SUBJECT: Correction of Ordinance—Landscaping Provisions for Auto Dealers
At its regular meeting of June 12, 2012, the Council approved on first reading an
ordinance providing alternative landscaping standards for auto dealers. Staff provided at
that meeting a hypothetical site plan showing what an auto dealership might look like if
landscaped under the alternative standards. The provisions included perimeter
landscaping around the building as a means of mitigating the loss of some of the interior
parking lot landscaping, and it was intended (as illustrated in the hypothetical site plan)
that this perimeter building landscaping would be applicable around the perimeter of all
principal building facades visible from a public street.
This requirement was intended to be stated in Section 29.403(5)(b). However, staff
unintentionally left out the word"building" in that sentence, leaving it to read:
"Landscaping around perimeter of all principal facades visible from a public street."
That changes the meaning from what was intended when staff drafted the language, and
also from what was illustrated to the Council per the hypothetical site plan. Staff,
therefore, recommends that Section 29.403(5)(b) of the ordinance be corrected by adding
the word"building," to read as follows:
"...(b) Landscaping around perimeter of all principal building facades visible from a
public street.
. . ." [with the balance of that section remaining unchanged.]
Staff has confirmed with Legal that this change is in line with what was discussed and
illustrated to Council, and therefore, does not have to go back to the Planning & Zoning
Commission. The Council may, therefore move to amend the ordinance as above-stated,
and then approve the second reading of the ordinance.
