HomeMy WebLinkAboutA003 - Council Action Form dated May 23, 2006 f ITEM #: DATE: MaV 23, 2006 COUNCIL ACTION FORM SUBJECT: REZONING OF PROPERTY IN NORTHRIDGE HEIGHTS SUBDIVISION FROM "FS-RM" (SUBURBAN RESIDENTIAL MEDIUM DENSITY) TO "FS-RL" (SUBURBAN RESIDENTIAL LOW DENSITY) BACKGROUND: Applicant: Uthe Development Co., LLC Owner: Uthe Development Co., LLC Request: Rezone property from "FS-RM" (Suburban Residential Medium Density) to "FS" (Suburban Residential Low Density) Location: Former street right-of-way for Harrison Road east of the intersection of Stange Road and Harrison Road. Size: 2.85 Acres History/Proposal. The land proposed for rezoning is a section of the Northridge Heights Subdivision that was previously planned as an extension of Harrison Road to the east property line of the subdivision. Existing zoning north of the centerline of the right-of-way for Harrison Road is "FS-RL." Zoning south of the centerline is presently "FS-RM." Plans for the extension of Harrison Road were changed with the recent adoption of the Transportation Plan in which it was decided that Harrison Road would not cross the Union Pacific Railroad right-of-way into the Bloomington Heights West Subdivision. The developer is responding to this change in plans by proposing additional lots for the construction of single-family detached homes on land that is no longer planned as right-of-way for Harrison Road. To plat the lots for single-family homes, on land formerly planned as the southern one-half of Harrison Road right-of-way, the developer is now requesting rezoning from "FS-FM"to "FS-RL." Approximately nine and one-half lots will be platted (as shown on the Preliminary Plat) on the land proposed for rezoning. Land Use. The land proposed for rezoning and the surrounding land is not yet developed for residential land use. The property is presently used as agricultural crop land. Zoning. The request represents moving the "FS-RM"zoning boundary to the southeast for a distance of approximately 150 feet. The majority of lots proposed on land to be rezoned will have a lot depth of approximately 120 feet. The rezoning to "FS-RL" is consistent with the zoning for all other single-family detached houses in the Northridge Heights Subdivision. Land Use Policy Plan (LUPP) Goals and Policies. The change in the zoning boundary does not significantly change the designation of uses shown on the Master Plan for Northridge Heights Subdivision. These changes are in conformance with the density requirement of 3.75 for the FS-RL zoned area as outlined in the City's Zoning Ordinance (Table 29.1202(6)). Furthermore, the proposed changes are consistent with the location and density goals stated in the City's Land Use Policy Plan. Utilities and Infrastructure: Utilities are adequate to serve single-family homes on the land proposed for rezoning. Access/Streets. The land proposed for rezoning will be served with a new extension of Harrison Road that will not extend to the east boundary of the subdivision Fire/Emergency Response. The subject area is located beyond the City's response time goal of five minutes. STIPULATIONS: The following stipulations should be placed on the approval of the proposed rezoning for the 2.85 parcel in Northridge Heights Subdivision to assure that it will be developed consistent with the intent of the Zoning Ordinance, Subdivision Regulations, and other adopted plans and policies of the City of Ames. 1. That the revised Master Plan be approved to be consistent with the proposed rezoning. 2. That the revised Preliminary Plat be approved to be consistent with the revised Master Plan and rezoning. Recommendation of the Planning & Zoning Commission. With a vote of 5-0, the Planning & Zoning Commission recommended approval at its meeting of May 17, 2006 with the stipulations listed above. ALTERNATIVES: 1. The City Council can approve the rezoning of 2.85 acres of land in Northridge Heights Subdivision from "FS-RM" (Suburban Residential Medium Density) to "FS-RL" (Suburban Residential Low Density) with the stipulations listed above. 2. The City Council can deny the rezoning of 2.85 acres of land in Northridge Heights Subdivision from "FS-RM" (Suburban Residential Medium Density) to "FS-RL" (Suburban Residential Low Density). 3. Action on this request can be postponed and referred back to City staff and/or the applicant for additional information.
