HomeMy WebLinkAbout~Master - Zoning text amendment for landscaping requirements for surfaced parking lots ORDINANCE NO. 3896 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES,IOWA,BY REVISION TO SECTIONS 29.403(4)(f)(i)AND 29.406(13) AND ENACTING A NEW SECTION 29.403(4)(g) THEREOF, FOR THE PURPOSE OF ALLOWING EXCEPTIONS TO THE MINIMUM LANDSCAPING REQUIREMENT FOR SURFACE PARKING LOTS; REPEALING ANY AND ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT TO THE EXTENT OF SUCH CONFLICT; PROVIDING A PENALTY;AND ESTABLISHING AN EFFECTIVE DATE. BE IT ENACTED,by the City Council for the City of Ames, Iowa,that: Section One. The Municipal Code of the City of Ames, Iowa shall be and the same is hereby amended by enacting a new Section 29.403(4)(g)as follows: g. The Department may approve a parking lot landscape plan submitted to it not conforming to the requirements of Section 29.403(4)(b)and 29.403(4)(c)when it conforms to an approved Master Plan or a Major Site Development Plan which the City Council has determined meets the purposes described in Section 29.403(4)(a). Section Two. The Municipal Code of the City of Ames, Iowa shall be and the same is hereby amended by enacting a new Section 29.403(4)(f)(i)and 29.406(13)and repealing Section 29.403(4)(fl(i)and 29.406(13)as follows: (i) The Department shall not approve any surface parking lot landscape plan submitted to it pursuant to this Section unless the plan conforms to the requirements of this Section or conforms to an approved Master Plan or a Maior Site Development Plan which the City Council has determined meets the purposes described in Section 29.403(4)(a). (13) Surface Parking Landscaping and Screening. Surface parking facilities must conform to the minimum landscaping and screening requirements set forth in Section 29.403(4)unless it is a part of an approved Master Plan or a Maior Site Development Plan which City Council deems acceptable under the purposes of Section 29.403(4)(a). Section Three.All ordinances,or parts of ordinances, in conflict herewith are hereby repealed to the extent of such conflict, if any. Section Four This ordinance shall be in full force and effect from and after its passage and publication as required by law. Passed this 121" day of December , 2006 .
