Thanks for taking the time to discuss the matter with me this morning. Finding a permanent precinct for land in Ames that lies east of the legislative district line,without moving the district line,is a real challenge. One possibility could be to create another precinct in the first ward. The problem with that is finding fifty registered voters that the new precinct could be drawn around. As you know,the area in question is part of a vast commercial and industrial area in which no one resides. Few people in Ames reside east of the Skunk River. There is an exception to the requirement that each precinct be contained wholly within an existing legislative district when adherence to that requirement would force creation of a precinct that has fewer than fifty registered voters. That exception, in Subsection 49.3(2)(a), plus the annexation attachment provision of Section 49.8(2), arguably makes our present arrangement legal until comprehensive reprecincting is done in response to the next federal census. Another alternative, as you suggest,would be to not assign this commercial area to any precinct in Ames. If the Secretary of State,with a supporting Attorney General's opinion,concludes that to be the proper approach,I will bring that proposal to the City Council with a measure to amend the precinct assignment ordinance enacted August 24, 2004. Ames Resolution 04-229, which we originally requested to be assigned to Ward 1 Precinct 3, crosses a Legislative boundary. The area included in the annexation should be assigned to Milford Township instead of W 1 P3. In addition, I am requesting that Ames Resolution 03-481 be assigned to Ward 3 Precinct 5. I am enclosing a map indicating the areas involved. To complete real estate and election records, I am requesting a Resolution from the City of Ames acknowledging the annexed territories with the established precincts.
