HomeMy WebLinkAboutA001 - Council Action Form dated January 9, 2007 ITEM # DATE: 01-09-07 COUNCIL ACTION FORM SUBJECT: PARKING REGULATION AMENDMENT FOR SOUTH BELL AVENUE BACKGROUND: On November 24, 2006, staff was contacted by an employee of Syngenta Seeds Inc., located at 1524 South Bell Avenue, who expressed a traffic safety concern pertaining to on-street parking along South Bell Avenue. The employee stated that vehicles, which are parking along both sides of South Bell Avenue, create a hazard for two-way traffic traveling on the roadway. Currently, South Bell Avenue is a 31-foot wide roadway beginning from a point approximately 200 feet south of the southern edge of Graham Street to its southern terminus. This width typically supports parking on one side of the street in residential areas; however, South Bell Avenue resides in an industrial/commercial park. When considering the higher frequency of larger vehicles that use South Bell Avenue, staff recommended that parking be restricted on both sides of South Bell Avenue to allow proper access for fire protection. The restriction also allowed those larger vehicles to pass safely side-by-side through the narrower sections of roadway. Staff conducted research as to any existing regulations for South Bell Avenue and found that parking regulations prohibit parking on both sides of this section of roadway. However, this prohibition is located under the section of Municipal Code that pertains to Bell Avenue, specifically Section 18.31(23)(b). Staff recommends that the City Attorney be directed to make an amendment to relocate this language to the correct section, Section 18.31(223)(b) for South Bell Avenue. South Bell Avenue has been constructed in several phases, portions of which start from East Lincoln Way and continue south for just under a half-mile in length. At that point, the roadway ends; it continues for an additional 650 feet from its intersection with Southeast 16tn Street. Currently, the land in between the two roadway sections is undeveloped. A developer will be required to connect South Bell Avenue when developing the area. ALTERNATIVES: 1. Direct the City Attorney to draft an ordinance that amends the Municipal Code, thereby moving Section 18.31(23)(b) to Section 18.31(223)(b). 2. Reject the script amendment. MANAGER'S RECOMMENDED ACTION: This amendment would clarify both sections of Municipal Code, thereby allowing staff to properly sign and enforce parking regulations for all portions of South Bell Avenue. The change will also provide consistency for future additions of roadway as development occurs. Therefore, it is the recommendation of the City Manager that the City Council adopt Alternative No. 1, thereby directing the City Attorney to draft an ordinance that amends the Municipal Code to move Section 18.31(23)(b) to Section 18.31(223)(b).
