HomeMy WebLinkAboutA001 - Commission Action Form dated December 6, 2023 ITEM#: 7 DATE: 12-6-23 COMMISSION ACTION FORM SUBJECT: TEXT AMENDMENT FOR PUBLIC NUISANCE "PROPERTY MAINTENAN E" RELATED CHANGES TO THE ZONING ORDINANCE BACKGROUND: City Council recently adopted an updated Public Nuisance"Property Maintenance"Code(Chapter 30 of the Ames Municipal Code) that consolidated certain existing standards and augmented the scope of nuisance enforcement. Concurrently, City Council directed staff to review the Zoning Ordinance (Chapter 29) for consistency with Chapter 30 and identify if any corresponding amendments would be needed. Based on this review, staff presented several alternatives for amendments to the City Council at their October 10, 2023, meeting. Chapter 30 addresses a wide range of nuisances that are beyond the scope of zoning. However, Chapter 30 overlaps with Chapter 29 primarily in relation to use issues of outdoor storage and vehicle parking. The key issues presented to City Council revolved around definitions of vehicles, trailers, equipment, inoperable/junked vehicles, accessory parking, and storage. Definitions were found to be inconsistent between the two chapters and the intent of some of the standards was also unclear. City Council directed staff on how to proceed with updates regarding definitions, allowances for junked vehicle and recreational vehicle storage, parking of recreational vehicles, and exemptions of trash container screening requirements for single-and two-family homes. The primary focus of the amendments is the application of these standards to single- and two-family homes. A discussion of the ordinance details is included in the Addendum. Draft ordinance language is included in Attachment A.A summary of the topics and changes follows. PROPOSED AMENDMENTS: An explanation of several terms is required to understand the proposed amendments and current code. • Vehicles. The Zoning Ordinance currently does not have a definition of"vehicle". It only defines trucks and equipment (as exceeding 10,000 ibs of gross vehicle weight) and inoperable vehicles. Vehicle is a broadly defined term within state law for any vehicle that can travel on a roadway, including cars trucks, recreation vehicles, and trailers. Chapter 30 includes more specific definitions that City Council directed staff to incorporate into zoning, with adjustments as necessary to reflect the intent of the additional terms. • Parking v. Storage. Generally, accessory parking is defined as keeping of a vehicle for under 72 hours related to the principal activity on the site. Storage is defined as keeping of a vehicle for over 72 hours. Part of the amendment process was ensuring these terms were used consistently throughout the Zoning Ordinance. It was unclear if these terms were used intentionally or interchangeably in the current code. Tablas showing what allowances for parking and storage of vehicles by vehicle type under the current code and proposed amendments are available in the Addendum. The 72-hour duration requirement will apply to the vehicle on the site, not to the precise location on the property. The 72 1 hours standards will not restart if a vehicle is moved elsewhere on a property, it must leave the site. • Required Parking Spaces. The Zoning Ordinance includes minimum parking requirements for most uses in all zoning districts. Required parking spaces are those provided to comply with the minimum number of spaces required under zoning for a given use. For single- and two-family dwellings, the number of required spaces is two per unit. These may be provided in a garage or other paved area, such as a driveway, in conformance with the Zoning Ordinance and can be located either stacked (tandem) or side-by-side. Tandem parking is only allowed for single and two-family dwellings. Current Zoning standards prohibit the use of required parking for other purposes, such as display and storage. Junked Vehicle Storage Amendments Currently,junked vehicles (referred to as "inoperable" in the current code) are not permitted to be stored for more than 30 days. Ames Municipal Code (29.304(3)(a)(iii)) considers"outside storage of inoperative or unregistered motor vehicles for more than 30 days"to be a prohibited use. This section is not clear on the number of junked vehicles permitted to be stored. It also highlights the issue of the use of required parking versus storage in a required parking space. City Council directed staff to amend the Zoning Ordinance and Property Maintenance Code to allow one junked vehicle to be stored for no more than 30 days. This is more restrictive than the current provision that did not specify the quantity of junked vehicles that can be on a site at one time. Provisions prohibiting parking of junked vehicles in required parking spaces remain(see 29.406(5)).The proposed amendments and current requirements that apply to junked vehicles are summarized in Table 1. Section 29.406(5) prohibits the use of required parking spaces for vehicles and equipment. However, 29.406(19), allows: the parking of one (1) unoccupied travel trailer or recreational vehicle, boat, or boat trailer is permitted behind the front yard setback of the lot in any district, provided the travel trailer or recreational vehicle, boat or boat trailer is not used for living quarters or business purposes. 