its right,
power and privilege to establish, maintain and operate a gas

works in said City, and to continue to maintain and lay, construct, ac-
quire, operate and maintain ae, system of maims, pipes, oandui*t+r and feeders
and necessary aiapurtenan es for the manufacture of gas and for the Maur-

Section 2.
Sucsh gas mains and services pipes shall be so laid as not to inter-
f0re with or obstruct the drainage, of said City or the construction of
sewer or underground fixtures for the con:voyance of water or electricity
or the necessary and proper use of said streets, avenues, allays and
public plasma.
Such gas mains and service pipes shall be laid under the super-
vision of the City Manager and in the event of a dispute as between
the said Manager and the grantee, the same shall be referred to the
City Council for final determination.
That the grantee herein, or its successors or assigns, shell not
excavate in any street or make any pavement cut r the purpose of
changing. repairing or laying any mains until a permit has been issued
therefor by thee. #city of Ames, Iowa,, through the office of the City
Manager, and then only, upon such terms a►n& conditions as the City, may
prescribe :and as shall hold the said City of Ames, Iowa harmless from
any coo t or expense.
The City of .Ames, Iowa, shall have the right to require the
grantee to remove at its own cost and expense any gas main or service
pipe which interferes with or obstructs the construction, renonstrue-
tion or repair of any sewer or undotground fixture for the conveyance
of water or electricity.
The City shall, have the right to define and establish plumbing
requirements pertaining to the installation and operation of gas
appliances, services mains, etc.
Section 3.
';the City Council of the City of .Ames, Iowa, shall have power to
regulate the rapes for service and fix the abarges far the gaffs to
furnished by the grantee, and to regulate the service. and designate
the quality of gas to be furnisheed by the grantee to the inhabitants
of the City of Ames, Iowa, all in accordance with the provisions of
the statutes of Iowa, with the understanding and iVon the condition
that there shall be no discrimination between the consumers as to the
rate so charged. The City of Ames, Iowa, shall have the right to test
the gate furnished by the grantees to the inhabitants of the City, which
test shall be made in accordance with the methods proscribed by the
Ifational Bureau of Standards, and the test so made in ,Al matters pertaining
to quality shall be presumptively correct unless overcome by affirmative
showing of error or mistake.
Section 4.
(a) The grantee, shall upon the application of any person residing
within the corporate limits of the City of Ames, Iowa desiring gAa service
where the mains are in front of or adjoining the property*, furnish the
service pipes from the main to the lot line without expense to the customer#

grantee and such customer as to the serviceability of the service lines

(e) The said grantee, its successors or assigns, shall at all
times have its gas system in condition to snpply all the gas that tahall
reasonably be required for consumption, and shall from time to tim4
extend its mains or pipes at its own expense whenever gas is desired
by any resident or residenae of the City at the rate of one consumer for
each ninety feet of the required extension.
(d) That the grantee will hold the City of Ames, Iowa., free and
harmless of all damages or costs, including all count costs and a
reasonable attorney fees, of any kind or character, resulting fre9a
construction., repair ear operation of said gas mains, se �,�pe 'i r��a;`, etc. ,
either during the course of construction or at any times ai erea.. er, or
damages to the grantee l s mains, serviq o ins , oto, caused by the Gity
in the construction or maintenance of, the City#t water mains, sewers,
electric facilities. streets, or other public improvements.
(,a) The grantee shall without further or other order adequately
protect all open ditches, excavations, or other obstructions in azW
street or other public place, but the City reserves the right to re-
quire additional protection if in its opinion the same is necessary.
Section 5.
The grantee herein &gross that in determining what shall be' a
proper return upon its investment, in connection with the fixing of
rates either by the City Council or in any court of record Vhtph may
review the same -ems, they shall not take into consideration any value

herein have actually, expanded. in Connection with the procuring of
said franchisee, however, if such expenditure to to be considered by
the grantee as a part of its permanent investment it shall be Inoup-

Nothing herein contained shall deprive the city of Ames, Iowa, of
any rights it may have under the statute to acquire the property of the
grantee, or any part thereof, at any time,

The right, privilege: and franchise herein granted are given by
the said Council of than City of Ames, Iowa, and apeepted by the grantee
upon the express condition that this Ordinance shall not become effec—
tive or binding until it shall have 'been submitted to and approved. by a
majority of the legal electors of said City voting thereon and in favor
of the same as provided by law at a spacial electio to "be called for

tion to be paid for and discharged by the said grantee as by is bra
vided.
Section 0.
That nothing herein shall be construed in any manner as giving
the grantee and or its successors or :assigns any exclusive right,
privilege or franchise.
Section 9.
.That all franchises or ordinances heretofore granted or adapted
by the City- Council in conflict herewith shall fully and completely,
cease, be determined and are hereby repealed from and after e e
tine date of this ordinance €end. the franchise and prvilega ei3
granted..

granted shall be In full. force and effect from and. after its sagoPlefuy '`�'���;
by the City Council. and its add ion by the legal electors o the City
of Awes, Iowa, at a special election to be held for that purpose, and

within ten days from and after its adoption at such special election,
and shall continue in full force and effect for the period of twenty—
five years from said date.
