Schainker, City Manager DATE: November 23, 2004 SUBJECT: Zoning Agreement—East 13`h Street Overlay At the previous City Council meeting, you took formal action to support the approval process reflected in Option 2 that will require a zoning agreement be approved prior to rezoning the land within the 13' Street Overlay District. Since a rezoning request has been submitted and a preferred approval process has been identified for the area, it is possible for the staff to begin negotiations with the developers as we simultaneously process the rezoning request. The Council members also indicated at this meeting that you would like to give some direction at the November 23rd meeting regarding the specific issues that should be covered in a zoning agreement prior to the staff finalizing negotiations with the developers. In attempt to facilitate this policy direction, I have provided on the back page a worksheet listing the issues that I reflected in our last staff report. This was never meant to be the final list of issues for negotiations. It was understood that the City Council might want to add to this list of issues or eliminate some of the issues from the list. Your direction in this matter will be greatly appreciated so that the staff can negotiate the type of agreement you are seeking.
