HomeMy WebLinkAboutA001 - Council Action Form dated March 27, 2007 ITEM # ' DATE 03/27/07 COUNCIL ACTION FORM SUBJECT: TEXT AMENDMENT TO THE HEIGHT OF PRINCIPAL BUILDINGS IN THE HOSPITAL/MEDICAL DESIGN DISTRICT (S-HM) BACKGROUND: Changes Needed to Correct Errors. It has come to the attention of City staff that changes are needed to correct errors in the Municipal Code concerning the "minimum" and the "maximum" permitted height of buildings in the Hospital/Medical Design District (S-HM)." (See Table 29.1001(3) of the Municipal Code in this Commission Action Form.) The errors occurred as Ordinance No. 3595 was adopted by the City Council on October 24, 2000. The ordinance approved several revisions to the adopted zoning regulations. One of the ordinance revisions was intended to add "minimum building setbacks for buildings that are four stories tall, or taller" in the Hospital/Medical Design District. This revision was made; however, other changes were unintentionally made to Table 29.1001(3) which are described as follows: Unintentional Changes. • Deleted Text: "Maximum Height for a Principal Building - 80 feet or 6 stories, whichever is lower." • Changed Text: "Minimum Height for a Principal Building" was changed to read "Maximum Height for a Principal Building." These unintentional changes limit the maximum height of buildings to 20 feet or two stories, whichever is greater. The Code further states that if any nonconforming structure is enlarged to the extent of 50% or more in floor area, whether through a single or cumulative expansions, such addition shall conform to this requirement. This means that there is no height limit to additions to nonconforming structures so long as the floor area does not exceed 50%. Corrections. To correct these errors, the City Council must pass an ordinance to reverse the action that resulted in the unintentional changes. The ordinance to correct the errors would include the following: • Add back to Table 29.1001(3) the "Maximum Height for a Principal Building - 80 feet or 6 stories, whichever is lower." • Change the "Maximum Height for a Principal Building" back to the "Minimum Height for a Principal Building". Proposed Changes to the Minimum and Maximum Height of Principal Buildings in the S-HM District. The following illustrates the changes that are proposed to Table 29.1001(3) to correct unintentional errors in the table: Table 29.1001(3) Hospital/Medical Design District ("S-HM") Development Standards DEVELOPMENT STANDARDS REQUIREMENT Minimum Lot Area 6,000 s . ft. With a vote of 6-0, the Planning and Zoning Commission recommended approval of the proposed amendments to Table 29.1001(3) of the Municipal Code to change the development standards for the height of principal buildings in the "S-HM" (Hospital/Medical Design District) at its meeting of March 7, 2007. 2 ALTERNATIVES: 1. The City Council can approve the proposed amendments to Table 29.1001(3) of the Municipal Code to change the development standards for the height of principal buildings in the "S-HM" (Hospital/Medical Design District). 2. The City Council can deny the proposed amendments to Table 29.1001(3) of the Municipal Code to change the development standards for the height of principal buildings in the "S-HM" (Hospital/Medical Design District). 3. The City Council can refer this proposed text amendment back to staff for further information. MANAGER'S RECOMMENDED ACTION: Approval of this text amendment will correct errors that were unintentionally made to Table 29.1001, as other zoning ordinance amendments were adopted by the City Council. Therefore, it is the recommendation of the City Manager that the City Council approve Alternative No. 1 , which would approve the proposed amendments to Table 29.1001(3) of the Municipal Code to change the development standards for the height of principal buildings in the "S-HM" (Hospital/Medical Design District). 3
