COUNCIL ACTION FORM
SUBJECT: AMENDMENT TO THE ZONING MAP FOR PROPERTY GENERALLY
LOCATED IN THE VICINITY OF SOUTHEAST 16T" STREET AND DAYTON AVENUE TO
REMOVE THE SOUTHEAST GATEWAY OVERLAY DISTRICT (O-GSE) DESIGNATION
SUMMARY: Staff is proposing a rezoning to shift the boundary of the O-GSE
(Southeast Gateway Overlay) District 120 feet to the south in order to coincide
with a proposed lot line associated with property currently under consideration
for rezoning to HOC — Highway Oriented Commercial.
BACKGROUND:

Request: Map amendment to remove O-GSE (Southeast Gateway Overlay) zoning
designation
Size: 3 Acres +
In August 2004, the "O-GSE" (Southeast Gateway Overlay) was created to provide for
enhancing the southeast and Dayton Avenue entries to Ames. This new overlay zoning
district was applied to an area west of the I-35/U.S. Highway 30 interchange and north
of U.S. Highway 30 and to the commercial property within the city limits to the south
(see Attachment A). According to the underlying base zoning, commercial uses in this
overlay district were expected to continue to expand north of this area, transitioning to
industrial uses to the east and north.
At that time, the property east of relocated Dayton Avenue was platted and improved for
development and property to the west was undeveloped agricultural property. That
property west of Dayton Avenue is now being considered for rezoning, platting, and
development. Staff is recommending that the north boundary line of the O-GSE
(Southeast Gateway Overlay) zoning district be adjusted to coincide with the proposed
pattern of development.
The owner of land west of Dayton Avenue has proposed that the area be divided into
three parcels. These are positioned such that the O-GSE zoning district boundary will
cut through one of the parcels, putting the south 120 feet of that parcel into that overlay
district, and putting the larger portion of that parcel out of that overlay district (see
Attachment A).
The current zoning of the subject property is "A" (Agricultural) and "O-GSE" (Southeast
Gateway Overlay). The owner has requested a change in the base zoning to Highway-Oriented
Commercial (HOC). The O-GSE zoning designation restricts permitted uses and adds
development standards for the area generally intended to promote the appearance of an entryway
and help create an attractive visual environment and a welcoming first impression.
RECOMMENDATION OF THE PLANNING & ZONING COMMISSION:
With a vote of 4-0 and one abstention, the Planning and Zoning Commission
recommended approval of the zoning map amendment at its meeting of May 18, 2005.
ALTERNATIVES:
1. The City Council can approve the rezoning of property generally located in the
vicinity of Southeast 16th Street and Dayton Avenue to remove the Southeast
Gateway Overlay District (O-GSE) designation.
2. The City Council can deny the rezoning of property generally located in the vicinity of
Southeast 16th Street and Dayton Avenue to remove the Southeast Gateway
Overlay District (O-GSE) designation.
3. The City Council can approve the rezoning of property generally located in the
vicinity of Southeast 16th Street and Dayton Avenue to remove the Southeast
Gateway Overlay District (O-GSE) designation, with modifications.
4. The City Council can postpone action on this proposal and refer it back to City staff
for additional information.
MANAGER'S RECOMMENDED ACTION:
The location of the north boundary of the O-GSE district was positioned to define an
area that has a prominent visual impact of views from U.S. Highway 30 and the Dayton
Avenue exit. It was expected and planned that the commercial land uses would
continue north of the O-GSE district; a large parcel outside the O-GSE district had HOC
as its base zone at the time the O-GSE district was established. The exact location of
this north zoning district line was based on platted lots east of Dayton Avenue. Its
location would now be adjusted based on platted lots west of Dayton Avenue.
Not adjusting this boundary would mean that the O-GSE requirements still apply to the
southern part of the property, not all of it. For example, parking lot landscaping on the
south portion would have to be native grasses and flowers, but in the north portion it
could be shrubs. However, if there are any conflicts between requirements, then the
more restrictive requirement might prevail. Completely removing the O-GSE zoning
designation from this one parcel would avoid conflicts in zoning requirements.

One primary objective of the design standards of the O-GSE district is to prevent the
construction of metal system buildings such as are typically found in agricultural and
industrial districts. The proposed relocation of the north boundary of this district will
continue to allow commercial uses with these agricultural and industrial building types,
north of the entry area, serving as a transition to the industrial area further north.
Therefore, it is recommended that Alternative #1 be adopted. Alternative #1 is a
recommendation that the City Council approve the rezoning of property generally
located in the vicinity of Southeast 16th Street and Dayton Avenue to remove the
Southeast Gateway Overlay District (O-GSE) designation. This action would make a
minor adjustment in the zoning overlay boundary and not substantially change the
implementation of the community's goals for the appearance of its entryways.
