HomeMy WebLinkAboutA001 - Council Action form dated February 27, 2007 t • • ©tD ITEM # " DATE February 27, 2007 COUNCIL ACTION FORM SUBJECT: AMEND GOLF CART OPERATION ON CITY STREETS ORDINANCE BACKGROUND: Currently, emergency service agencies such as the Police Department and Mary Greeley Medical Center utilize golf carts during special events in the community. The advantages for these emergency responders in the use of a golf cart over other motorized vehicles are the ease in getting around large crowds, equipment, and congested streets to more quickly address problems and health issues. The Police Department is interested in having the current golf cart ordinance amended to allow emergency providers to operate golf on city streets. The current ordinance states: Sec. 26.76. GOLF CART OPERATION ON CITY STREETS (1) No one shall operate a golf cart upon a city street except when done pursuant to a plan approved by the City Manager setting forth the specific streets, dates and conditions during which such operation is permitted. (2) A golf cart shall not be operated upon a city street which is a primary road extension through the city except to cross such street. (3) Golf carts operated on city streets shall be equipped with adequate brakes, a slow moving vehicle sign and a bicycle safety flag. Operators shall meet any other safety requirements imposed by the City Manager. (4) Golf cart operation on city streets shall be permitted only from sunrise to sunset and only by persons possession a valid motor vehicle license. (State Law Ref. Iowa Code Sec. 321.247; Ord. No. 3160, Sec. 1, 2-25-92) The Police Department recommends the ordinance be changed to read: Sec. 26.76. GOLF CART OPERATION ON CITY STREETS. (1) No one shall operate a golf cart upon a city street except: s (a) when done pursuant to a plan approved by the City Manager setting forth the specific streets, dates and conditions during which such operation is permitted, or (b) members of a law enforcement agency, fire department, and emergency medical personnel when working in an on-duty status. (2) A golf cart shall not be operated upon a city street which is a primary road extension through the city except to cross such street. (3) Golf carts operated on city streets shall be equipped with adequate brakes, a slow moving vehicle sign and a bicycle safety flag. Operators shall meet any other safety requirements imposed by the City Manager. (4) Golf cart operation on city streets shall be permitted only from sunrise to sunset and only by persons possessing a valid motor vehicle license. ALTERNATIVES: 1. Direct the City Attorney to draft an amended ordinance allowing members of a law enforcement agency, fire department, and emergency medical personnel when working in an on-duty status to operate a golf cart upon a city street. 2. Continue with the current ordinance as written. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt alternative number 1, thereby directing the City Attorney to draft an amended ordinance allowing members of the Police Department to operate a golf cart upon a city street when working in an on-duty status.
