AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF
AMES, IOWA, BY REPEALING SECTIONS AND SUBSECTIONS 10.12,
17.6(4),22.3(3)(a),22.3(4),22.4(3)(h),22.14(5),26.66(3),AND 27.6(1),AND
ENACTING NEW SECTIONS AND SUBSECTIONS 10.12, 17.6(4), 17.6(5),
22.3(3)(a), 22.3(4), 22.4(4), 22.14(5), 22.66(3), AND 27.6(1) FOR THE
PURPOSE OF REVISING INSURANCE REQUIREMENTS FOR VARIOUS
REGULATED ACTIVITIES;REPEALING ANY AND ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT TO THE EXTENT OF SUCH
CONFLICT; PROVIDING A PENALTY; AND ESTABLISHING AN
EFFECTIVE DATE.
BE IT ENACTED,by the City Council for the City of Ames,Iowa,that:
Section One. The Municipal Code of the City of Ames, Iowa shall be and the same is hereby amended by
repealing Sections and Subsections 10.12,17.6(4),22.3(3)(a),22.3(4),22.14(5),26.66(3)and 27.6(1) and enacting new
Sections and Subsections revised as follows:
"Sec.10.12. INSURANCE AFFIDAVIT; CONTENTS;LIABILITY COVERAGE.
(1) Contents. The certificate or affidavit of insurance to be filed with the application
for a license hereunder shall be executed by representatives of a duly qualified insurance company
evidencing that the insurance company has issued liability and property damage insurance policies
covering the following:
(a) All operations of the applicant, or any other person employed by the
applicant in garbage and refuse collection within the corporate limits of the city;
(b) The disposal of the garbage and refuse to and within any area designated
as a sanitary landfill by the city;
(c) Protecting the public and any person from injuries or damages sustained
by reason of carrying on the work of garbage and refuse collection and disposal.
(2) Applicant shall procure and maintain, for the duration of the license period,
insurance against claims for injuries to persons or damages to property which may arise from or in
connection with the function for which the license is issued.
Applicant shall furnish the City of Ames with certificates of insurance evidencing the
following coverages:
(a) Comprehensive General Liability with limits of no less than$1,000,000
combined single limits per occurrence for bodily injury,personal injury and property damage.
(b) Automobile Liability with limits of no less than $1,000,000 combined
single limits per occurrence for bodily injury,personal injury and property damage.
(c) Worker's Compensation and Employer's Liability as required by the laws
of the State of Iowa.

(3) The approved insurance certificate must be on file in the office of the City Clerk,
before a license will be issued.

Sec. 17.6. FIREWORKS,USE REGULATED.
(4) An insurance certificate naming the City of Ames,its officers,and employees as an
additional insured with comprehensive general liability limits in the amount of$500,000 combined
single limit shall be in full force and effect during the life of the fireworks permit. The coverage shall
be at least as broad as the ISO Form Number CG0001 covering commercial general liability written
on an occurrence basis only. A copy of the current insurance certificate shall be maintained on file
with the City Clerk.
(5) A violation of a provision of this section pertaining to the use or exploding of
fireworks shall be a municipal infraction punishable by a penalty of$50.00 for a person's first
violation and $100.00 for each repeat violation. Alternatively, a violation of this section can be
charged by a peace officer of the city as a simple misdemeanor.

Sec.22.3. ENCROACHMENTS.
(3) Approval.
a) The city council may, after investigation, approve,modify or reject the
application. An insurance certificate naming the City of Ames, its officers, and employees as an
additional insured with comprehensive general liability limits in the amount of$500,000 combined
single limit shall be in full force and effect during the life of the encroachment permit. The coverage
shall be at least as broad as the ISO Form Number CG0001 covering commercial general liability
written on an occurrence basis only. A copy of the current insurance certificate shall be maintained
on file with the City Clerk.
(4) Issuance of permit;records.Upon approval of an application for an encroachment
permit by the city council or city traffic engineer,the city clerk shall,upon receipt of the Certificate
of Insurance, collect the payment of a minimum fee of twenty-five dollars ($25.00) or one dollar
($1.00)per square foot of encroachment,whichever is the larger amount, and issue the permit and
retain a record thereof. The permit issued shall set forth in detail any requirements imposed by the city
council or city traffic engineer in granting the permit.

Sec.22.4. TEMPORARY OBSTRUCTIONS.
(4) Insurance. An insurance certificate naming the City of Ames, its officers, and
employees as an additional insured with comprehensive general liability limits in the amount of
$500,000 combined single limit shall be in full force and effect during the life of any temporary
obstruction permit,including a permit for a sidewalk cafe. The coverage shall be at least as broad as
the ISO Form Number CG0001 covering commercial general liability written on an occurrence basis
only. A copy of the current insurance certificate shall be maintained on file with the City Clerk.
Sec.22.14. APPLICATIONS.
(5) An insurance certificate naming the City of Ames,its officers,and employees as an
additional insured with comprehensive general liability limits in the amount of$500,000 combined
single limit shall be in full force and effect during the life of the street vendors license. The coverage
shall be at least as broad as the ISO Form Number CG0001 covering commercial general liability
written on an occurrence basis only. A copy of the current insurance certificate shall be maintained
on file with the City Clerk.

Sec.26.66. PEDESTRIAN USE OF THE ROADWAY.
(3) Roadways shall not be used for a foot race without a city permit. Permits may be
issued by the City Clerk after an application is received on forms provided by the Clerk when,after
review of the plans for the race by the Department of Public Works and the Police Department,the
City Manager,finding no basis to conclude that the event cannot occur safely and consistent with the
public interest,approves the plan.An insurance certificate naming the City of Ames,its officers,and
employees as an additional insured with comprehensive general liability limits in the amount of
$1,000,000 combined single limit shall be in full force and effect during the life of the foot race
permit. The coverage shall be at least as broad as the ISO Form Number CG0001 covering
commercial general liability written on an occurrence basis only. A copy of the current insurance
certificate shall be maintained on file with the City Clerk. Under such permit, a roadway may be
temporarily closed to vehicular traffic for the duration of the race. A permit fee shall be charged in
such amount as shall be established from time to time by the City Council,with additional charges to
cover the costs of any special services provided by the City to facilitate the event.
Sec.27.6. INSURANCE REQUIRED.
(1) An insurance certificate naming the City of Ames,its officers,and employees as an
additional insured with comprehensive general liability limits in the amount of$500,000 combined
single limit shall be in full force and effect during the life of the tree surgeons license. The coverage
shall be at least as broad as the ISO Form Number CG0001 covering commercial general liability
written on an occurrence basis only. A copy of the current insurance certificate shall be maintained
on file with the City Clerk."
Section Two. Violation of the provisions of this ordinance shall constitute a municipal infraction punishable
as set out in Section 1.9 of this Code.
Section Three. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of
such conflict,if any.
Section Four. This ordinance shall be in full force and effect from and after its passage and publication as
required by law.
