Petition to oppose Creating Rental Concentration Limits in Near Campus Neighborhoods We are petitioning the City Council to require a 5/6 City Council approval of a proposed ordinance regarding rental concentration limits rather than the typical 4 vote majority. Information: The Ames City Council is considering restricting the number of rental units in Near Campus Neighborhoods. You live or own property in one of these neighborhoods and would be subject to this ordinance. It will state that if your neighborhood has more than X% of rentals (25% is being discussed now), you would not be able to convert your home to a rental unit at any point until the entire neighborhood is below the percentage number set by the City Council. This will affect your rights as a homeowner and your property value. If you are not in favor of this potential ordinance, please sign your name below. In consideration of the information above, I oppose any restrictions that the City would place on the use of my property as an owner occupied or rental home. Mostly in support of the rental cap ordinance,but agreed the Council should consider compromises especially in the area West of Lynn Ave.Would like to see incentives to for potential buyers to convert rentals to owner occupied. Would like stricter enforcement of nuisance properties and landlords.They have dealt with repeat nuisance property issues for a rental down the street. 2. Sees both sides of the argument.Wasn't sure his property sees impacts either way due to its location and size.Asked for more information before deciding, but he did empathize with friends on Lynn Ave who deal with nuisance renters. 3. Owner sees both sides of the argument. Neighbor had talked to him about putting a covenant on his property preventing it from being rented if he sold in the future. They indicated they didn't want to tell a future owner what they could do with the property. In the end,he wanted to remain neutral. 4. Owner sees both sides of the argument. He has struggled with nuisance renters across the street. He wanted to remain neutral,but believed his wife had stronger views about the ordinance. 5. Owners said they understood both sides.As residents,they would like more young families to live in the neighborhood,but they also bought the property at 424 Stanton in December 2017 from a young family who owned it since 2006 with the intention to flip it to a rental. They were able to get an LOC just before the moratorium went into place. He would like to research both perspectives on his own. 6. Resident is a long-time property owner. Feels very strongly the city lied to residents about the closing of Crawford and that contributed significantly to the changing of the neighborhood. He wasn't sure where he stood, but wondered if residents might have legal recourse if the ordinance passes. 7. Resident would rather see the Council consider other options for handling nuisance properties. She understands the issue and has dealt with problem tenants in the past,but also doesn't want to see potential for negative impacts on property owners.Would rather see incentives and harsher enforcement than the cap,but in the end declined to officially take a position. 8. Can see both sides,but sympathizes with loss of property rights and property values. He wants to see how the Tuesday's council meeting goes before taking a position but asked to keep the conversation going if the ordinance advances. We were unable to speak with a resident and/or property owner for all unmarked properties.All owner occupied homes were attempted at least 3 times. We feel we need to share with you the misleading, intimidating, and false information that is being conveyed to residents, particularly those who may not have been following the rental cap discussions. If successful, this campaign will further degrade our neighborhood. This effort, involving a cover letter along with two petitions (all attach0d), is being spearheaded by some individuals, along with realtors and the Ames Rental Association. There are two petitions: f i 1) To require a supermajority for passage of the rental cap ordinance(see below). 2) Should that effort fail and/or should the ordinance pass, they ask that the part of SCAN west of Lynn(starting with the west side of that street) be exempt from any cap because of its current higher rental percent. Petitioners are going door to door in the proposed exempted area, avoiding those who have spoken publicly in favor of the cap; it is not clear if they are asking renters to sign. They are also mailing the attached cover letter and petitions to owners of rental property (based on personal contact with one such person). The cover letter and petitions sent by mail include the following statements: 1. "Sign the enclosed supermajority petition being organized by the Ames Rental Association and area realtors." (Emphasis added.) Note: We have passed this information to the City Attorney and City Manager so that they can be ready to address whether this would even be allowed in a non-zoning issue; if not, Council consideration of a supermajority could be avoided. 