2 1 While this provision applies to parking (less than 72 hours), in practice this has been interpreted to allow for storage outside of the front setback. City Council directed staff to allow one recreational vehicle, boat, or trailer to be stored (for more than 72 hours) in the side or rear yard of a property. This clearly permits their storage versus the current code. Only one recreational vehicle, boat, or trailer is permitted to be stored (not one of each). Additionally, City Council directed staff to allow one recreational vehicle, boat, or trailer to be parked for no more than 72 hours in a required parking space to allow for off-street loading and unloading. Previously, this was only allowed beyond the front setback. The proposed amendments and current requirements are summarized in Table 2. City Council directed staff to remove the screening requirements for trash receptacles used for single- and two-family dwellings, relaxing the current requirement. Vehicles Use for Human Habitation Amendments Chapter 29.304(3)(a)(ii) of the current code disallows: Parking of trailers or motor vehicles used for human habitation or any accessory use, except use incidental to construction or emergency shelter for up to 30 days by persons whose dwelling has been made uninhabitable by fire or other casualty The intent of this section is to ensure that only approved dwellings are used for living purposes in all zoning districts. The changes are to address the updated definitions for various vehicle types. Definition Amendments Chapter 30 includes definitions of vehicles, trailers, semitrailers, and junked (formerly inoperable) vehicles. To maintain consistency, City Council directed staff to modify definitions within the Zoning Ordinance. Staff also added or amended definitions for all-terrain vehicles, equipment, commercial trucks, habitation, accessory parking, and commercial parking to assist in the administration of these 3 requirements. More information on why these definitions were amended can be found in the Addendum. Amendment Options City Council did not direct staff to reconsider the duration of parking and storage terms (less or more than 72 hours), only how they applied to certain situations. Council elected to allow storage of one boat, trailer, or recreational vehicle, not one of each item (the exception being an item on a trailer). City Council also maintained all the driveway, front yard, and other paving requirements as it relates to parking and storage. This means that all parking and storage of vehicles, trucks, equipment, trailers, recreational vehicles, etc. must occur in a parking area and meet paving requirements.The requirement for required parking spaces to be available for vehicle parking and not be displaced by other items continues with the proposed changes. ALTERNATIVES: 1. Recommend that the City Council adopt the Public Nuisance "Property Maintenance" related amendments to the Zoning Ordinance as presented. 2. Recommend that the City Council adopt the Public Nuisance "Property Maintenance" related amendments to the Zoning Ordinance with modifications. 3. Recommend that the City Council take no action to amend the Zoning Ordinance for consistency with the Public Nuisance "Property Maintenance" Code. PLANNING AND HOUSING DEPARTMENT RECOMMENDATION: The proposed changes do not substantially alter the general allowances and prohibitions for parking and storage. The most substantial changes are for junked vehicles (30-day storage allowance for one) and recreational vehicles, boats, and trailers (storage and parking allowance for one). The current Ordinance is unclear on these allowances/prohibitions, and enforcement was limited or did not occur. As a result, these changes will not cause a great shift in staffs administration of the code. The attached draft language will be refined in coordination with the CityAttorney's office to prepare a draft ordinance for City Council review and approval. At the time City Council considers the proposed Chapter 29 changes, they will also review related amendments to Chapter 30 Public Nuisance"Property Maintenance", Streets and Sidewalks (Chapter 22), and Parking (Chapter 18) code chapters. As these chapters are not under the purview of the Commission, they are not presented as part of this report. The proposed changes do provide needed clarifications on vehicle definitions, definitions of parking versus storage, and eliminate confusion on what code enforcement or nuisance abatement procedures apply. As a result, the recommendation of the Planning and Housing Department is Alternative 1. 