HomeMy WebLinkAboutA006 - Code of Iowa procedures for TIF and URA PROCEDURE FOR ADOPTION OF URBAN RENEWAL PLAN,RESOLUTION CREATING THE URBAN RENEWAL PLAN AND THE ORDINANCE CREATING THE TIF DISTRICT. AS OUTLINED IN CODE OF IOWA 403.5 UPDATED DECEMBER 3,2008 December 9: Staff prepares the plan and presents it to the City Council. The City Council refers it to the Planning and Zoning Commission for a recommendation. The City Council can also appoint a representative for the consultation to be held December 16 December 10: The City mails out an invitation with a draft of the plan to the taxing entities for the December 16 consultation. December 17: The Commission reviews the plan and forwards its written recommendation to the City Council. No official public hearing is required but public input may be gathered. The scope of the recommendation is limited: does it conform to the LUPP. December 16: The consultation is held at the City Council meeting. The Council sets January 13 as the date of the public hearing. No later than December 23: The taxing entities may make recommendations for modifications to the plan within 7 days of the consultation. No later than January 6: The City responds to the comments from the taxing entities no less than 7 days prior to the public hearing. Between December 23 and January 9: The City provides notice of the public hearing in the newspaper no less than 4 days and no more than 20 days before meeting. The notice is also mailed to taxing entities. January 13: The City Council conducts the public hearing. The City then can approve a resolution adopting the plan, approve a resolution creating an urban renewal area, and approve an ordinance establishing a TIF district. As part of the process, the City of Ames is enclosing a copy of the proposed urban renewal plan to you, an affected taxing entity. In accordance with Code of Iowa Chapter 403.5 (2), you are cordially invited, or to appoint a representative who is invited, to attend a consultation with the Ames City Council on December 16 in the City Council Chambers of City Hall, 515 Clark Avenue in Ames. The meeting will begin at 6:30 P.M., immediately prior to the regularly scheduled meeting of the City Council. Following the consultation, you or your appointed representative will have seven(7) days within which to submit "written recommendations for modifications to the proposed division of revenue." The City will review any correspondence from you and submit our written response no later than seven (7) days prior to the public hearing on the adoption of the urban renewal plan.
