FINDINGS. The City Council has authority, as described in section 354.23 to vacate parts of an official plat conveyed to the city or dedicated to the public to be of no benefit to the public. The City Council received a request to vacate a portion of land that is dedicated alley right of way north of Lincoln Way and East of Elm Avenue, in the City of Ames, Iowa. The Council has previously given notice of and conducted a public hearing regarding the vacation of said Alley. The City Council deems this ordinance appropriate, and necessary to protect, preserve, and improve the rights, privileges, property, peace, safety, health, welfare, comfort, and convenience of the City of Ames and its citizens, all as provided for in and permitted by section 364.1 of the Code of Iowa(2019). SECTION 2. VACATION. The portion of dedicated alley right of way located generally North of Lincoln Way and East of Elm Avenue is hereby vacated where legally described as follows: [See attached Exhibit 'Al. SECTION 3. REPEALER. All other ordinances or parts of ordinances in conflict with this ordi- nance are hereby repealed. SECTION 4. EFFECTIVE DATE.
