HomeMy WebLinkAboutA003 - Council Action Form dated October 28, 2003 v ITEM # DATE 10/28/03 COUNCIL ACTION FORM SUBJECT: REZONING OF OUTLOT "S" IN THE FIRST ADDITION OF DAUNTLESS SUBDIVISION FROM RESIDENTIAL MEDIUM DENSITY (RM) TO RESIDENTIAL LOW DENSITY (RL). BACKGROUND: Applicant request. The applicant is requesting the rezoning of Outlot "S" in the First Addition of Dauntless Subdivision from Residential Medium Density (RM) to Residential Low Density (RL). The subject property is located north of Mortensen Road, east of Miller Avenue, south of Clemens Boulevard, and west of Dickinson Avenue. The subject area is comprised of 13.1 acres. The applicant's request is a result of the stipulations City Council placed on approval of the future subdivision of Outlot "S". In Resolution 01-510, City Council put the stipulation on Outlot"S"that it be rezoned to Residential Low Density prior to approval of any subsequent Final Plat. In other words, a future developer of the property would have to rezone the property to RL before it could be subdivided for single-family homes. ANALYSIS. Land Use. The subject parcel is bounded by Residential Low Density uses to the north and west, Residential Medium Density and Residential High Density uses to the south and east, and vacant commercial ground to the south and southeast. The outlot located to the west of the subject outlot is reserved for a future school site. Rezoning the subject property to RL is consistent with surrounding land uses. Zoning. The existing zoning of the subject property is Residential Medium Density (RM). City Council placed the stipulation on the Longview Subdivision Preliminary Plat that the subject property be rezoned to RL before it is further subdivided. Council's mandate is to assure that the proposed single-family lots could not be combined in the future to accommodate more dense residential uses. Even though RM zoning permits single-family homes, City Council required a guarantee to give surety to future single-family homeowners that the area will remain as single-family homes. Utilities. Since the subject area is a developing subdivision, all adjacent and planned utilities are and will be of sufficient size to serve a single-family development. Emergency Response. The subject property is located in an area that is within a five-minute response time. This property is located in part of the city that comprises 85%of the area that is within the City's desired response time. It is an ideal location for single-family housing development. Land Use Policy Plan (LUPP) Goals and Policies. Rezoning the subject area to Residential Low Density is consistent with the Land Use Policy Plan and Future Land Use Map. RECOMMENDATION OF THE PLANNING & ZONING COMMISSION: The Planning & Zoning Commission recommended approval of this rezoning request at their meeting of October 15, 2003. ALTERNATIVES: 1. The City Council can approve the rezoning of Outlot "S" located in the First Addition of Dauntless Subdivision from Residential Medium Density (RM)to Residential Low Density (RL). 2. The City Council can deny the rezoning of Outlot "S" located in the First Addition of Dauntless Subdivision from Residential Medium Density (RM) to Residential Low Density (RL). 3. Action on this request can be postponed and referred back to City staff and/or the applicant for additional information. CITY MANAGER'S RECOMMENDED ACTION: City Council placed a stipulation on the subject outlot to assure it was rezoned to RL before it was further subdivided. Therefore, it is recommended that Alternative #1 be approved. Alternative#1 is a recommendation to rezone the subject area to Residential Low Density and allow for future subdivision of the outlot for single-family residential lots.
