HomeMy WebLinkAboutA003 - Council Action Form dated April 12, 2005 A ITEM # /U DATE 4/12/05 COUNCIL ACTION FORM SUBJECT: REZONING OF PROPERTY GENERALLY LOCATED IN THE AREA OF WOODVIEW DRIVE AND OAKWOOD ROAD FROM "A" (AGRICULTURAL) TO "RL" (RESIDENTIAL LOW DENSITY) BACKGROUND: The subject property was annexed by City Council action on December 23, 2003, along with the "Ringgenberg Farm" property. Such annexed land comes into the City zoned "A" (Agricultural). Since rezoning of the Ringgenberg property has now been requested, this is an opportune time to rezone this property in the vicinity of Woodview Drive to a classification consistent with its use, ANALYSIS: Existing Land Use. The area to be rezoned is 27.32 acres. This area is currently zoned "A" (Agricultural). Existing use of properties on Woodview Drive is single-family detached residential units. This rezoning also includes a property with a house on Timberland Road, a vacant property on Timberland Road, a vacant property on Oakwood Road, and the Ontario Bible Church on Oakwood Road. The current agricultural zoning classification does not meet the general purpose of the existing use of the property. The surrounding land is comprised mostly of single-family detached residential units, with some medium density single-family attached residential units northeast in the Green Hills retirement community. To the southwest is agricultural land, which includes the proposed Ringgenberg Park development of attached and detached single-family homes. Proposed Land Use. The proposed "RL" (Residential Low Density) zoning designation is consistent with the existing use of the property for single-family detached homes. Development of the vacant parcels for single-family detached homes would also be consistent with their surroundings. The use of the Ontario Bible Church property as a religious institution is an allowable use in the RL zoning classification, although further development of that property would now require approval of a Special Use Permit. Land Use Policy Plan (LUPP) Goals and Policies. Rezoning the subject area to "RL" (Residential Low Density) is consistent with the Land Use Policy Plan and Future Land Use Map. The redevelopment of the property supports the Plan's goals and objectives for orderly and predictable growth, compatible land uses, and infill. RECOMMENDATION OF THE PLANNING & ZONING COMMISSION: With a recommendation of 4-0, the Planning and Zoning Commission approved this rezoning proposal at its meeting of March 16, 2005. ALTERNATIVES: 1. The City Council can approve the rezoning of the property in the area of Woodview Drive and Oakwood Road from "A" (Agricultural) to "RU (Residential Low Density). 2. The City Council can deny the rezoning of property in the area of Woodview Drive and Oakwood Road from "A" (Agricultural) to "RU (Residential Low Density). 3. Action on this request can be postponed and referred back to City staff and/or the applicant for additional information. CITY MANAGER'S RECOMMENDED ACTION: It is recommended that Alternative #1 be approved. Alternative #1 is a recommendation to rezone the subject area to RL, making the zoning of this recently annexed area consistent with its existing use.
