HomeMy WebLinkAboutA005 - Council Action Form dated March 27, 2007 ITEM # q/aolh DATE: 03/27/07 COUNCIL ACTION FORM SUBJECT: FIRST PASSAGE OF AN ORDINANCE ESTABLISHING PROPERTY LOCATED AT 207-215 LYNN AVENUE AS AN URBAN REVITALIZATION AREA AND APPROVAL OF THE URBAN REVITALIZATION PLAN BACKGROUND: On February 13, 2007, the City Council directed staff to prepare an Urban Revitalization Plan and set a date of public hearing for March 27, 2007, to establish an Urban Revitalization Area for 207 - 215 Lynn Avenue. These properties will be combined into one parcel by plat of survey, following City Council's decision on the Urban Revitalization Area and Plan and demolition of the structures (see attached Map of proposed 211 Lynn Avenue Urban Revitalization Area). The following items are included in the proposed Urban Revitalization Plan for the 211 Lynn Avenue Urban Revitalization Area (see attached Plan): ■ The area includes two properties with the total current assessed valuation of land at $342,900 and of improvements at $39,000. ■ It is expected that the value added by the proposed improvements will exceed the 5% increase required in actual value of the properties. ■ The owner of the properties in the district is Dayton Road Development Corporation. ■ The zoning classification is Residential High Density Zone (RH)with a West University Impacted Area (O-UIW) overlay designation. ■ There are no City infrastructure improvements associated with this project. ■ The tax abatement will be given only for the construction of multi-family residential buildings with brick or masonry material on 100% of the street faces and on 50%of the other faces, and also including 150% of the required landscaping or greater. ■ The district will be in place for 10 years. ■ There will be no displacement of any persons and thus no relocation benefits provided. Criteria. On February 13, 2007, the City Council determined that the request for designation of an Urban Revitalization Area for 207—215 Lynn Avenue meets the Multiple Family Residential Criteria Matrix in that its condition is slum and blighted. The City Building Official had determined that two of the existing buildings are no longer inhabitable. The project as proposed will meet the requirements of Optional Conditions of the Criteria Matrix of brick construction or similar masonry material and landscaping beyond required (see attached drawings). These Optional Criteria have been included in the Urban Revitalization Plan. As in all Urban Revitalization Areas, for tax abatement, improvements must first be complete in accordance with the approved Plan for that Area. ALTERNATIVES: 1. The City Council can approve on first reading the 211 Lynn Avenue Urban Revitalization Area and approve the Urban Revitalization Plan for 211 Lynn Avenue. 2. The City Council can deny approval of the 211 Lynn Avenue Urban Revitalization Area and deny approval of the Urban Revitalization Plan for 211 Lynn Avenue. 3. City Council can direct staff to work with the developer to revise the Urban Revitalization Plan in accordance with alternatives set forth by the City Council. MANAGER'S RECOMMENDED ACTION: The replacement of the three existing wood frame buildings with the proposed17-unit multiple family residence will improve the immediate area, which is characterized by large, masonry, multiple family residences and churches. The property tax abatement will support this project, which meets the City Council's goals for this urban revitalization program. Any qualified real estate may elect one of the three schedules. The exemption period for ten (10) years. The amount of the partial exemption is equal to a percent of the Actual Value added by the improvements, determined as follows: For the first year, 80% second 70% third 60% fourth 50% fifth 40% sixth 40% seventh 30% eighth 30% ninth 20% tenth 20% The exemption period for five (5) years. For the first year, 100% second 80% third 60% fourth 40% fifth 20% The exemption period for three (3) years. All qualified real estate is eligible to receive a 100% exemption on the Actual Value added by the improvements for each of the three years. Carefully examine the exemption schedules before making a selection. Once the selection of the schedule is made and the exemption is granted the owner is not permitted to change the method of exemption. 4 URBAN REVITALIZATION PLAN 211 Lynn Avenue 1. Property Address: A) 207 Lynn Avenue B) 213-215 Lynn Avenue (Properties will be combined into one parcel by plat of survey,following City Council's decision on the Urban Revitalization Area and Plan and demolition of the structures.) 2. Legal Description: The East 172 feet of Lot 17, Parker's Addition to Ames, Iowa, and beginning at the Southeast corner of Lot 5, Greer's Subdivision of Lot 24,Parker's Addition to Ames, Iowa,thence North 12.6 feet, thence in a Southwesterly direction to a point 10.9 feet North of the Southwest corner of said Lot 5, thence South 10.9 feet,thence East 153.6 feet to the point of beginning. and Lot One (1) and the North Sixteen and One-half(16'/2)) feet of Lot Two (2) in Hadley Hill's Subdivision of Lot Six (6) of Parker's Addition to Ames, Iowa, also known as H.T. Duration: December 31,2017 9. Relocation: The plan does not require the displacement of any persons, and there will be no relocation benefits provided. 10. Percent Increase in Value Required: The value-added requirement is a five (5) percent increase in actual value. 11. Federal, State,or Private Grant/Loan Programs for Residential Improvements: There are no grants or loans. 12. Existing Land Use: Single and Multi-Family Residential 13. Geocode: A) 09-09-201-030 B) 09-09-201-040 14. Tax Exemption Schedule: The exemption period is for either 3 years, 5 years, or 10 years. All qualified real estate is eligible for tax exemption of the value added by the improvements according to the terms of the exemption selected.
