Dear Council Members,
Thank you again for another productive discussion on the proposed Rental Housing Concentration Cap
Exception Requirements (13.300.10.a) at the July 10, 2018 City Council meeting.
We would like to voice our support for the proposed amendment that limits the window of time within
which trade permits were obtained.
We would like to voice our opposition to the proposed amendment that would prevent the transfer of
a letter of compliance (LoC) when the property is sold.
Our primary reason is that it is in direct conflict with the Property Sale Hardship Exception (13.300.11)
which recognizes that the lack of a transferrable LoC can be a barrier to the sale of a property and
specifically offers a path to removing that barrier by allowing the owner to obtain an LoC "to facilitate
the sale of the property". The proposed amendment to 13.300.10 does the exact opposite of this and
introduces the same barrier to the sale of the property by making its LoC non-transferrable.
We respectfully request that all LoCs are treated consistently once they have been validly obtained (via
issue prior to the moratorium, via 13.300.11 or via 13.300.10) It is likely a small subset of properties
that fall into the third category and introducing verbiage to treat that subset differently adds
unnecessary complexity to the process, is inconsistent, and is unfair.
