SUBJECT: Agenda Item #36-Public Hearing for Rezoning with Master Plan for 798 N 500th Avenue.
The proposed rezoning from Agriculture (A)to Floating Suburban Residential Low Density (FS-RL)
with Master Plan included a contract rezoning agreement for cost share of an oversized sanitary sewer
extension. A draft contract rezoning agreement was presented to the applicant on Friday and it was
included in the agenda packet for City Council. Per Iowa Code, contract rezoning agreements must be
signed and completed prior to the close of a public hearing and approval of a rezoning ordinance.
After discussion with the applicant about the agreement,they have decided they prefer to have
additional meetings with staff about the design of the sanitary sewer system that may result in
changes to the language of the agreement. Therefore, no signed agreement will be provided to
City prior to tonight's meeting. The applicant intends to meet with staff this week in an effort to have
a final agreement ready for City Council review on July 121n
The public hearing for this item has already been noticed by publishing in the newspaper,posting of a
sign, and mailing of notices to property owners within 200 feet of the site. Staff believes there will
likely be members of the public that want to discuss the rezoning with master plan proposal at the
meeting on Tuesday night. Staff recommends that City Council open the public hearing and take
comment from the public and then continue the hearing to July 12th in order to finalize the
contract rezoning agreement.
