These persons may not do this type of work on a daily basis and sometimes they are brought in from elsewhere. They have also not been the source of any complaints or problems. • Some businesses operate regularly on an intermittent basis. Examples: • Hobby Lobby has a sewing machine sale and a distributor sets up inside the store for a week. • Auto service company hires temporary help to sell oil changes (or another service) door- to-door. • Booths in the mall are changed frequently, with many operating only during holiday periods. • Tropical Sno sells snow-cones from stands in several locations, but only during summer months. • Coldwater Links ceases operations during the winter. Proposed Solution: Delete the words "by said person" and "on a continuous and permanent basis." 17.26(5) Issue: In 2007, Individuals with extensive criminal histories applied for permits to go door-to- door selling magazines. Three of them failed to furnish complete or accurate information and their licenses were denied; however, the existing ordinance allows them to re-apply in six months. If they correctly state all their offenses, we have no basis for denying them permits. Nevertheless, these are not individuals citizens would want knocking on their doors. (Offenses included: theft in the first, third and fifth degrees; robbery in the first and second degrees; assault; assault using a weapon; domestic abuse; consumption/intoxication; false use of a financial instrument, etc.) Proposed Solution: Add a prohibition for those who have been convicted of certain offenses within a certain time frame. 17.26(8)(a) Issue: Existing code does not make special provisions for sales within City Parks. Proposed Solution: Add provisions in a new Section 22.14(d) and cite them here. 17.26(8)(d) Issue: In the last 15 years, there have not been any problems with participants in established Farmers Markets or local sellers of flowers, fruits, vegetables, etc. The Farmer's Markets generally screen their participants and other local growers, such as the Strawberry Patch or Holub's, are well known to Ames citizens. Residents also seem to look forward to being able to purchase locally-grown produce from road-side stalls. Proposed Solution: Allow persons or businesses who have registered with the Iowa Department of Agriculture and Land Stewardship to sell locally-produced items without a permit, provided they are in an appropriate zoning district and have the property owner's permission. The list of items should probably be detailed to some extent in order to restrict the sale of certain products, such as cattle or fresh meat. Directories listing registered parties are listed on the IDALS Web site at http://www.iowaagricuIture.gov/iowaProducts.asp. Vending 22.14 Issue: At present, the Parks & Recreation Commission enters into annual Concession Agreements with parties who sell food and beverages in City-operated parks. This practice is not reflected in the Municipal Code. Proposed Solution: Add section 22.14 (d) making an exception for vendors regulated by the Commission. Notes: • I have asked Jon-Scott Johnson to review the insurance requirements of Section 22.16(5). • We may want to consider the option of allowing Transient Merchants' permits to be extended or purchased for longer than a 60-day period. • We may want to consider the fee differential for those who sell from private property ($35 per person for a 60-day permit) and those who vend on public property ($50 per space for an annual license).