2. The rental cap is "nothing more than an effort to push renters out of the neighborhood (bold in original)by the long-time residents". We find this statement misleading and insulting: no renters will be pushed out; in fact there will be more under the new occupancy ordinance. And, of course, no current rental property will lose its ability to remain rental. 3. "Realtors have warned this effort will significantly devalue the properties (bold in original) in our area of the neighborhood." This seems to be a scare tactic. We are concerned that there are other, similar cases of intimidation by realtors, warning people about their property values. One neighbor reported a phone message from a realtor warning they would be unable to sell their home—even though they are not moving and the house is not on the market! This petition for exemption will have the negative consequences that the cap is meant to prevent. We have always been adamant that SCAN is one entity and no part should be sacrificed for the economic gain of a few. It has natural boundaries because it abuts high density or university-owned land. We know you have received emails in support of the cap from residents west of Lynn, including people who are surrounded by rentals. Petitioners drew their boundary down the middle of Lynn Avenue(see map on attached petition). This would leave the east side of the street, which has NO single-family rentals, as the border of the capped part of SCAN, potentially facing all rentals across the street. In the proposed exempt area there are clusters of owner-occupied homes in locations like the southern section of Hayward, the 600 block of Stanton, the 500 block of Lynn and the western section of Donald with few or no rentals; how would exemption from the cap do anything but negatively impact those who want to remain living there? While we support realtors' and others' rights to protest, we are disheartened by their use of half-truths and intimidation. We appreciate your support to date and urge you to adopt the cap as an appropriate tool for all of SCAN and Colonial Village. For reference, the neighborhood as a whole is already above 40% rental concentration. Further, the area west of Lynn Ave is above 60-70% rental concentration. In short,this means the city will not allow any new single-family homes to become rental properties in this neighborhood - something tenants, landlords, realtors, and many property owners living in the Iii-fifly con-,,en trated area are againsf. That means our calculation of 63% rentals west of Lynn (excluding high density) is actually much higher when you include these properties. 2.As we suspected, not many owner-occupied properties were aware of the ordinance, and they were definitely not aware of what it means. 3.Those that were aware and in favor only cited nuisance college students as their reason for supporting. 4.As everyone knows, not all of the tenants are college students. We've spoken to: • a single father wanting to live close to his kids • a single mother who wanted a yard for her kids and could only afford a home in Campustown • at least four young families • a woman who has rented her home more than 20 years • an adjunct professor who is not ready for long-term housing Our neighborhood will not attract non-student tenants if we treat all tenants like second-class citizens who are not welcome in our neighborhood simply because they choose to rent instead of buy a home. S. Many of the non-undergraduate renters noted finding an affordable rental home vs. an apartment is very difficult in Ames. This proposal will not make rental housing more affordable; rather, it will likely increase rental prices. 6. Many of the undergraduate renters noted the new apartment buildings around town are more expensive than renting a home in Campustown,which is one of the reasons they choose to live in the neighborhood. We believe our petition to be a compromise that would better fit the needs and wants of each part of the SCAN North neighborhood than a broad overlay.We appreciate your attention and time in considering our petition. In the full page format, I see a number of companies signed that they are citizens of the neighborhood, like RWK, which is listed by the Assessor as having an address in Amana, IA. Here is a sample.- Mid IA Family Thera p_20180424 070036.pdf My thoughts: The petition, even if signed by a requisite number of property owners under Iowa Code section 414.5 would not require a 4/5 (5 out of 6) vote by the Council, since this is not a re-zoning, and the "protest by petition" provision in the Iowa Code that would trigger a 5-of-6 vote only applies to re-zonings. It could be that 1) whoever is circulating this petition thinks this is a re-zoning, or 2) the petition is essentially asking the Council to self-impose a 5-of-6 vote requirement instead of the usual simple majority, or 3) the person promoting the petition thinks the proposed ordinance is essentially a re-zoning even if we're not calling it that. I should note that it is theoretically possible that the Council could take an action it did not consider a zoning action, but a court might say that was done was, in fact, zoning, even if we didn't call it that. I don't think there's a risk of a court deciding such in this case. Regarding #2 above, the Iowa Code sets a majority vote of a City