4 ADDENDUM Parking and Storage Tables Vehicle Storage standards are summarized within Table 4, which compares current code requirements to the proposed amendments by vehicle type. Most vehicle storage is currently prohibited; however, outdoor storage is permitted in certain commercial and industrial zoning districts. These exceptions are proposed to remain. Exceptions for vehicle storage incidental to construction activities on site are also proposed. The main changes proposed to the outdoor vehicle storage standards are for junked vehicles (30-day allowance for one), which is less permissive than the current code. The amendments for recreational vehicles, boats, and trailers (storage allowance for one) are more permissive than the current code. The only change to vehicle parking standards is the allowance for one recreational vehicle, boat, or trailer to be parked on the driveway in a required parking space. Under the current Zoning Ordinance, one is permitted to be parked behind the front setback. Similar to the vehicle storage amendments, exceptions are proposed to allow parking if otherwise allowed by individual zone standards. Commercial parking is permitted in certain commercial and industrial zoning districts. Commercial parking is generally defined as short- or long-term parking as a principal use and is not accessory or used as parking for another use on the site. Definitions Staff is proposing to amend or define several terms: • All-terrain vehicles.Ali-terrain vehicles were defined so that they could be included in the definition of a vehicle. State law now allows them on State Highways and communities may regulate their use of roadways. This also helps to enforce parking in the front yard standards. • Equipment and Commercial Trucks (proposed as separate definitions). Trucks and equipment was previously one definition and did not specifically define equipment. These terms were separated so that equipment(construction equipment, drilling equipment, etc.) could be defined. The term commercial vehicles (inclusive of trucks) was introduced as a new term to distinguish from light-duty trucks, which are considered common passenger and light-duty types of vehicles. The definition for Commercial Vehicles based upon weight largely remains the same. • Habitation. Habitation was previously not defined but referenced in a prohibition on using vehicles for habitation. Clarification on how habitation was determined was needed (overnight accommodation is proposed). • Accessory and Commercial Parking (proposed as separate definitions). Only accessory parking (parking that serves another principal use on a site) was defined with the establishment of the 72-hr standard. Commercial parking was not defined and not distinguished from storage. Commercial parking is generally defined as short-or long-term parking as a principal use and is not accessory or used as parking for another use on the site. In addition to Home Occupations that do not comply with the criteria,the following uses are prohibited for Home Occupations; (g)Repair or painting of motor vehicles(including motorcycles and boats)or of any trailer,semitrailer,recreational vehicle,manufactured or mobile home,q prq vehicles,equipment, etc. , See. 29,1308. MINI-STORAGE WAREHOUSE FACILITIES. (7) Parking. Parking shall be situated in conjunction with an office or management structure,for use by staff,service or delivery personnel,or prospective tenants. (c)Except for purposes of loading and unloading, there shall be no parking or storage of commercial vehicles,equipment,vehicles,trailers,mobile and manufactured homes, semitrailers,recreational vehicles, and moving vans. (9)Prohibited Uses. (a)The following uses and activities shall be prohibited; (i) Any business activity other than the rental of storage units,including miscellaneous or garage sales and transfer-storage enterprises that utilize vehicles as part of said business is prohibited. (ii)Servicing or repair of motor vehicles, boats,trailers,lawnmowers, semitrailers,recreational vehicles.commercial vehicles,equipment, manufactured and mobile homes,or similar equipment is prohibited. (iii)Outdoor storage of boats,vehicles,commercial vehiclesquipment,,trailers, semitrailers,recreational vehicles, or other materials is prohibited. All items stored on the property shall be located within buildings. 12
