Good morning,
On December 20, 2019, federal legislation was signed by President Trump raising
the age for sales of tobacco products from age 18 to 21 under federal law. This
new federal law bars retailers from selling tobacco prod ucts�ncluding
cigarettes, cigars, and e-cigarettes - to anyone under age 21. Please see the
following link to the Federal Food and Drug Administration Website regarding this
law change: https://www.fda.gov/tobacco-products/corrrpliance-enforcement-
training/retail-sales-tobacco-products.
There is also a recording regarding this law change that can be heard by calling
the FDA - Center For Tobacco Products at 1-877-287-1373, option 1. You must
call during normal business hours to hear the recording.
As for the FY20 Tobacco Enforcement Program 28E Agreement
between ABD and your department, there will be no changes to that
agreement or program procedures during this program year (July 1,
2019 through June 30, 2020).
Questions regarding federal enforcement of this law need to be directed to the
FDA - Center For Tobacco Products.

ORDINANCE NO. 3575
AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE 'J
AMES, IOWA, BY ENACTING A NEW SECTION 17.33 TO Pl,—..—..
PROVISION OF TOBACCO PRODUCTS TO MINORS;REPEALING ANY
AND ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
TO THE EXTENT OF SUCH CONFLICT;PROVIDING A PENALTY;AND
ESTABLISHING AN EFFECTIVE DATE.
BE IT ENACTED,by the City Council for the City of Ames,Iowa, that:
Section One. The Municipal Code of the City of Ames, Iowa shall be and the same is hereby amended by
enacting a new Section 17.33 as follows:
"Sec. 17.33. PROVISION OF TOBACCO PRODUCTS TO MINORS.
(1) A person shall not sell,give.or otherwise supply any tobacco,tobacco products,
or cigarettes to any person under eighteen years of age. Violation of this subsection shall be a
municipal infraction punishable by a penalty of S300 for a person's first violation and$750.00 for
each repeat violation; and, alternatively a violation of this subsection can be charged by a peace
officer of the City as a simple misdemeanor.
(2) If the holder of a permit issued by the Iowa Department of Revenue and Finance
under Chapter 453A Code of Iowa, or any employee of such permittee, during the course of the
permittee's business,knowingly sells or otherwise supplies any cigarette or other tobacco product to
any person under eighteen years of age,or fails to take reasonable measures to ascertain whether that
person is eighteen or more years of age, the said pemunce shall have committed a municipal
infraction punishable by a penalty of$300 for that permittee's first such violation and$750.00 for
each repeat violation."
Section Three. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of
such conflict, if any.
Section Four. This ordinance shall be in full force and effect from and after its passage and publication as
required by]a"-.