Council for passage of an ordinance. (Iowa Code section 380.4(1) states: "Passage of an ordinance, amendment, or resolution requires a majority vote of all of the members of the council...") It appears to me that they are just asking to be excluded from the 25% rental-concentration cap. There was some thought yesterday that the petition was going to be a re-zoning protest, which requires a supermajority vote by the Council for approval. Of course, this is a change to the Rental Code, not a re-zoning, so the re-zoning protest provisions of the Iowa Code would not apply. Again, it appears the purpose of the petition is just to ask to for a certain area to be excluded. But in case the"re-zoning protest" issue comes up, here's the relevant Iowa Code provision. I've underlined the key language: 414.5 Changes—protest. The regulations, restrictions, and boundaries may, from time to time, be amended, supplemented, changed, modified, or repealed. Notwithstanding section 414.2, as a part of an ordinance changing land from one zoning district to another zoning district or an ordinance approving a site development plan, a council may impose conditions on a property owner which are in addition to existing regulations if the additional conditions have been agreed to in writing by the property owner before the public hearing required under this section or any adjournment of the hearing. The conditions must be reasonable and imposed to satisfy public needs which are directly caused by the requested change. In case, however, of a written protest against a change or repeal which is filed with the city clerk and signed by the owners of twenty percent or more of the area of the lots included in the proposed change or repeal, or by the owners of twenty percent or more of the property which is located within two hundred feet of the exterior boundaries of the property for which the change or repeal is proposed, the change or repeal shall not become effective except by the favorable vote of at least three-fourths of all the members of the council. The protest, if filed, must be filed before or at the public hearing. The provisions of section 414.4 relative to public hearings and official notice apply equally to all changes or amendments. A 3/4 vote would be 5 of the 6 Council members. We have also heard rumors about a second petition that is being circulated by a realtor. We don't know the nature of that petition. Just to summarize: The petition that has been filed does not seem to be a "re-zoning protest" and if it were such a protest, the Iowa Code section cited above would not be relevant, since this is not a re-zoning. They are ordered according to neighborhood associations with SCAN (84), CCOAMS (65), Oak Riverside (26), and Colonial Village (2). We have tried to remove any duplicates and where spouses signed separate petitions, we have put them next to each other and only counted it as 1 property. Also, some of the owners have properties in multiple neighborhoods. We counted petitions by properties, so some petitions have several properties and were counted for each property the owner listed that they owned. We have received a few different numbers from City Staff Officials, but we trust that - for SCAN and CCOAMS, these numbers will meet the threshold of 20% of property owners to require a 5/6 majority vote on the issue (see below for numbers given by the City of Ames). At the very least, I hope you see all of these signatures as an indication that MANY people are opposed to this ordinance and the council is moving down this path too quickly. There will be a follow up email to this with the petitions from CCOAMS since the files were too big to attach to one email. Looking forward to discussing this more tonight. Each time, the following numbers are what I received (at the time, I had 81 petitions, but they keep coming in). The most recent email was received this morning and stated: "The numbers I sent are what Planning used to send out notices so it should be a complete set of all properties within those areas. I assume they used our GIS system to pull the numbers and associated mailing addresses. The list Julie gave me shows that there are 96 properties in SCAN North. Your percentage will depend on the number of properties the signatures represent. So, if you have three people that signed at one property, percentage-wise, they should only count as one. Apples to apples would be number of properties represented to total number of properties. Apples to oranges would be number of properties represented to number of signatures (if more than one per property). We did not request only owner occupied people in those neighborhoods, but received petitions from everyone. Regarding the count of numbers, I agree that the numbers must be off. However, I emailed Sara Van Meeteren 3 separate times to ask about numbers and explained why I wanted them (i.e. that we were creating a petition and we wanted to know how many properties are in the area so we could figure out the percentage of properties that our petitions would make up). In all 3 responses, she gave me the below numbers from Julie in Planning and Housing. I put in a phone call to Julie before the meeting, but we were not able to connect.
