HomeMy WebLinkAboutA002 - Staff Report STAFF REPORT Zoning Changes in the Community Commercial Node at U.S. 30 and South Dakota BACKGROUND On December 21, 2004 the City Council took action to eliminate residential uses from the City's Community Commercial Node zoning provisions, while allowing continued mixed use buildings (residential uses only above commercial uses on the first floor) in three specific areas already developed, or soon to be developed near the interchange of U.S. 30 and South Dakota. Attachment A illustrates these areas, with "CCN" indicating areas to be developed as commercial uses without residential uses and "CCR" indicating areas to be developed with both commercial and residential uses. At that time Council also directed staff to work with the developer of the proposed West Towne Apartments to convert this mixed-use development to only high-density residential uses. RECENT FINDINGS Since December 21 , staff has met with the West Towne developer, Matt Ellers, and the owner of other property yet to be developed, Dickson Jensen, and reports: • The West Towne will continue to develop as eight mixed-use buildings, under the site plan that the Council saw previously. The project is being developed in phases, with the four buildings on the north now under construction. • Rather than split the large property at the north end of this area into CCR on the west (along Dickinson), and CCN on the east (along South Dakota), the property owner would prefer this allowance of residential uses above the first floor (CCR) to be available on the parcel at the south end of Dickinson Avenue, on its west side. This would leave commercial uses only across this entire parcel at the north, between Dickinson and South Dakota. (see Attachment B) NEXT STEPS Staff believes that this request to switch the location of future mixed uses is consistent with the intent of the Council's action of December 21 and is proceeding with the necessary zoning actions to implement these policies.
