SUBJECT: AMENDMENT TO THE ZONING ORDINANCE TO ESTABLISH THE
SOUTHWEST GATEWAY OVERLAY DISTRICT (O-GSW)
BACKGROUND:
The City's Land Use Policy Plan (LUPP, "Community Entry Options," page 109,
December 20, 2005 edition) and Section 29.1104, "O-G" (Gateway Overlay) of the
City's Zoning Ordinance provide for enhancing the entries to Ames. This ordinance and
the LUPP identify the area of the South Dakota and U.S. Highway 30 interchange as
one of these entries to Ames. Section 29.1104(4) calls for the creation of ordinances
with standards for each specific gateway. On May 23, 2006, the City Council approved
draft standards for this Southwest Gateway and directed staff to prepare the Southwest
Gateway Overlay District (O-GSW) zoning ordinance.
At the first Planning and Zoning Commission hearing on the ordinance, the Commission
heeded a request from an interested property owner developing one of the properties
for more time to review the ordinance. The property owner, Mr. Bryan Kinnear, also
expressed interest in partnering with the City to provide pedestrian and gateway
amenities around the pond on his property, which has been a Commission priority for
the Southwest Gateway. (See Attachment A and further discussion under "Manager's
Recommended Action.")
Following review and questions by Mr. Kinnear, City staff recommended two revisions,
included in items 5 and 6 in the attached ordinance. These revisions clarify that when
collective parking is used, each site or parcel should stand on its own, for both number
of parking spaces and minimum landscaped area. (Note that the current "Remote
Parking" zoning standard in Code Section 29.406(18) can be used if the objective is a
different distribution of parking spaces among different sites.) At its meeting of July 19,
2006, with a vote of 6-0, the Planning and Zoning Commission recommended approval
of the attached amendment to the Zoning Ordinance to establish the Southwest
Gateway Overlay District.
The City Council is now being asked to approve this zoning ordinance establishing the
Southwest Gateway Overlay District (O-GSW).
ALTERNATIVES:
1. The City Council can approve the proposed Southwest Gateway Overlay District
(O-GSW) ordinance.
2. The City Council can deny the proposed Southwest Gateway Overlay District
(O-GSW) ordinance.
3. The City Council can approve the proposed Southwest Gateway Overlay District
(O-GSW) ordinance with modifications.
4. Action on this proposal can be postponed and referred back to City staff for
additional information.
MANAGER'S RECOMMENDED ACTION:
Development of a Southwest Gateway Overlay ordinance has been underway for
several years. In the area to which this proposed zoning district is applied, its provisions
will provide guidance for future development to be consistent with the City's land use
policies for the community's entryways. Therefore, the City Manager recommends
that the City Council adopt Alternative No. 1, which is a recommendation to
approve the proposed Southwest Gateway Overlay District (O-GSW) ordinance.
An important related issue is the potential for development of gateway amenities in
this gateway area. Attached is a letter from Bryan Kinnear (Attachment A), who is
developing one of the properties, stating his intention to create an attractive amenity
around the lake. Mr. Kinnear is very interested in identifying any support the City could
provide to help create an even more attractive entryway. This support could take the
form of property tax abatement, grants, loans, or other City investment. It also leads to
the question of who will own the entry amenity and who will maintain it.
In the case of the Southeast Gateway area, a partnership was formed between the City
and neighboring property owners to plan and create a gateway to Ames and the Dayton
Road area. Following City Council direction, the first step was preparing a conceptual
plan for the gateway, including proposed amenities. Both the City and the neighbors
funded this planning process, which involved all of the stakeholders in the area and in
the community's gateways. This conceptual plan was the basis for both public and
private amenities supported by combined funds. This work is still underway,
A first step to pursue this possibility for the Southwest Gateway is for the City
Council to direct staff to explore possible public-private collaboration for
conceptual design of entryway amenities in this area, and then report back to City
Council. This report would address a potential process, costs, and
responsibilities along with appropriate public review of that design.
ATTACHMENT A
Dear City Council:
My brother and I recently purchased 7 acres of land on the corners of Hwy 30, Mortensen
Rd and Dickensen Ave. We intend to develop this land into a family destination. This
area will include a large, family, bowling center. It could also include several restaurants
in a park like setting.
After some discussion with P &Z and Jeff Benson we understand that this area is
currently being considered for a rezoning(Gateway Overlay).
The land that Kinneer Land Development purchased has a substantial amount of water on
it. This "lake" covers over 2 acres of the 7 which we purchased. It also happens to be
very visible to the Ames' Gateway. Every car that enters Ames from the South
Dakota/Hwy 30 exit will view this water. It is the predominate feature of this gateway.
Currently there are no incentives to improve this water. We would like to ask Council
to investigate tax abatement, grants, partnerships, etc. to help us beautify this
feature. We envision a large fountain, landscaping(to include retaining walls), and
walk/bike paths around the lake that connect to the Ames path system. This area could
be both beautiful to our visitors and useful to our citizens.
We welcome an opportunity to discuss this plan in further detail with Council prior to
amending the current zoning ordinance.
