BE IT ENACTED,by the City Council for the City of Ames,Iowa,that: Section One. The Municipal Code of the City of Ames, Iowa shall be and the same is hereby amended by repealing Subsection 23.102(2()b)and re-enacting the same to state as follows: "(b) These Regulations govern any plat for subdivision of any area of land within the City or outside the City but within two miles of the City boundaries,including any plat of survey,within Story County or Boone County,Iowa." Section Two. The Municipal Code of the City of Ames,Iowa shall be and the same is hereby amended by repealing Subsection 23.301(5)(d)and re-enacting the same to state as follows: "(d) City staff may classify a proposed adjustment of lot lines between owners of contiguous officially platted lots as a minor subdivision if: (1) No more than the same number of lots or a fewer number of lots exist after the adjustment. (2) The lots resulting from the adjustment conform to the then current requirements of the zoning ordinance of the City and the subdivision regulations of the City;and, (3) Such adjustment of lots lines is not contrary to the goals and objectives of the Land Use Policy Plan of the city,or the Transportation,Parks Master Plan,or any other plan,regulation or ordinance of the City of Ames,Iowa." Section Three. Violation of the provisions of this ordinance shall be a municipal infraction punishable by a penalty of$500 for a person's first offense,and a penalty of$750 for each repeal violation. Section Four. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict,if any. Section Five. This ordinance shall be in full force and effect from and after its passage and publication as required by law. Passed this 271"day of January,2004. Diane R. The ordinance must be recorded in both Boone and Story County to meet the requirement of section 354.9(1) Code of Iowa. Can you take care of this please?
