COUCIL ACTION FORM
SUBJECT: AMENDMENT TO THE ZONING MAP FOR PROPERTY GENERALLY
LOCATED IN THE SOUTHERN PORTION OF "OUTLOT B", EAST
HICKORY PARK SUBDIVISION WEST OF THE PROPOSED RIGHT-
OF-WAY FOR RELOCATED DAYTON AVENUE FROM "HOC"
(HIGHWAY-ORIENTED COMMERCIAL) TO "A" (AGRICULTURAL)
BACKGROUND:
Property Owner. Hickory Park, Inc. Attn: David Wheelock
Request. Zoning Map amendment to zone all of "Outlot B" as "A" (Agricultural), and
relocate the zoning boundary between the "A" (Agricultural) district and the
"HOC" (Highway-Oriented Commercial) zoning district to follow the lot
lines for "Outlot B".
Size. Approximately 411,131 square feet (9.5 acres)
Rezoning Initiated by the City. This is a rezoning proposal initiated by City staff to
address a problem in assigning property identification numbers (geo-code) to the lots in
the East Hickory Park Subdivision. "Outlot B" in the East Hickory Park Subdivision is
presently divided between the "HOC" and "A" zoning districts. The boundary line
between the two zoning districts was established by an earlier rezoning that occurred
prior to the platting of the East Hickory Park Subdivision. The Ames City Assessor's
Office will not assign the property identification numbers until the zoning boundaries are
adjusted to follow the property lines established by the Final Plat of East Hickory Park
Subdivision.
Until the property identification numbers are assigned by the City Assessor's Office,
permits cannot be issued to allow building construction and utility services for Lot 1 in
the East Hickory Park Subdivision. Site work is underway on Lot 1 to construct
Theisen's Home-Farm-Auto Store. In the near future, building construction is scheduled
to begin, at which time it will be necessary that permits be issued for electric service and
building construction. The rezoning, to adjust zoning boundary lines to match the new
platted lot lines, is necessary for the City Assessor's Office to recognize the new lots for
assessment purposes that will in turn enable the issuance of permits, based on property
identification numbers.
Boundaries for Zoning Districts to Follow New Platted Lot Lines. City staff propose
that the southern portion of "Outlot B" be rezoned from "HOC" to "A" to follow the platted
lot lines, so as not to divide "Outlot B" between the "A" and "HOC" zoning districts. The
rezoning affects land that is undeveloped and a storm water detention basin for East
Hickory Park Subdivision. At the time that "Outlot B" is proposed for replatting and
development, staff recognizes that it will be necessary to rezone "Outlot B" from the "A"
zoning designation to "HOC" or "GI" (General Industrial) for the purpose of commercial
and/or industrial development. Until such time as development is proposed, the "A"
(Agricultural) zoning designation is appropriate given the undeveloped condition of the
property.
Recommendation of the Planning & Zoning Commission. At its meeting of
February 15, 2006, with a vote of 7-0, the Planning and Zoning Commission
recommended approval of the rezoning of land generally located in the southern portion
of "Outlot B", East Hickory Park Subdivision, west of the proposed right-of-way for
relocated Dayton Avenue from "HOC" (Highway-Oriented Commercial) to "A"
(Agricultural).
ALTERNATIVES:
1 . The City Council can approve the rezoning of land generally located in the southern
portion of "Outlot B", East Hickory Park Subdivision, west of the proposed
right-of-way for relocated Dayton Avenue from "HOC" (Highway-Oriented
Commercial) to "A" (Agricultural).
2. The City Council can deny the rezoning of land generally located in the southern
portion of "Outlot B", East Hickory Park Subdivision, west of the proposed
right-of-way for relocated Dayton Avenue from "HOC" (Highway-Oriented
Commercial) to "A" (Agricultural).
3. The City Council can approve the rezoning of land generally located in the southern
portion of "Outlot B", East Hickory Park Subdivision, west of the proposed
right-of-way for relocated Dayton Avenue from "HOC" (Highway-Oriented
Commercial) to "A" (Agricultural).
4. The City Council can postpone action on this rezoning proposal by the City and refer
it back to City staff for additional information.
MANAGER'S RECOMMENDED ACTION:
Rezoning of the land in the East Hickory Park Subdivision to have the zoning
boundaries follow established lot lines will enable the property owner and developer to
continue without delay the development of Lot 1 for commercial purposes, consistent
with the "HOC" (Highway-Oriented Commercial) zoning designation. This is a situation
where rezoning occurred prior to the division of the land into platted lots, and now the
zoning boundaries need to be adjusted to follow the newly established lot lines.

Therefore, it is recommendation of the City Manager that Alternative #1 be
adopted. Alternative #1 is a recommendation that the City Council approve the
rezoning of land generally located in the southern portion of "Outlot B", East Hickory
Park Subdivision, west of the proposed right-of-way for relocated Dayton Avenue from
"HOC" (Highway-Oriented Commercial) to "A" (Agricultural).
To expedite the rezoning and not delay commercial construction on Lot 1, the City
Council will be asked, by City staff, to suspend the rules and to pass the ordinance to
rezone the property at the same meeting as the public hearing for the rezoning.
