Dear Mayor and Council members,
As of Fri. Nov.2lst, protest signatures for 8 of the 16 properties (50%) within 200' of this grouping of
three properties have been turned into the City Clerk. These eight properties also represent 19.81% of
the area of the properties within 200 ft. (please see attachments).

Throughout these many rezonings we have been told that 20% of property numbers or property area
would result in the need for a Council `super-majority' to pass a rezoning. Now we are told only 20% of
property area can require "super-majority" vote to pass rezoning. This again is one of several changes
in the rules, as we've participated in the City processes over the past 3+ years.
23.9% protest signatures by area(25.5% by number of properties) were turned in Oct. 14th, for the
"Enlarged North Parcel" (collected and turned in after the LUPP amendment for the "Enlarged North
Parcel" passed). In November we were told that there would be two rezonings, requiring separate
protest signatures for Breckenridge's three S. Wilmoth properties purchased at the end of July. More
owners signed that protest (actually more owners signed both protests!). Nov.6th 44+%by area(48% by
number of properties) was turned in for 205 S. Wilmoth rezoning. (See attached map)
We were also told Breckenridge was challenging the City to include the public roadways in the 200'
property count, changing the rules again, which would require even more signatures than ever before.
We may pass the 20% protest by area bar before Tuesday's public hearing to rezone this parcel, but
with Breckenridge owning over 45% (the athletic field), a church owning 6+%, one owner near MN
owning 18+% with 3 properties, two owners unknown with combined 10+%, the great majority of the
owners closest to the impact of Breckenridge's rezoning are owners of properties too small to
make a difference (contrary to the considered equality of"one `person' one vote"... ).
The effort behind these protest signatures to mandate a"super majority" to pass a rezoning, is to require
Council members to listen to each other, consider well all the positions put forth. It does not guarantee
any given outcome.
Hopefully, even with only 19.81%, the Council will not consider a 4-2 vote worthy of reflecting
Council consensus on such a crucial vote.
