SUBJECT: Zoning Ordinance Text Amendments for the Creation of the Convenience General
Services (CGS) District
The Planning and Zoning Commission will review the proposed amendments at its meeting scheduled
for February 17, 2010.
The City Council will be reviewing the proposed amendments at its meeting scheduled for March 2,
2010. You have indicated that you need to send a public hearing notice to the newspaper on February
16, for publishing on February 19, for the City Council meeting of March 2.
I have attached a copy of the Commission Action Form dated February 17, 2010, as prepared by Steve
Osguthorpe.
Please contact Steve at extension 5400 if you have any questions regarding this agenda item.

No, I did not. Elara is listed as the contact and I figured she would keep their people informed, but I will
forward a copy to Chuck now.
Also, I su check with Diane on notice requirements, because even for the CC to consider the
zonings n March 2, the notice will have to go out the day before the Feb. 17 PZC meeting.

The attorney for Casey's is Doug Beech; I have copied him on this email so that you will have his email
address. His office number is 515-965-6284.
1 looked at the calendar this morning and hopefully staff will be able to pull the language together so that
this will be on the P &Z agenda for their meeting on February 171 I know it would be a quick turnaround
but we would request that it go to council on February 23`d, otherwise we would have to wait until March 9`
Please let me know when we can get together with planning and electric to review the site plan, we would
really like to go to the planning and zoning meeting and indicate that all of the site plan issues have been
resolved and that with these minor changes in the text Casey's is ready to start construction.
I would like to be involved in the meeting as well so please copy me on the meeting time and dates

Subject Casey's and the CVCN zoning amendments
FYI, my response today to some phone calls yesterday from Elara Jondle at Pels Engineering inquiring if
we need the resubmitted site plan for Casey's at Stange and Bloomington before the February 17 PZC
meeting:
1. No, we don't need anything at this point from Pels or Casey's. On February 17 the PZC will be
acting on zoning amendments, which City staff is preparing. We will send Casey's the staff report
including the proposed amendments before the meeting, by the end of Friday, February 12 at the latest.
2. Since Elara said that the Minor Site Development Plan has not changed from what was reviewed
by the ZBA last fall (and is not likely to change) that we have no need for it this early. However, to
expedite a final decision when it is resubmitted, Pels could send one copy of the Plan on the day after the
City Council takes action on the zoning amendments. We will do a courtesy review to confirm that there
are no issues or contact her if there are questions.
3. The site plan should be resubmitted as a new submittal, with a signed application form, required
copies and application fee immediately after the zoning amendments take affect. We will then expedite
review and final action based on the revised zoning code.
