on November 19, 2008, pertaining to the rezoning of property located at 4098 East 131n
Street:
Bill Bartine, Belin Law Firm, 2000 Financial Center, Des Moines, Iowa, here on behalf of
Woldord Development Options. I have tried to come up with a metaphor to describe the East
Barilla property and I have come up with two. The first one is red headed step child because it is
kind of sitting out there by itself and it may have been a little bit of extra property that Barilla
had and it never was planned for development. The agreement now talks about it as future
industrial and it just hasn't fit into the plan. And for that reason the Wolford interests are very
amenable to making this consistent with the LUPP and sending the zoning back to match the
land use classification. We filed the application so obviously we are okay with that. It is just a
piece of property that has really never fit into the plan. The other thing you would call it perhaps
is a shuttle cock as its been planned industrial, regional commercial, and for planning purposes it
is back across the line so we really believe it is in the City's interest and the developer's interest
to have those classifications consistent at this stage and so we are fully behind the application
and believe that this is the case.
Two other points:
One, Jeff in his presentation, alluded to the Development Agreement and it happens to be the
developer's interpretation as well that the Development Agreement doesn't change; their
obligations don't morph because we rezoned this property; there really isn't nothing in this
agreement that talks about rezoning this property or not rezoning this property. Having said that,
that is not an issue.
On the O-GNE, we have gone back and forth and have had quite a few discussion about which is
better, and we have decided that it is kind of a push. The subject .. we are no worse off
tomorrow if the O-GNE is still in place ...we have got it today. We kind of like the idea of
having that little development transition as you go from commercial to the industrial to have
some additional standards. I think that's ... I wish we though of it at the time and I wish we
knew it were going industrial because that is probably a pretty good plan. If you are doing raw
industrial, it probably doesn't help that much, but that is for another time. If there were a
development planned and there were a project, we might have a discussion, but it's not there now
and it's not right to be discussed.
So, Mr. Wolford's organization sends its regards and we are locked into this with the application.
