HomeMy WebLinkAboutA004 - Council Action form dated April 24, 2007 ITEM #: DATE: 04/24/07 COUNCIL ACTION FORM SUBJECT: REZONING OF PROPERTY LOCATED AT 799 SOUTH BELL AVENUE FROM RESIDENTIAL LOW DENSITY PARK (RLP) TO GENERAL INDUSTRIAL (GI) BACKGROUND: The site is approximately 9.58 acres in size and was created as Outlot `Z' in the Four Seasons Park Subdivision. The same property owner, Dayton Park LLC, owns Four Seasons Park, as well as the site to be rezoned, addressed at 799 South Bell Avenue. The property is currently vacant and unbuildable due to the Outlot designation. The property is located directly south of the terminus of South Bell Avenue, as shown on the attached Location Map. On January 24, 2006, the City Council approved Resolution No. 06-039, which effectively removed the Environmentally Sensitive Areas Land Use Policy Plan (LUPP) Map designation from the property. This LUPP Map designation change provided a consistent LUPP designation of General Industrial for the entire property. Resolution No. 06-039 and the associated map are attached. The staff has discussed this proposal with the property owner to determine future plans. The property owner has stated that there are no specific plans for the property at this time. Allowable uses by Code are defined in Ames. Municipal Code Table 29-901(2). The property owner further stated that his LLC owns not only the subject property, but also the manufactured home park directly west of the site, that they are long-term owners, and the property is not currently, nor is it planned to be, for sale. Four Seasons Manufactured Home Park, located directly west of the site is residentially zoned and will be utilized for residential homes. Ames Municipal Code does require L4 landscaping on all GI zoned properties, which abut residentially zoned properties. The L4 landscaping standard requires an eight-foot high masonry wall with one landscape tree per 50 lineal feet, and three high or six low shrubs per 30 lineal feet with ground cover plans fully covering the remainder of the landscaped area. The properties directly to the north, west (including the manufactured home park), and east are designated General Industrial on the LUPP Map. Properties to the south are a combination of Highway-Oriented Commercial and General Industrial designations. Further, properties to the north, east, and south of the site are zoned General Industrial (GI). Because the property is currently designated as an 0utlot, the applicant will need to submit a Sketch Plan to start the process of changing the site from an Outlot to a buildable lot. Recommendation of the Planning & Zoning Commission. At its meeting of April 4, 2007, with a vote of 5-0, the Planning and Zoning Commission recommended approval of the rezoning of 9.58 acres of land in Four Seasons Park Subdivision from Residential Low Density Park (RLP) to General Industrial (GI). ALTERNATIVES: 1. The City Council can approve the rezoning of 9.58 acres of land in Four Seasons Park Subdivision from Residential Low Density Park (RLP)to General Industrial (GI). 2. The City Council can deny the rezoning of 9.58 acres of land in Four Seasons Park Subdivision from Residential Low Density Park (RLP) to General Industrial (GI). 3. Action on this request can be postponed and referred back to City staff and/or the applicant for additional information. MANAGER'S RECOMMENDED ACTION: Rezoning the site to General Industrial (GI) would be consistent with the Land Use Policy Plan designation for the site and for the majority of the surrounding properties. Future General Industrial uses on this property would also be consistent with the uses currently found on Bell Avenue. Lastly, as development occurs, the Municipal Code provides additional screening requirements between the industrial and residential zones. For the above stated reasons, it is the recommendation of the City Manager that Alternative #1 be adopted. The zoning boundary between general industrial and low density residential is moved to a location that makes good use of the future developed land. 2. General industrial lots would bound South Bell Avenue on both sides rather than an existing zoning boundary that would create a small sliver of area of low density residential zoning on the east side of a future extended South Bell Avenue. 3. The western boundary of the general industrial zone will line up with the approximate zone division in Dayton Park Subdivision to the south, and will create a logical location of the zone division for the entire area. CONSISTENCY WITH THE LAND USE POLICY PLAN The Land Use Policy Plan illustrates that approximately 70% of Outlot `Z' is general industrial in the northern tier and approximately 30% of Outlot `Z' is environmentally sensitive area in the southern tier. The rezoning of this land will be more the consistent with the Land Use Policy Plan in that the proposed rezoning to general industrial would cover the 70% general industrial land as shown in the Land Use Policy Plan.
