They need an Ordinance revising the original TIF District #1 (created in 2014, 1 believe). I also spoke with Justin in planning and he is working on providing us with the legal description we need to include the land outside of the original TIF boundary. Provided that somebody can get me a legal description on a timely basis, I think that I can prepare the Ordinance"correcting"the boundary of the first TIF district, as Duane references below. I will run this past the County when I have a draft done, so that we know it will be acceptable before Council is asked to approve it. SECOND TIF DISTRICT. As it relates to the new TIF district (#2 within the ISURP area), I was provided today a by Planning a legal description quite similar to that Planning originally provided on September 4. It remains unacceptable to the County, and they will not recognize it. We cannot include land that is currently in Outlot X, Iowa State University Research Park Phase III, Third Addition, as Planning proposes. In order to create the second district, we can include 3525 S. Riverside (Deere & Company- 09-22-150-100), and 3511 S. Riverside (ISU Research Park- 09-22-100-004) and (ISU Research Park 09-22-100-240), or any one or a combination of the three. We are not able to create a second TIF District that includes other land currently in Outlot X, Iowa State Research Park Phase III. I will wait for Planning to (1) provide the description for the amended boundary of TIF District #1 so that we can fix the area to conform to the new boundary, and (2) provide me with the intended boundary of District #2 --which needs to be any one or a combination of the three parcels I identified above. She informed me that upon receipt of an amended ordinance to expand the boundaries the current ISURP TIF, she will include the ARFC property at 3600 University and increase the frozen base by the value of the property added by the amended ordinance. I learned from the County Auditor that the ARFC property at 3600 University is now outside the boundaries of the ISURP TIF district. Per the City Assessor's records, a plat of survey was approved by Council on 8/14/2018 (Res. 18-481) that modified the lot to include the tennis bubble. This change placed the lot outside the TIF district boundaries and to have taxes go to the TIF a property needs to be fully within the boundaries. As best I can tell from the sketched maps I have, the ARFC lot including the tennis bubble is within the URA. If that is the case we will need to modify just the TIF ordinance to change the boundaries. The property taxes collected in September 2019 and March 2020 will not be impacted, however there is some urgency to modify the ordinance. The County tells me we need to have this done prior to our December 1 TIF claim. For Legal - let me know if you will be preparing the ordinance with the modified TIF boundaries or if you would like me to coordinate with Planning and Dorsey Law to get this done.
